About this file
This is a Worker Protection and Investment Certification Form (BOP-2201) issued by the Commonwealth of Pennsylvania for use in state and local contracting, specifically applicable to the Department of Conservation and Natural Resources' procurement of fifty-five universal access picnic table kits for the Bureau of State Parks, Park Region 2/Presque Isle State Park Complex. The form requires contractors and grantees to certify compliance with Pennsylvania's labor and workforce safety laws, including the Unemployment Compensation Law, Workers' Compensation Law, and thirteen enumerated state labor statutes covering areas such as workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, medical examination fees, seasonal farm labor, wage payment and collection, industrial homework, employee verification, healthcare overtime restrictions, apprenticeship training, and employment records inspection. Contractors must designate an authorized official to execute the certification under penalty of law.
The certification subjects contractors to Pennsylvania's enforcement mechanisms and penalties, including contract termination and three-year debarment or suspension from bidding on state contracts under 62 Pa. C.S. § 531 for providing false certifications. Contractors must also immediately report any changes to their compliance status to the purchasing agency. The form, published February 4, 2022, is executed under the authority of Executive Order 2021-06 and subjects signatories to penalties under 18 Pa. C.S. § 4904 for unsworn falsification to authorities. The certification represents an ongoing compliance obligation that extends throughout the term of the contract.
