About this file

This Brand Name Justification document details a procurement request by the U.S. Department of Transportation's Federal Highway Administration (FHWA), Western Federal Lands Highway Division (WFLHD), for a Yellowscan Navigator Bathymetic LiDAR system. The total estimated contract value is $235,000.00, which includes delivery, assembly and calibration with an existing WFLHD Freefly Alta-X UAS platform, system testing, and additional training on the unmanned aircraft system and processing software. The justification specifically argues for sole-source procurement of the Yellowscan system, citing its unique compatibility with WFLHD's existing equipment, current full licensing of its Cloudstation LiDAR processing software, and superior technical characteristics compared to alternative LiDAR platforms like the Reigl VQ-840-G.

The document includes technical certification by Zekial Rios, Land Services Team Lead, and contracting officer certification by Doug Taylor, who confirms the procurement represents the best value and lowest overall cost alternative to meet the government's needs. The procurement is being conducted under FAR 13.106-1(b)(i), which allows for a single-source procurement when only one source is reasonably available. The Yellowscan Navigator is deemed superior because it is independent of the UAV power system, includes a quick-release mounting system, and would not require additional software purchases or training that would be necessary with alternative platforms.

BRAND NAME JUSTIFICATION

For purchases below the Simplified Acquisition Threshold

Procurement Request Number HFLWSI250120PR

1. Contracting activity/agency

U.S. Department of Transportation, Federal Highway Administration (FHWA), Western Federal Lands Highway Division (WFLHD).

2. Description of the supplies and/or services required to meet agency needs

Delivery of a Yellowscan Navigator Bathymetic LiDAR, assembly and calibration with existing WFLHD Freefly Alta-X UAS platform, system testing, and additional training on both the unmanned aircraft system and the processing software. The total estimated amount of this anticipated contract is $235,000.00.

3. Rationale

The Yellowscan Navigator Bathymetic LiDAR and the Reigl VQ-840-G platforms are the only LiDAR systems currently available that can meet WFLHD needs and is compatible with existing NDAA and EO compliant WFLHD FreeFly Alta-X UAV system.

Due to FHWA current ownership of Yellowscan LiDAR scanners for all three Federal Highways divisions, we currently have full licensing of the Cloudstation LiDAR processing software that is not compatible with the Reigl VQ-840-G platform. To incorporate the Reigl VQ-840-G platform into our current workflow would require the purchase of, and training on, three additional software programs.

Additionally, the Yellowscan Navigator is independent of the Alta-X UAV power and comes with a quick release mounting system while the Reigl VQ-840-G requires additional integration and draws power from the UAV which would lessen the flight time of the UAV resulting in smaller areas to be scanned for a single flight.

4. Authority

FAR 13.106-1(b)(i) – The contracting officer has determined that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
