About this opportunity

The Department of Veterans Affairs Long Beach Healthcare System has issued a Special Notice of Intent indicating their plan to award a non-competitive delivery order to Matheson Tri-Gas Inc. for bulk oxygen services. This notice is not a solicitation or request for competitive proposals, but rather an announcement of the VA's intention to procure bulk oxygen delivery, tank rental services, telemetry, Certificate of Analysis upon delivery, and portal administration fees through a single-source acquisition. The procurement falls under NAICS code 325120 (Industrial Gas Manufacturing) and Product Service Code 6835 (Medical Gases). The VA is utilizing Federal Acquisition Regulation provisions that allow for single-source procurement under the simplified acquisition threshold. The contracting officer for this procurement is Anthony Dela Cruz, who can be contacted at the VA Long Beach facility.

The Special Notice serves to justify the VA's decision to bypass competitive procurement due to unique logistical circumstances surrounding their current oxygen tank infrastructure. The existing main and backup oxygen tanks are located adjacent to an ongoing Mental Health construction project, creating limited access and making removal and installation of new systems impractical without causing significant operational disruption. Any interested parties have until September 1, 2025, at 7:00 AM Pacific Time to respond with clear and convincing evidence that competition would be advantageous to the government. The VA emphasizes that engineering services lack capacity to manage additional construction projects and that any system redesign would require a one-to-two-year lead time for securing design funds. The government retains sole discretion in determining whether to proceed with competitive procurement based on any responses received, and the current operational system would face substantial hardship if modifications were required at this time.

Notice text

This Special Notice of Intent (NOI) is not a request for competitive proposals. This is not a solicitation or request for offers.  The Department of Veterans Affairs (VA), Long Beach Healthcare System, intends to award a delivery order to Matheson Tri-Gas Inc. for delivery of bulk oxygen, rental of the main and backup tank, Telemetry, Certificate of Analysis (COA) upon delivery, and Portal Admin fee. The unusual circumstances leading to justification for other than full and open competition is the accessibility of the main and back-up oxygen tanks. Both tanks are currently located adjacent to the Mental Health construction project that is not complete. The construction area surrounds both tanks and there is limited access. Removal and installation of a new system, including commissioning, would create significant hardship for the facility. Engineering services currently do not have the capacity to manage another small construction project, nor has any contingency been put in place to do any type of design or construction to support new equipment transition at this time. The system is currently operational. Any design requirement would require a 1-to-2-year lead time to secure design funds and support the change.

The North American Industry Classification System (NAICS) code for this requirement is 325120. The Product Service Code (PSC) is 6835.

Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Information received will be considered solely for the purpose of determining whether to conduct competitive procurement. Â A decision by the Government not to conduct competitive procurement for the proposed order based upon response to this notice is solely within the discretion of the Government.

The anticipated acquisition procedures are in accordance with (IAW) Federal Acquisition Regulation (FAR) 13.106-1(b)(1) soliciting from a single source for purchases not exceeding the simplified acquisition threshold which states that the Contracting Officer (CO) may solicit form one source if the CO determines that the circumstances of the contract action deem only one source reasonably available due to unusual circumstances and urgency. All inquiries shall be submitted via email to Anthony.delacruz@va.gov.
