About this file

This is a Determination to Solicit from a Single Source document for solicitation 140R8125Q0014 issued by the Department of the Interior, Bureau of Reclamation, Denver Office Acquisitions. The document justifies a brand name requirement to procure specific Schweitzer Engineering Laboratories (SEL) equipment, including an SEL-400G Relay, SEL Advanced Digital Fault Recorder components (SEL-2243 Power Coupler, SEL-2245-2 DC Analog Input Module, SEL-2245-4 AC Metering Module), SEL-3560 RealTime Automation Controller, and SEL-2242 Chassis/Backplane.

The justification explains that SEL equipment is required because the TSC Power System Analysis and Control team needs the exact relay model deployed in the field to provide accurate support, and the SEL Advanced Digital Fault Recorder must communicate with existing SEL relays at Reclamation facilities. The procurement will be competed on SAM.gov as a small business set-aside, though limited to the specified brand name equipment. Price reasonableness will be determined through comparison with previous purchases and market analysis. The Bureau's subject matter experts will continue monitoring the market for potential compatible alternatives for future requirements.

(11/2020)

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Denver Office Acquisitions

2. Name and Address of Single Source.

This is a brand name requirement to procure Schweitzer Engineering Laboratories (SEL) equipment. Competition will be sought on the Government Point of Entry (GPE) SAM.gov.

3. Description of Supplies/Services.

This requirement is for the procurement of Schweitzer Engineering Laboratories (Schweitzer) items/equipment listed below.

4. Description of Circumstances, including why only one source is reasonably available.

SEL 400-G Relay The TSC Power System Analysis and Control team provides essential relay support to the field, including relay testing, settings, and troubleshooting of relay events. Acquiring this specific relay model is crucial for our team to gain familiarity and deliver enhanced engineering support to the field. It is imperative that we procure the exact model currently deployed in the field to ensure our support is accurate and effective.

SEL Advanced Digital Fault Recorder The SEL Advanced Digital Fault Recorder is uniquely suited to communicate seamlessly with the extensive array of SEL relays currently installed at Reclamation facilities. Given that the majority of our protective relays are manufactured by Schweitzer Engineering Laboratories (SEL), it is imperative to use fault recorders from the same manufacturer to ensure optimal data aggregation and system integration.

This integration is critical for maintaining the reliability and efficiency of our monitoring and diagnostic processes, which cannot be guaranteed with fault recorders from other manufacturers. Therefore, procuring the SEL Fault Recorder through a brand name contract is essential to uphold the operational standards and compatibility required for our facilities.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13 .106- 3 (a)(2)(ii)), market analysis for similar items in the industry (FAR 13.106-3(a)(2)(i)), and other determinations listed in FAR 13.106-3(2) if the information is available to determine if the quoted price is fair and reasonable.

6. Description of Market Research.

The requested Schweitzer Engineering Laboratories products are the only brand that can interact with the current infrastructure. The Bureau of Reclamations subject matter experts will continue to monitor the market for a possible replacement that is compatible with the current system for future requirements.
