About this opportunity
The Naval Surface Warfare Center Indian Head Division (NSWC, IHD), a component of the Department of the Navy Naval Sea Systems Command, has issued a Special Notice of Intent to Sole Source a firm fixed price contract to Foster Miller Inc. for an FMS Poland PL-P-LBR Operational License. The notice, published on March 24, 2025, indicates the government's plan to award a noncompetitive contract under Federal Acquisition Regulation (FAR) 13.106(b). The contract falls under the North American Industry Classification System (NAICS) code 334511 for Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing. The sole source determination is based on Foster Miller Inc. being the only known source capable of meeting the government's specific requirements.
Interested parties have until April 8, 2025, at 10:00 AM EST to respond to the notice and potentially challenge the sole source decision. To be considered, vendors must be registered in the System for Award Management (SAM) and submit written documentation via email to Rebecca Maddox, demonstrating clear and convincing evidence that competition would be advantageous to the government. Oral communications are not acceptable, and all responses must provide concise documentation indicating the vendor's capabilities. The government retains sole discretion in determining whether to conduct a competitive procurement, and respondents will not be reimbursed for any costs incurred in preparing their submissions. The contract will be awarded using other than full and open competition procedures, specifically under the authority of 10 U.S.C. 2304 (C) (1), with the ultimate goal of procuring the operational license for the specified system.
