About this opportunity
The Consumer Product Safety Commission (CPSC) has issued a Special Notice announcing its intention to award a sole-source contract to Summit Point Training Facility (SPTF) located in Summit Point, West Virginia for fireworks testing facility support. This procurement is being conducted under the authority of FAR 6.302-1 and 41 U.S.C. 253(c)1, which permits sole-source awards when only one responsible source can satisfy agency requirements. The CPSC requires specialized testing and evaluation capabilities for consumer fireworks classified as 1.4G, which are small fireworks sold to the general public and regulated under the Federal Hazardous Substances Act. SPTF has been identified as the only facility capable of meeting the agency's specific operational needs, making this a sole-source procurement. The Special Notice was posted on November 13, 2025, and will be awarded as a simplified acquisition under FAR Subpart 12 and FAR Subpart 13 procedures.
Interested contractors have until December 5, 2025, at 12:00 PM Eastern Time to submit written responses or capability statements demonstrating their ability to meet the CPSC's requirements. Submissions must be emailed to the Contract Specialist at apatel@cpsc.gov, and phone calls will not be accepted. The contract will be structured as a five-year agreement with a base year from November 1, 2025, through October 31, 2026, followed by four optional 12-month renewal periods extending through October 31, 2030. The testing facility must accommodate two 20' x 40' Department of Defense approved explosives magazines, a Conex storage container, and a 100' x 100' open test range while being located within driving distance of the CPSC National Product Testing and Evaluation Center in Rockville, Maryland. Although this notice indicates a sole-source award to SPTF, the government will consider all responses received within seven business days and retains sole discretion to determine whether to compete this procurement based on submissions received.
Notice text
The Consumer Product Safety Commission (CPSC) announces its intention to issue a sole source award to Summit Point Training Facility (SPTF) – 201 Motorsports Park Circle, Summit Point, WV for testing facility for the purpose of testing and evaluating consumer fireworks. The Consumer Product Safety Commission (CPSC) requires testing support for the evaluation and storage of regulated consumer fireworks. Consumer fireworks (classified as 1.4G) are small fireworks that are sold for use by the general public and are generally weaker in explosive power used in professional displays (classified as 1.3G). Fireworks are regulated under the Federal Hazardous Substances Act (FHSA) and a variety of voluntary standards. Summit Point Training Facility (SPTF) has a range facility suitable for the testing and storage of consumer fireworks. Summit Point Training Facility is the only one responsible source available for this type of service therefore this requires a sole source award to Summit Point Training Facility.
CPSC intends to negotiate this requirement under the authority of FAR 6.302-1 and 41 U.S.C. 253(c)1. The sole source procurement will be awarded as a simplified acquisition in accordance with FAR Subpart 12 & FAR Subpart 13 procedures. Interested persons may identify their interest and submit a capability statement demonstrating their ability to meet this requirement.
This notice of intent is not a request for competitive quotations; however, all quotations/responses received within seven (7) business days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed procurement based upon responses to this notice is solely within the discretion of the Government. Any quotation/response must be in writing and can be sent via email to the Contract Specialist at apatel@cpsc.gov by 12:00 PM Eastern Time December 5, 2025. No phone calls will be accepted.
