About this file
This is a Single Source Determination document for the National Oceanic and Atmospheric Administration's (NOAA) Fisheries Office of Sustainable Fisheries/National Seafood Inspection Laboratory. NOAA intends to negotiate a sole source contract with bioMerieux, Inc. for TEMPO Test Kits, which are consumable testing supplies used for mission-critical seafood inspection analyses. The specific items needed are TEMPO QC Kit (Cat: 80000), TEMPO YM Kit (Cat: 80001), TEMPO EB Kit (Cat: 80003), and TEMPO AC Kit (Cat: 411113), with a base year contract and four option years.
The procurement is being conducted under FAR 13.106-1(b)(1) with a firm-fixed price contract type. Market research confirms bioMerieux is the sole source distributor, with the test kits being uniquely qualified and compatible with the existing TEMPO machine. The contract requires delivery to the NOAA Fisheries Office in Pascagoula, MS, with quantities dependent on monthly sample volumes. The solicitation allows other firms to submit documentation within 15 days demonstrating they can meet the government's requirements, though the final determination of competitive procurement remains solely at the government's discretion.
