About this opportunity

The National Oceanic and Atmospheric Administration (NOAA) Fisheries Office of Sustainable Fisheries has issued a Special Notice announcing its intent to negotiate a sole source contract with bioMerieux, Inc. of Salt Lake City, Utah. The procurement is for TEMPO Test Kits, which are consumable testing supplies used with the bioMerieux TEMPO automated quantification system for mission-critical seafood inspection analyses. The notice covers four specific test kit categories: TEMPO QC Kit, TEMPO YM Kit, TEMPO EB Kit, and TEMPO AC Kit, to be delivered to NOAA's National Seafood Inspection Laboratory in Pascagoula, Mississippi. NOAA is proceeding under FAR 13.106-1(b)(1) authority, citing bioMerieux as the sole manufacturer and distributor of these specialized test kits. The contract structure includes a base year with four option years, totaling a potential five-year period of performance.

The sole source determination is based on NOAA's requirement for test kits that are compatible with their existing TEMPO automated quantification system, which supports their ISO 17025:2017 certified methodology that was validated at significant expense. The procurement allows other firms to submit documentation within 15 days of the notice publication date (by August 27, 2025) demonstrating their ability to meet the government's technical requirements, though NOAA retains sole discretion in determining whether competitive procurement is feasible. Contractors seeking to participate must prove their products are compatible with the bioMerieux TEMPO system and can support the laboratory's seafood inspection program requirements. The quantities needed vary by test kit type, with up to 12 units required for the TEMPO QC Kit in the base year, while other kits are measured per 48-test units based on monthly sample volumes. The contract will be structured as a firm-fixed price agreement supporting NOAA's ongoing seafood safety and inspection mission.
