About this opportunity
The Department of Veterans Affairs, Veterans Integrated Service Network 8, issued this Special Notice of Intent for Single Source Award on April 3, 2026, regarding the procurement of a RhodoLED XL device. The acquisition is intended for the Dermatology Clinic at James A. Haley Veterans Hospital in Tampa, Florida, and will be awarded as a sole source contract to Biofrontera Inc. The VA is conducting this procurement under FAR 13.106-1(b), which authorizes sole source awards when only one responsible source can provide supplies due to their unique or highly specialized nature. A Sole Source Justification has been completed and approved in accordance with applicable regulations. This notice falls under Product Service Code 6515 (Medical and Surgical Instruments, Equipment, and Supplies) and NAICS Code 339112 (Surgical and Medical Instrument Manufacturing). The contract is structured as a firm fixed price award with a performance period from April 13, 2026, through May 12, 2026.
While this is a notice of intent rather than a formal competitive solicitation, the VA has invited interested parties to submit capability statements by 10:00 AM EDT on April 8, 2026, demonstrating clear and convincing evidence that alternative sources could fulfill the Government's requirements. All submissions must be directed via email to Quentin Ford, Contracting Officer at Quentin Ford@va.gov, as telephone inquiries will not be accepted. Although the Government will review all received responses, it is not obligated to conduct a competitive procurement based on these submissions. Any contractor wishing to challenge the sole source determination must provide substantial evidence of their capability to meet the specialized needs of the dermatological equipment requirement. The expedited response deadline of five days from the posting date reflects the urgent nature of the requirement for the VA medical facility.
