About this file
This Amendment No. 2 document is issued by the Colorado Division of Reclamation, Mining & Safety under the Department of Natural Resources for the Wise Hill Coal Seam Excavation Project (PKA-17-773). The project involves excavation of overburden and coal materials at the Wise Hill site in Moffat County, Colorado, with quantities including 200,000 cubic yards of primary excavation and backfill work, 2,500 cubic yards of topsoil stockpiling and replacement, and additional optional quantities of up to 15,000 cubic yards. A pre-bid meeting was held on July 27, 2016, with bids due on August 23, 2016, and bid opening scheduled for 10:00 a.m. on August 24, 2016. The project scope includes sediment and dust control, topsoil management, coal and overburden blending, final grading, and revegetation across approximately 3 acres.
The amendment clarifies critical project requirements and adds new bid items. Contractors must provide MSHA Part 48 training and employ a certified on-site trainer; a minimum CAT D8 bulldozer (235 FWP) or equivalent is mandated for earthmoving operations. Payment for excavation (Item 6) is measured by surveyed cubic yardage compared to pre-construction topography. New bid items include hydraulic hammer rental (16 hours estimated, hourly rate basis, not guaranteed), removal of approximately 1,400 feet of powerlines and two poles by a licensed electrical contractor (lump sum, not guaranteed), and survey services for volume control. Backfill work requires moisture content between 10-15% with field testing methods rather than laboratory analysis. The prequalification 5-year time limit has been removed. Drill casing encountered during excavation must be disposed of at licensed facilities only.

RE: Amendment No. 2 to PKA-17-773, Wise Hill Coal Seam Excavation Project
Thank you for your attendance at the Wise Hill Coal Seam Excavation Project Pre-Bid Meeting, held on July 27, 2016. Please note, bids are due on Tuesday August 23, 2016. The Bid Opening will be 10:00 am, Wednesday August 24, 2016. An amended bid schedule has been included with this amendment.
The following clarifications and amendments should be noted and incorporated into the bid document:
1. Peabody and DRMS (as determined by the MSHA district Office in Denver) will require MSHA Part 48 Training, including hazard training for all of the contractors, employees working on the site, as well as hazard training for the work site. The CONTRACTOR will be required to provide an on-site MSHA trainer to do the site specific training. A Certified Surface Examiner will NOT be required. Because the site is still regulated by MSHA, all of Part 77 will apply, including, but not limited to, training, fire extinguishers, emergency notification, equipment inspection, proper ground control during excavations, and PPE requirements. If you have any questions regarding these items, or need clarification, please contact:
Mike Crum, CSP Safety Manager Peabody Energy Twentymile Mine 970-870-2711 (office)
2. Two figures and a drill core log have been attached to this amendment. Please note, the core was drilled approximately 2,000 feet away from the outcrop/excavation area, where the coal seams are significantly deeper, and the rock is unaltered by fire.
3. The 5 year time limit on the pre-qualification has been removed. All other items in the pre-qualification apply.
4. The CONTRACTOR is required to provide a minimum CAT D8 sized bulldozer (235 FWP) or equivalent to accomplish the required earth moving operations for this project. Smaller equipment will not be accepted.
5. Drill casing will be encountered during excavation. Casing that is removed must be recycled or disposed of at a licensed facility. On-site disposal will not be permitted.
6. Task 6, Excavate Overburden and Coal, Measurement for Payment has been amended to the following:
Payment for this Bid Item will be made at the unit price established in Item 6 of the Bid Schedule.
Measurement for payment will be made per cubic yard of excavated materials. The cubic yardage will be measured for payment by surveying the completed excavation(s), and comparing the excavation topography to pre-construction topography minus the volume of topsoil stockpiled and paid for under Bid Item 5. The calculated volume of in-place overburden and coal will be in-bank yards. Payment for this Bid Item will be upon progressive completion of excavation operations and upon approval of PROJECT MANAGER. Such payment shall be considered full compensation for all labor, materials, equipment and all other items necessary and incidental to the completion of Bid Item 6 as described above.
7. Bid Item 8, Backfill Excavation, has been amended to include the following: If materials are dry (below 5% moisture content), and unable to be effectively compacted, water must be added to increase moisture content. Optimum water content will be between 10-15%, and can be tested easily with a palm test. Laboratory soils testing will not be required.
8. The following bid items have been added to the project. A REVISED Bid Schedule is attached to this amendment:
Bid Item 14, Hydraulic Hammer for Excavator. In the instance that rock materials which must be excavated to facilitate Project goals cannot be ripped or otherwise removed by a 235 FHP dozer, a sufficiently sized hydraulic hammer mounted on an appropriately sized track excavator may be utilized and paid for under this Task. Such use and application for payment must be pre-approved by Project Manager. Nothing in this Task prohibits CONTRACTOR from offering and using such equipment at their discretion separate from this Task.
Measurement and Payment. Payment will be based on a per hour basis. Payment will be when use of the hydraulic hammer and excavator is approved by Project Manager. Payment for this task will be reflected under Item 14.0 of the REVISED Bid Schedule at an hourly rate for actual use of a Hydraulic Hammer with Excavator and Operator. Bid hourly rate shall reflect CONTRACTOR estimate for equipment and personnel cost per hour to complete the task.
Measurement will be actual number of hours required to complete work as directed and approved by the PROJECT MANAGER. The machine time hours under this Bid Item 14.0 are NOT
GUARANTEED.
Bid Item 15, Remove Power Lines and Power Poles. To facilitate benching during excavation, the overhead powerlines and associated poles will be removed from the project area. The Power lines and poles will be set aside for potential future use at a location designated by the Project Manager. All work on the power lines must be completed buy a licensed electrical contractor.
Approximately 1,400 feet of powerlines will be removed, and two poles. Peabody uses Cromer Contracting at the Wise Hill site. The CONTRACTOR is responsible for providing an MSHA certified, licensed electrical contractor. The powerlines are not energized. This Bid Item is NOT
GUARANTEED.
Measurement for Payment. Payment for Bid Item 15 will be reflected in a lump sum bid price under Item 15 on the bid schedule. Payment will include all the CONTRACTORS expenses for hiring an MSHA certified licensed electrical contractor and all associated costs with taking down the powerlines and two power poles located within the project area. Payment for this bid item will be upon completion of this task, and as approved by the PROJECT MANAGER. Such payment shall be considered full compensation for all labor, materials, equipment and all other items necessary and incidental to the completion of Bid Item 15 as described above.
All terms and conditions of the Invitation for Bid other than as changed by this amendment remain the same.
Receipt and acceptance of this amendment shall be acknowledged on the bid form and by use of the Revised Bid Schedule.
