Consumer Product Safety Commission
About this file
This document is a Justification for Other than Full and Open Competition issued by the Consumer Product Safety Commission (CPSC) for a sole-source contract to obtain a testing facility for consumer fireworks. The contract is a 5-year agreement with a base year from 11/01/2025 to 10/31/2026 and four potential 12-month option periods through 10/31/2030. Summit Point Training Facility (SPTF) in Summit Point, WV is the sole identified vendor capable of meeting CPSC's specific requirements, which include a pad site for two 20' x 40' Department of Defense approved explosives magazines, a Conex storage container, and a 100' x 100' open test range within driving distance of the CPSC National Product Testing and Evaluation Center in Rockville, MD.
The justification specifies unique requirements for the testing facility, such as being located far from residential areas, having a flat and obstruction-free test range, and enabling same-day testing and travel. After an extensive search of Maryland, Virginia, Pennsylvania, and West Virginia, CPSC determined that SPTF is the only facility willing and able to accommodate their precise needs for storing and testing consumer fireworks (classified as 1.4G). The document justifies the sole-source procurement under the category of "Only one responsible source and no other supplies or services will satisfy agency requirements."

Consumer Product Safety Commission Revised: 5/06/19 Office of Procurement Services Reviewed/Current 5/06/19
Justification for Other than Full and Open Competition
1. Requisition number and title:
2. Description of the Supplies and Services Required:
Testing facility needed for the purpose of testing and storing consumer fireworks.
3. Period of Performance:
This is a 5 year contract with a base period of one (1) year and four (4) twelve-month option periods, if exercised each year, will run sequentially.
Base year: 11/01/2025 – 10/31/2026 Option year 1: 11/01/2026 – 10/31/2027 Option year 2: 11/01/2027 – 10/31/2028 Option year 3: 11/01/2028 – 10/31/2029 Option year 4: 11/01/2029 – 10/31/2030
4. Estimated Value (to include options):
5. Description of effort made to ensure that offers are solicited from as many potential sources as practical:
Only Summit Point Training Facility (SPTF) can provide an adequate testing facility that can meet the CPSC’s requirements for storing and testing consumer fireworks (See section 7).
6. Reason for Other Than Full and Open Competition (check one):
X a. Only one responsible source and no other supplies or services will satisfy agency requirements.
b. Only a particular Brand Name item can meet the Government’s need.
c. Unusual and compelling urgency.
d. Industrial mobilization; engineering, developmental, or research capability; or expert services.
e. International agreement.
f. Authorized or required by statute.
g. National security.
h. Public interest (must be approved by Chairman).
7. Justification for sole source (not competing the requirements):
CPSC requires a testing facility that can accommodate both the storage and testing of consumer fireworks. Consumer fireworks (classified as 1.4G) are small fireworks that are sold for use by the general public and are generally weaker in explosive power used in professional displays (classified as 1.3G). The testing facility must have a pad site that can accommodate the storage of two (2ea.) 20’ X 40’ Department of Defense approved explosives magazines (ARMAGs) and a Conex storage container and provide CPSC with exclusive use of this pad site during the lease period. The testing facility must provide CPSC a suitable testing range with a minimum 100’ x 100’ testing area to support the testing and evaluation of regulated consumer fireworks. The test range must be open, flat, and free of overhead obstructions and cleared of any foliage to control any potential fire spread. The test range must be located as far as possible from any residential areas due to the noise generated from testing fireworks. In addition, the testing facility must be located within driving distance from the CPSC National Product Testing and Evaluation Center (NPTEC), located at 5 Research Place, Rockville, MD to ensure testing is complete within one day (8 hours), including travel, and not require an over-night stay.
After an extensive search for potential testing facilities in the Maryland, Virginia, Pennsylvania, and West Virginia area, only one facility is willing to meet the CPSC’s specific requirements. Summit Point Training Facility (SPTF), located at 201 Motorsports Park Circle, Summit Point, WV can meet the requirements needed for the storage and testing of consumer fireworks and is eager to accommodate the CPSC. SPTF will provide a pad site for the two ARMAGs and Conex containers and provide a test range sufficient for testing fireworks. In addition, SPTF is within driving distance from NPTEC, to ensure testing is completed in one day. There is no other known source for all requirements that is within driving range of NPTEC.
