Notice text

The Department of Justice (DOJ), Criminal Division, intends to negotiate and award a sole source purchase order with Best Staffing Team Inc. for continuation of highly important Oracle Hyperion Financial Management system and accounting support services.

DOJ Criminal Division's Financial Management Office has primary responsibility for the fulfillment of all financial management functions for the organization. The proposed purchase order will maintain continuity of financial support services.

Presently, the aforementioned services are being provided to Criminal Division through Best Staffing Team Inc. under a subcontractor arrangement. The primary contract expires on March 31, 2013 and cannot be extended. The services of Best Staffing Team Inc are required until a follow-on solution is in place. The period of performance for the purchase order will be approximately nine (9) months beginning around April 1, 2013 through December 31, 2013.

Best Staffing Team Inc. has the necessary knowledge, experience, and staff to maintain the financial support services required by the Criminal Division. Best Staffing Team Inc. is the only source that can seamlessly perform the required critical services using Criminal Division's Hyperion Financial Management System which is unique to the Criminal Division. Use of this system takes several week of intense training and the Best Staffing is expertly trained on the system. It would not be an effective use of time or resources to bring on new contractor support unfamiliar with the system. Additionally, it would take several months for a new contractor to clear Criminal Division's Security process. For this short term requirement, the duplication of costs to provide the necessary system training and the security clearance process could not be recovered by Criminal Division through competition or any other means.
The statutory authority permitting other than full and open competition for this contract extension is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, which provides for limiting competition in those situations where only one responsible source and no other supplies or services will satisfy agency requirements. No source other than the incumbent can satisfy this short-term need given the transition period that would be required and conducting a follow-on acquisition for this need would result in unacceptable delays in fulfilling the agency's requirements.
For the reasons noted above, Criminal Division intends to award a short-term purchase order to Best Staffing to ensure that the Criminal Division is able to meet its mission without any lapse in services while it completes the follow-on solution.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and no solicitation will be issued, however, any firm that believes it can satisfy the requirements must give written notification to the Contracting Officer in the form of a capability statement. All supporting evidence must be in sufficient detail that demonstrates the ability to comply with the requirements and must be furnished to the point of contact listed below by Friday March 8, 2013 at 2:00 PM EST. A determination by the government not to compete this proposed purchase order based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The information should be submitted to Lorenza Barnes, Lorenza.Barnes@usdoj.gov.
