The Contractor shall obtain all permits required for its Work unless the

Township specifically agrees in writing to obtain a particular permit.

Temporary restoration shall not be considered permanent restoration unless specifically accepted by the Township.

The Contractor shall correct settlement, cracking, rutting, pavement failure, or other restoration defects attributable to its Work during the one-year warranty period at no additional cost to the Township.

The Contractor expressly warrants all labor, workmanship, materials, repairs, installations, backfill, compaction, and restoration performed under this

Contract.

Unless a longer warranty is required by the Contract Documents, the warranty period shall be one (1) year from the date of Township acceptance of the applicable Work.

The Contractor shall, at no additional cost to the Township, promptly correct any defective Work resulting from defective materials, improper workmanship, improper installation, inadequate compaction, or failure to comply with the Contract Documents.

The Contractor shall respond to warranty repair requests within a reasonable period established by the Township and shall respond immediately where the condition presents a threat to public health, safety, property, or the operation of the Township's utility system.

The warranty shall not limit any other rights or remedies available to the

Township under the Contract or applicable law.

2.1.29. PHOTOGRAPHS AND RECORD DOCUMENTATION

2.1.30. NO GUARANTEE OF WORK

2.1.31. COMPLIANCE WITH LAWS

The Contractor shall take photographs of conditions when requested by the Township and, for significant emergency repairs, the Township may require photographs documenting:

Existing conditions;

Excavation;

Existing pipe or component failure;

Repair or replacement;

Utility conflicts;

Backfill;

Temporary restoration; and

Final restoration.

The Contractor shall provide photographs and other documentation with the invoice when requested.

The Township may require sketches, measurements, GPS coordinates, pipe sizes, materials, depths, and other information necessary to update

Township utility records.

The Contractor acknowledges that this is an as-needed Contract.

Nothing contained in the Contract shall be construed as a guarantee that the Contractor will receive any minimum quantity of Work, labor, equipment rental, material purchases, restoration Work, or other compensation.

The Township reserves the right, subject to applicable law and the Contract

Documents, to obtain services from other sources when necessary, including when the Contractor is unable to meet required emergency response times, lacks required equipment or personnel, or when the

Township determines that obtaining services elsewhere is in the Township's best interest.

The Contractor shall have no claim for lost profits, anticipated profits, or damages resulting from the Township's failure to issue a particular quantity of Work.

The Contractor shall comply with all applicable Federal, State, County, and local laws, regulations, ordinances, codes, permits, and administrative requirements applicable to the Work.

Nothing in these Specifications shall relieve the Contractor from complying with a legal requirement that is not specifically identified herein.

2.1.32. CONFLICTS AND INTERPRETATION

2.1.33. NO PAYMENT FOR UNAUTHORIZED WORK

Where a law, regulation, code, standard, or permit requirement is more stringent than a requirement contained in these Specifications, the more stringent lawful requirement shall govern.

In the event of a conflict between the Contract Documents, the Contractor shall immediately notify the Township before proceeding with the affected

Work.

The Contractor shall not rely upon an apparent conflict or ambiguity to perform additional Work or incur additional costs without prior written authorization from the Township.

No oral direction that changes the scope, price, or Contract requirements shall be binding unless confirmed in writing by an authorized Township representative.

The Township shall have no obligation to pay for Work, labor, equipment, materials, restoration, or other services performed without proper authorization, except for reasonable emergency measures necessary to protect life, public health, safety, property, or the Township's utility system.

The Contractor shall obtain authorization before proceeding with additional

Work whenever reasonably practicable.
