About this opportunity

The Department of Justice Drug Enforcement Administration (DEA) issued a Special Notice on January 9, 2026, announcing its intention to make a sole source award to the Bay Area Toll Authority for tolls and fees services. This notice invokes the Federal Acquisition Regulation (FAR) 6.302-1(c) authority to proceed without full and open competition, citing the unavailability of alternative sources to satisfy agency requirements. The procurement will be conducted as an open market purchase order under FAR 13.106-3(b) for supplies and services. All written communications regarding this posting must be received by the archive date of January 19, 2026, at 1:00 pm EST, with Donita Hood serving as the point of contact at Donita.L.Hood@dea.gov. The North American Industry Classification System (NAICS) code 926120 applies to this acquisition.

The Special Notice addresses the DEA's need for Bay Area Toll Authority services to cover tolls and fees associated with DEA personnel operations and approved cases, with an estimated contract value of $32,400.00 and a performance period from February 1, 2026, through January 31, 2027. The government anticipates awarding a firm-fixed price purchase order and will apply FAR Part 12.3 provisions and clauses applicable to commercial items, including contract terms and conditions updated through October 2025. This is classified as a Total Small Business set-aside opportunity. While the notice indicates that other parties may submit information regarding the sole source determination, the government reserves sole discretion in deciding whether to open the requirement to competition based on responses received. The acquisition is not a request for competitive quotations, and the government's determination to proceed with sole source procurement is final absent significant new information challenging the stated justification.
