About this file

These Technical Specifications document a streetscape improvement project for North Main Avenue in Scranton, Pennsylvania, prepared by a local government agency and following PennDOT (Pennsylvania Department of Transportation) Publication 408 Specifications. The project scope covers approximately 500 linear feet from south of West Gibson Street to the North Scranton Expressway southbound ramps, and includes comprehensive infrastructure and aesthetic upgrades such as replacement of curbs and sidewalks, installation of period lighting, construction of a retaining wall, tree planting, traffic and pedestrian control during construction, pavement restoration, line striping, and related restoration work. The technical specifications are organized into multiple divisions covering general requirements, site work, concrete work, and various technical implementation details.

The project will be executed using standard PennDOT construction protocols, with specific requirements for materials, construction methods, measurement, and payment. Materials must meet PennDOT Publication 408 Specifications, and the contractor will be responsible for furnishing all labor, materials, equipment, and performing work according to detailed technical specifications. Payment will be made on a unit price basis for various line items, with most work considered incidental to the primary contract items. The specifications include provisions for coordinating with utility companies, maintaining traffic flow, protecting existing structures and vegetation, and ensuring proper erosion control and site restoration. The contractor will need to comply with all local, state, and federal regulations, including obtaining necessary permits and maintaining safety standards throughout the project.

PENNDOT PUBLICATION COORDINATION 01020-1

SECTION 01020 – PENNDOT PUBLICATION COORDINATION

1.01 MINIMUM STANDARDS

A. All work in State Highway Right-of-Way shall be constructed in accordance with the requirements of:

1. PennDOT Publication 408 Specifications

2. PennDOT Publication 35 Bulletin 15 – Approved Construction Materials

3. PennDOT Publication 72M – Roadway Construction Standards

B. It is the intent of the Contract Documents that the requirements of the above listed

PennDOT Publications are the minimum quality of work and minimum quantity of work to be provided by Contractor. The Contract Documents, including but not limited to the Drawings and Specifications, may require additional work, additional material, a higher quality material, specialized equipment and/or other additional quantity or quality of work to complete the construction. Accordingly, such additional work, additional material, higher quality material, specialized equipment and/or other additional quantity or quality of work shall be provided by Contractor.

For example:

A PennDOT Publication 72M – Roadway Construction Standard Drawing may have a detail which shows that retained material may be used for backfill, while the Contract Document Drawings and/or Specifications require that 2A Coarse Aggregate be used for all backfill within all state highway right-of-way limits. Then, in this example, the Contract Documents require that the Contractor use 2A Coarse Aggregate backfill and remove the excavated material. The PennDOT Publication 72M – Roadway Construction Standard reference to retained material is interpreted as the minimum level of construction and is superseded by the higher quality 2A Coarse Aggregate material and associated work to fully install and construct 2A Coarse Aggregate backfill complete in place including any associated work of hauling and disposing of any excavated material.

1.02 REFERENCED PENNDOT SPECIFICATIONS

A. It is the intent of the Contract Documents that the Contract Documents as designated in the Agreement, including but not limited to the Agreement, the Instructions to Bidders, the General Conditions and Supplementary Conditions, govern the terms and conditions of the Agreement between Owner and Contractor, including but not limited to bidding requirements, contract administrative procedures, contract

PENNDOT PUBLICATION COORDINATION 01020-2

payments, contract times, amending and supplementing contract procedures and other similar administrative items. Any references to PennDOT Publication 408 Specifications shall not be construed to supersede such administrative terms and conditions of the Agreement.

For example:

The Contract Documents shall govern over PennDOT Publication 408 Specifications Section 100 – General Provisions on administrative matters including but not limited to, reporting and resolving discrepancies, subsurface and physical conditions, differing subsurface and physical conditions, underground facilities, hazardous environmental conditions at the Site, bonds and insurance, changes in the work, claims, claims between contractors, cost of the work, unit price work, changes in contract price, changes in contract time, delays, payments to Contractor, dispute resolution and giving notice.

B. Nothing in Paragraph 1.02.A shall in any way diminish, lessen or eliminate the right and authority of PennDOT and its duly authorized representatives from fully exercising their rights of inspecting, reviewing, rejecting the Work and the materials and suspending the Work for cause in accordance with PennDOT’s requirements.

Nor shall this section relieve Contractor’s responsibilities to adhere to applicable state and federal laws and regulations.

Not Used.

PART 3: EXECUTION

UNIT PRICES 01270-1

SECTION 01270 – UNIT PRICES

1.01 DEFINITIONS

A. Unit price is an amount proposed by bidders, stated on the Bid Form, as a price per unit of measurement for each separately identified item of Unit Price Work added to or deducted from the Contract Price by appropriate modification, if the estimated quantities of items of Unit Price Work are increased or decreased.

1.02 PROCEDURES

A. Unit prices shall include all work, labor, equipment, material, plus cost for delivery, installation, insurance, overhead, profit, applicable taxes and all other costs needed to complete the project. Unless a required item of work is separately identified on the Bid Form as an item of Unit Price Work, it will not be paid for separately and shall be included in the unit prices as incidental.

B. Work and materials not specifically described in the Drawings and Specifications but needed to complete the Work shall be included in the unit prices as incidental.

C. Work that is required by the Contract Terms and Conditions, including but not limited to the General Conditions of the Construction Contract, the Supplementary Conditions, Additional State, Federal or Funding Agency Requirements and permits may not be assignable in whole or in part to any particular item of Unit Price Work but is considered to be part of the entire work. Payment for such work shall be considered a subsidiary part of the project requirements and shall be included proportionally in the unit prices as incidental.

