About this opportunity
This Limited/Sole Source Justification Notice, published by the Department of State Office of Acquisition Management on January 26, 2026, documents the non-competitive extension of contract 72061521C00003 with the Mission for Essential Drugs and Supplies (MEDS) for the continuation of HIV/AIDS services in Kenya under the Dawa za Ubora program. The contractor will provide critical life-saving services including antiretroviral therapy, viral load testing, and HIV testing to support 1.3 million HIV-positive individuals across Kenya's 47 counties, delivering health commodities through an established network of 10,268 health facilities. The justification for proceeding without full and open competition relies on AIDAR 706.302-70(b)(3)(ii) and the Expedited Procurement Procedures for HIV/AIDS prevention, citing the urgency of maintaining service continuity during the transition of program oversight from USAID to the Department of State, the limited timeframe available, and the complexity of the institutional transfer. The estimated extension value is approximately $15 million over a two-year period from June 29, 2026, through June 28, 2028, with pricing continuing under existing contract terms at the same rate structure applied to the original award. MEDS demonstrated unique qualifications through its proven procurement system, robust logistics networks with 95 percent inventory accuracy, and extensive experience delivering over $327 million in health commodities across Kenya's healthcare system.
Notice text
This acquisition is conducted under the authority of 40 U.S.C. 113, as implemented by AIDAR 706.302-70(b)(3)(ii), and substantiated by the Expedited Procedures Package (EPP).
AIDAR 706.302-70(b)(3) and FAR 6.303-2 allows USAID (now the Department of State) to limit competition when compliance with full and open competition procedures would impair foreign assistance objectives. More specifically, AIDAR 706.302-70(b)(3)(ii) states that full and open competition is not required for: “Awards for countries, regions, projects, or programs for which the Administration of USAID makes a formal written determination with supporting findings (D&F), see Attachment 1 to this J&A, that compliance with full and open competition procedures would impair foreign assistance programs.”
The authority for the D&F under the HIV/AIDS EPP is based on 40 U.S.C. 113(e)(2) and 48 CFR 706.302-70. Tab 1 of the EPP procedures, specifically the D&F, is provided as Attachment 1 to this J&A. The EPP specifically authorizes the use of AIDAR 706.302-70(b)(3)(ii) for contract actions, stating: "You have the authority to extend the EPP under the following: for contracts, Section 706.302-70(b)(3)(ii) of USAID’s Acquisition Regulation (AIDAR), Impairment of Foreign Aid Programs; for assistance awards, ADS Chapter 303.3.6.5, Restrictions to Eligibility; and for the source-and-nationality waiver, Section 228.31 of Title 22 of the Code of Federal Regulations (CFR)."
Awarded contract 72061521C00003 to unknown vendor for unknown amount on 2021-06-29.
