1. Documentation of Ownership and Use
The subject lands are a portion of the lands originally ceded to the United States of America (USA) by “Treaty with the Yakima” in 1855.
All the even numbered sections were granted to the Burlington Northern Railroad Company under the Exchange Act approved March 20, 1922 (42 Stat. 465) and the Act approved October 21, 1976 (90 Stat. 2743) as cited in the Serial Patent No. 46-86-0022, BLM Serial No. OR 40426 W, issued on June 12, 1986. There are several reservations in favor of the
USA.
All the odd numbered sections were granted to the Northern Pacific Railway Company under Act approved July 2, 1864 (13 Stat. 365), entitled “An Act granting lands to aid in the construction of a Railroad and Telegraph Line for Lake Superior to Puget’s Sound, on the Pacific Coast, by the Northern Route” and by the Joint Resolution of May 31, 1870 (16 Stat., 378). These grants vested sometime in the 1880’s upon satisfaction of the terms in said act and the exact location of these granted lands were later fixed by the completion of the official government surveys, approved in 1915, after which the subject lands, among many other lands, were conveyed from United States of America under two patents.
1918 Serial Patent No. 630219, Document No. 322, BLM Serial Number WAORAA 031497, issued on May 13, 1918. This patent included section all odd numbered sections except section 19, T. 19 N., R. 15 E., W.M., among many other lands, and contained no reservations to the United States.
1919 Serial Patent No. 664645, Document No. 328, BLM Serial Number WAORAA 043206, issued on February 7, 1919. This patent included only section 19, T. 19 N., R. 15 E., W.M., among many other lands, and contained no reservations to the United States.
