About this file
This is a Worker Protection and Investment Certification Form (BOP 2201) issued by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06. The form requires all contractors and grantees of the Commonwealth to certify compliance with Pennsylvania's labor and workforce safety laws, including the Unemployment Compensation Law, Workers' Compensation Law, and thirteen specific state labor statutes covering areas such as workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examinations, seasonal farm labor, wage payment and collection, industrial homework, employee verification, healthcare overtime restrictions, apprenticeship and training, and employment record inspection requirements. No specific products, services, project timelines, or contract terms are outlined in this certification form, as it serves as a general compliance documentation requirement applicable across Commonwealth contracting opportunities.
The form requires an authorized official to certify on behalf of the contractor or grantee that the entity maintains full compliance with all listed Pennsylvania state labor and workplace safety laws. Certifying officials must understand that any false certification is subject to penalties under 18 Pa. C.S. § 4904 (Unsworn Falsification to Authorities), and that contractors providing false certifications face contract termination and three-year ineligibility to bid on Commonwealth contracts under the debarment or suspension provisions of 62 Pa. C.S. § 531. Additionally, contractors must report any changes in compliance status to the Purchasing Agency immediately. This certification requirement applies uniformly across Commonwealth contracts and does not establish any specific pricing terms, set-asides, funding sources, or contract modifications.
