About this file

This is a Statement of Need for unlimited land access to the National Marine Sanctuary of American Samoa, Fagatele Bay, issued by the Pacific Islands Division (PID) of the Office of Law Enforcement (OLE) under the National Marine Fisheries Service (NMFS), National Oceanic and Atmospheric Administration (NOAA), Department of Commerce.

NOAA OLE PID and the American Samoa Department of Marine and Wildlife Resources (DMWR), through a Joint Enforcement Agreement (JEA), conduct regular land and sea patrols to Fagatele Bay to detect and deter violations of the Magnuson-Stevens Act (MSA), Endangered Species Act (ESA), and Marine Mammal Protection Act (MMPA). Land access to the sanctuary is exclusively available through privately held lands, requiring fee payment to the landowner. The services required include: (A) providing unlimited access via privately held land; (B) permitting NOAA OLE PID to install a coded padlock on the gate chain to enable 24/7 vehicle and foot access by OLE and DMWR personnel; and (C) maintaining vehicle routes, footpaths, and trails in accessible condition. Implementation will enhance operational efficiency, enable consistent monitoring and public education activities, and facilitate detection, deterrence, and citation of violations within the marine sanctuary. The primary point of contact is located at NOAA-IRC/NMFS/OLE, 1845 Wasp Boulevard, Building 176, Honolulu, Hawaii 96818, Office: 808-725-6110.
