About this file
This is a Worker Protection and Investment Certification Form (BOP 2201) required by the Commonwealth of Pennsylvania for contractors and grantees seeking state and local contract opportunities, specifically applicable to the Susquehanna County west dirt road shaping project. The form mandates that all contractors certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including provisions related to workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examination fees, seasonal farm labor, wage payment and collection, industrial homework, construction industry employee verification, healthcare overtime restrictions, apprenticeship and training, and employment records inspection. The certification must be executed by an officially authorized representative of the contractor or grantee, who assumes personal responsibility for the accuracy of the compliance statement and must immediately report any changes in compliance status to the purchasing agency.
Pennsylvania law imposes significant penalties for false certifications, including immediate contract termination and three-year ineligibility to bid on future contracts under 62 Pa. C.S. § 531. Additionally, the certification is subject to criminal penalties under 18 Pa. C.S. § 4904 for unsworn falsification to authorities. The Susquehanna County dirt road shaping solicitation is restricted to vendors certified as Small Businesses on the Department of General Services Supplier search tool as of the bid close date, making this a Small Business Reserve Solicitation with services to be performed in accordance with PennDOT's Maintenance Manual Publication 23, Chapter 6.3.