D. Other items of work not separately identified on the Bid Form as items of Unit Price

Work but included in the PennDOT Standard Drawings or PennDOT Publication 408 Specifications as required or related to the items of Unit Price Work, even if listed by the PennDOT Standard Drawings or PennDOT Publication 408 Specifications as separate pay items, will not be paid for separately and shall be included in the unit prices as incidental.

E. The cost of items of work that are noted or specified as included in or incidental to an item of Unit Price Work separately identified on the Bid Form shall be included in the unit prices as incidental. No separate payment will be made for such items of work even if the Specification for these items list them as being payable. For example, if an item of Unit Price Work separately identified on the Bid Form for the installation of pipe is noted or specified to include pavement restoration, no separate payment will be made for the pavement restoration associated with the pipe

UNIT PRICES 01270-2

installation even though the pavement restoration Specification may list it as payable by the square yard.

F. No payment will be made for the correction or removal of defective work.

G. No payment will be made for work in excess of that indicated, shown, or specified unless such additional work is ordered by Owner by a Change Order or a Work Change Directive.

H. Work, material or labor specified for an item of Unit Price Work will not be measured or paid for again under any other item of Unit Price Work.

1.03 MEASUREMENT AND PAYMENT

A. Measurement and Payment: Refer to individual Specification Sections for work that requires establishment of unit prices. Methods of measurement and payment for unit prices are specified in those Sections.

B. Determinations of the actual quantities and classifications of Unit Price Work performed by Contractor will be made by Engineer subject to the provisions of General Conditions of the Construction Contract as may be modified by the Supplementary Conditions.

C. Unless specifically noted otherwise on the Drawings or in the Measurement and

Payments sections of the Specifications, determination of actual quantities will be made using horizontal planar dimensions.

D. No measurements or payments will be made beyond the pay limits. Payments will be made for the actual amount of work completed up to a maximum of the pay limit amount. Pay limits for different items of work shall not overlap such as for restoration where a pipe meets an inlet or manhole. Pay limits for pipe trench restoration shall be considered centered over the pipe centerline.

SUBMITTALS 01300-1

SECTION 01300 – SUBMITTALS

1.01 BEFORE STARTING CONSTRUCTION

A. Record of Existing Conditions: Within 10 days after the Effective Date of the Agreement, Contractor shall submit to Engineer for record:

1. Pre-construction photographs of all planned construction areas, material storage areas, areas adjacent to these areas, including but not limited to, streets, driveways, sidewalks, curbs, ditches, fencing, railing, visible utilities, retaining structures and adjacent building structures. The purpose of the photographs is to document existing conditions and to provide a fair measure of required restoration. Care should be taken to record all existing conditions which exhibit deterioration, imperfections, structural failures or situations that would be considered substandard.

1.02 PROPOSED ADJUSTMENTS IN THE PROGRESS SCHEDULE

A. If, in the opinion of Engineer, Contractor falls behind the Progress Schedule, Contractor shall submit to Engineer for acceptance proposed adjustments in the Progress Schedule that will not result in changing the Contract Times in accordance with the General Conditions and as follows:

1. Adjustments shall include such steps as will be necessary to improve the progress.

Engineer may require Contractor to increase the number of shifts and/or overtime operations, days of work, and/or the amount of construction planned, all without additional cost to Owner.

1.03 SHOP DRAWINGS AND SAMPLES

A. Contractor shall submit Shop Drawings and Samples to Engineer for review and approval in accordance with the General Conditions for all items to be furnished and/or installed under the Contract Documents.

C. Submittals smaller than 8-1/2 x 11 inches shall be secured to paper 8-1/2 x 11 inches.

SUBMITTALS 01300-2

D. Submittals will be returned, stamped with the following classifications:

a. "Approved" – There are no notations or comments on the submittal and, in Engineer’s opinion, the submittal appears to generally be in conformance with the requirements of the Contract Documents and Contractor may release the equipment for production.

b. "Approved as Noted" – Notations have been made on the submittals for conformance with the Contract Documents. Contractor may release the equipment for production in accordance with the notations.

c. "Not Approved" – The submittal does not meet the requirements of the Contract

Documents. Contractor must submit the specified product.

E. Where a submittal indicates a departure from the requirements of the Contract

Document which the Engineer deems to be a minor adjustment in the interest of the Owner not involving a change in Contract Price or Contract Times, Engineer may approve the submittal but the approval will be subject to the following clause:

- "The modification indicated on the attached submittal is approved in the interest of the Owner to effect an improvement for the Project and is accepted with the understanding that it does not involve any change in the Contract Price or Contract Times; that it is subject generally to all Contract stipulations and covenants and that it is without prejudice to any and all rights of the Owner under the Contract Bonds".

F. It is emphasized that Engineer’s approval of Contractor’s submitted data is for general conformance to the Drawings and Specifications, but subject to the detailed requirements of the Drawings and Specifications. Although the Engineer may check submitted data in more or less detail, such checking is an effort to discover errors and omissions in Contractor’s drawings and to assist the Contractor in coordinating and expediting his work, and shall in no way relieve the Contractor from the Contractor’s sole responsibility for complying with the requirements of the Contract Documents.

The Contractor’s responsibility shall continue so that even if shop drawings are marked approved and subsequently it is discovered that the Contractor’s submitted item does not fit the work, does not have the required certification, does not meet a certain characteristic, and/or is in any way not in strict compliance with the Contract Documents, the Contactor shall be fully and solely responsible for removing and replacing the item including paying all related costs.

1.04 CONTRACTOR'S DAILY REPORTS
