About this file
This Memorandum for Record documents a sole-source acquisition by the Army Contracting Command - APG - Huachuca Division for Uninterruptible Power Supply (UPS) system refurbishment and modernization at Fort Huachuca, Arizona. The contract is with Pergravis Mission Critical Facilities for a fixed-price, brand-name procurement of Eaton Powerware equipment and services, with a base year value of $136,877.18 and four option years totaling an additional $43,649.13, for a total potential contract value of $180,526.31 using Operations & Maintenance, Army (OMA) funds.
The scope includes replacing capacitors, fans, air filters, and batteries in two UPS systems located in Building 53302, with specific Eaton Powerware parts. Pergravis was selected as the sole source due to proprietary diagnostic equipment, prior site assessment experience, and existing vendor approval. The contract addresses urgent maintenance needs, including systems with faulty capacitors and critical fan assembly issues. The base period runs from 15 Sep 2025 to 14 Dec 2026, with subsequent one-year option periods extending through 14 Dec 2030.

4. Authority: FAR 13.106-1(b)(1) FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization. Pergravis, is the only source that possesses proprietary equipment Eaton UPS Service Tool laptop, with Eaton service software, to download, record, analyze, and complete the system diagnostic checks, providing the government with a Field Service Report (FSR) for repairs, and has DPW Self Help vendor approval.
Or
FAR 8.405-6(a)(1)(i)(B) and 8.405-6(b)(1)Brand Name FAR 8.405-6(a)(1)(i)(A) Urgency FAR 8.405-6(a)(1)(i)(B) Only One Source is Capable FAR 8.405-6(a)(1)(i)(C) Logical Follow-on Or
FAR 16.505(b)(2)(i)(B) Only One Awardee is Capable FAR 16.505(a)(4) Brand Name FAR 16.505(b)(2)(i)(A) Urgency FAR 16.505(b)(2)(i)(C) Logical Follow-on FAR 16.505(b)(2)(i)(D) Minimum Guarantee
5. Reasons for Authority Cited:
a. It was determined that a logical follow-on utilizing Pergravis would be in the best interest of the government since they have already completed a UPS system site diagnostic assessment, has DPW Self-Help vendor approval and were the previous vendor, which provided maintenance support services on the UPS systems.
b. Brand specific equipment identified in section 3 is required to ensure a continued stable, reliable, and operational system in support of both UPS systems. The UPS Systems are required for ISEC to provide clean filtered power and remove line noise from AC utility power ensuring that mission critical Information Technology (IT) and Operational Technology (OT) lab equipment receives the proper input power during interoperability & cybersecurity testing. The UPS systems also safeguard the connected IT & OT devices by providing continued operations utilizing the stored battery power during power outages/failures.
c. This contract is critical to Operation and Maintenance of the UPS System in that it offers a proactive and programmed service replacement of batteries, capacitors, filters, and fan components ensuring extension of UPS systems life and protection of the mission critical IT & OT equipment systems being evaluated in the test labs.
d. The supplies and services required must be procured as brand name only because the support for this equipment and networks must be obtained from the original source or its licensed resellers/dealers due to compatibility, proprietary data rights, and form, fit, function requirements to existing equipment and systems. The system is designed using Eaton Power ware hardware and software for specific technical specifications that must be adhered to in order to be compatible with their current environment.
e. This contract addresses the urgent need for equipment maintenance on the nonoperational UPS systems; one system is in bypass mode, due to faulty capacitors that have signs of leakage and swelling; the other system has a critical alarm for a defective fan assembly, which is causing the system to overheat; both systems have outdated batteries that have signs of swelling and leakage.
Control No: JA-21-Hua-0616 Version – February 2017
f. The failure to acquire only Eaton Powerware hardware and software will result in the UPS System failing and not achieving the expected life of the UPS systems thereby affecting the day-to-day support requirements for IT & OT system interoperability and cybersecurity testing efforts in support of the global modernization and transformation initiatives. Furthermore, not acquiring the proper named brand hardware exposes the UPS systems to greater risk of failure, overheating and causes the load to be transferred to bypass, leaving mission critical IT & OT systems unprotected and compromise employee safety, due to swollen or leaking UPS batteries and capacitors.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at 5.202(a)(6)_____________________.
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A) Action is NOT a brand name restriction and is under $150K, no posting required Action is a brand name restriction, under $25K, no posting required Action is a brand name restriction, over $25K. 7. Market Research: Market research consisted of conducting comprehensive internet search for authorized Eaton UPS systems vendors capable of performing, systems services, maintenance repairs and parts replacement distributors. The market research started on 8 May 2025 and completed on 12 Jun 2025. Unified Power, Somerset Power Systems, Alpine Power Systems and Pergravis. Unified Power, Somerset Power Systems, and Alpine Power Systems all needed to perform their own site diagnostic assessment, which would take 30-60 days to schedule and complete. These three companies would also have to complete the Directorate of Public Works (DPW) SelfHelp vendor registration to perform UPS system repair on Fort Huachuca, AZ. Pergravis was identified as the only authorized repair technicians for the existing Eaton UPS systems installed in CMET 2 that completed a UPS system site diagnostic assessment and have DPW Self-Help vendor approval.
