About this file

This is a Worker Protection and Investment Certification Form (BOP-2201) required by the Commonwealth of Pennsylvania for contractors and grantees working on state contracts, including those with the Department of Environmental Protection. The form mandates that all contractors certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including provisions related to workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examinations, seasonal farm labor, wage payment and collection, construction industry employee verification, healthcare overtime restrictions, apprenticeship and training, and employment records inspection. The certification must be executed by an official duly authorized to represent the contractor or grantee and submitted to the purchasing agency.

Pennsylvania law imposes significant penalties for providing false certifications, including immediate contract termination and a three-year debarment period prohibiting the contractor from bidding on future state contracts under 62 Pa.C.S. § 531. Contractors are required to report any changes in their compliance status to the purchasing agency immediately upon discovery. The certification is subject to the penalties outlined in 18 Pa.C.S. § 4904 for unsworn falsification to authorities, establishing legal accountability for all representations made on the form. The form was published on February 4, 2022, and applies to this particular procurement for diesel utility vehicles through the Department of Environmental Protection's Bureau of Abandoned Mine Reclamation.
