About this file

This document is Addendum #1 for Invitation for Bid (IFB) Y23-737-GO issued by the Orange County Board of County Commissioners in Florida, pertaining to the Utilities SCADA Upgrade Package 3. The addendum modifies the original bid solicitation, with the submission deadline remaining 4:00 PM (EST) on Tuesday, January 10, 2023. Key changes include updates to Minority and Women Owned Enterprise (M/WBE) requirements, specifically the elimination of Attachment C-3 (Letter of Intent), though M/WBE ordinance requirements remain in effect. The county reserves the right to follow up with the three lowest bidders for supplemental information or corrections related to M/WBE compliance.

The addendum also provides updated guidance for references, emphasizing that all bidders must submit a requisite number of similar projects that can be independently verified by the county. Failure to provide accurate and verifiable reference information may result in bid rejection. The county maintains sole discretion in determining bidder responsibility, considering factors such as the bid submittal, project references, and historical performance on previous county projects. Bidders are advised to ensure their references have current contact information, knowledgeable contacts, and have been pre-contacted regarding their willingness to serve as a reference for this specific bid opportunity.

ORANGE COUNTY BOARD OF

COUNTY COMMISSIONERS

PROCUREMENT DIVISION

Issue Date: December 5, 2022

BOARD OF COUNTY COMMISSIONERS

ORANGE COUNTY, FLORIDA

ADDENDUM #1

Y23-737-GO

UTILITIES SCADA UPGRADE PACKAGE 3

Submission Deadline: 4:00 PM (EST), Tuesday, January 10, 2023

The above Invitation for Bids is changed as follows:

1. Minority and Women Owned Enterprise Requirements

A. Execution of Attachment C-3, Letter of Intent (Verification M/WBE Utilization) shall no longer be required. Attachment C-3 is hereby deleted and all requirements/deadlines for Attachment C-3, Letter of Intent, are null. All remaining Minority and Women Owned Enterprise Ordinance requirements remain in effect.

B. Notwithstanding anything to the contrary herein, without assuming any obligation to do so, the

County reserves the right to follow up with – at minimum – the three (3) lowest Bidders for supplemental submission of good faith effort information and/or to provide such bidders with the opportunity to correct any forms submitted for the purpose of evaluating compliance with this IFB’s M/WBE requirement. Any such opportunity to supplement or correct granted to a bidder by the County under this provision shall expire at 11:59pm county local time on the second full county business day after the day on which such bidder received the County’s request for supplementation or correction. There will be no additional time or consideration granted by the County thereafter.

C. Bidders are encouraged to contact the Business Development Division for additional guidance and assistance at BusinessDevelopment@ocfl.net.

Important Note:

The elimination of form C-3, Letter of Intent, is provided for administrative efficiency and does not relieve the bidder of the requirement to comply with M/WBE goals and good-faith-effort requirements, as applicable, and as specified in the solicitation documents. Additionally, bidders should continue to maintain contact with all MBE, WBE or M/WBE sub-contractors and suppliers listed herein throughout this solicitation process. If recommended for award, the timely submission of sub-agreements (if applicable) will be required to demonstrate program compliance prior to contract execution.

2. Updated Guidance for References

ALL BIDDERS MUST SUBMIT THE REQUISITE NUMBER OF SIMILAR PROJECTS. EACH SUCH

PROJECT MUST BE VERIFIED BY THE COUNTY IN ORDER TO BE DEEMED RESPONSIBLE.

FAILURE TO PROVIDE REFERENCE INFORMATION AS REQUESTED MAY RESULT IN THE

REJECTION OF YOUR BID.

Bidders are advised to confirm that:

a. Each reference provided by the Bidder has up to date contact persons and contact information;

b. The contact person provided for each reference is someone who has personal knowledge of the Bidder’s performance during the referenced project; and

c. The contact person for each reference has been contacted by the Bidder regarding this specific bid submittal and such person confirmed their willingness to serve as a reference.

THE COUNTY WILL CONTACT THE REFERENCES PROVIDED AND WILL REJECT ANY AND

ALL REFERENCES FOR SIMILAR PROJECTS THAT IT IS UNABLE TO INDEPENDENTLY

VERIFY.

Notwithstanding anything to the contrary herein, without assuming any obligation to do so, the County reserves the right to follow up with – at minimum – the three (3) lowest Bidders for supplemental submission of references/similar projects. Any such opportunity to supplement or correct granted to a bidder by the County under this provision shall expire at 11:59pm county local time on the second full county business day after the day on which such bidder received the County’s request for supplementation. There will be no additional time or consideration granted by the County thereafter.

Bidders found responsible under this section may still ultimately be deemed to be not responsible by the County due to other considerations including, but not limited to, other information provided in the Bidder’s bid submittal, as well as any history the Bidder may have of negative performance on previous County project(s). Ultimately, the determination of whether a bidder is deemed responsible shall be at the sole discretion of the county.

3. All other specifications, terms and conditions remain the same.
