About this opportunity

The National Oceanic and Atmospheric Administration (NOAA) Western Acquisition Division intends to award a firm-fixed-price purchase order on a sole-source basis for land access to the National Marine Sanctuary of American Samoa at Fagatele Bay, with responses due by July 2, 2026. The identified sole-source vendor is AUF Clan, P.O. Box 5158, Pago Pago, American Samoa 96799. This procurement is unrestricted and carries no set-aside.

Land access to Fagatele Bay is available only through privately held lands. The requirement includes unlimited vehicle and foot access via private property, permission to install a coded padlock on the gate chain to enable 24/7 access by NOAA Office of Law Enforcement (OLE) and American Samoa Department of Marine and Wildlife Resources (DMWR) personnel, and maintenance of vehicle routes, footpaths, and trails in accessible condition. NOAA OLE and DMWR conduct joint enforcement patrols under a Joint Enforcement Agreement to detect and deter violations of the Magnuson-Stevens Act, Endangered Species Act, and Marine Mammal Protection Act within the marine sanctuary. Expected delivery is September 2026.

Market research indicates that landowners require fee payment from the public for property access with no exceptions for law enforcement. Sole-source justification rests on the fact that only AUF Clan's family lands provide the safest landside route into and out of the sanctuary; without this access, NOAA OLE cannot conduct necessary enforcement and deterrent patrols.

Firms believing they can fully meet the Government's requirements may submit substantiating documentation in writing to Grace LaPierre (grace.lapierre@noaa.gov) or Charles Kendall (charles.kendall@noaa.gov) by July 2, 2026. The Government will evaluate such submissions solely to determine whether to conduct this procurement competitively; that determination remains at Government discretion.
