About this file

This is an amendment to solicitation W91QVN25R0015 providing answers to questions received during the Q&A period and removing the certification requirement for "Information and Communication Construction performance confirmation last 3 years" to align with evaluation criteria.

The amendment includes 9 Q&A items clarifying submission requirements, pricing structure, and technical details. Key clarifications include: proposals should be submitted electronically via email rather than hard copy; unit prices should reflect annual (12-month) pricing; quantity of 100 jobs represents maximum task orders over total period of performance; redundancy requirements serve as backup communication channels; and licenses/past performance documents can be submitted in Korean with certified English translations. The amendment also clarifies that offerors must submit both original and redacted copies of proposals, with the redacted version excluding company names/symbols to ensure impartial evaluation. Award will be made on a Lowest Price Technically Acceptable (LPTA) basis to the responsible offeror whose proposal meets all technical requirements. All pricing must be quoted in Korean Won (KRW) and contracts/invoices will be paid in KRW currency.

New awards originating in SPS/PD2 or PADDS (including those already containing the ACWS solicitation language).

New awards originating in ACWS when the solicitation originated in SPS/PD2 or PADDS.

Existing contracts, indefinite delivery vehicles (IDVs), and agreements with a period of performance or delivery schedule that may exceed the sunset date of the legacy system (including any extension or option clauses).

Location: Section H, Special Contract Requirements.

Army Contract Writing System (ACWS) Transition Information for Contractors

a. The Department of the Army is in the process of deploying a new solicitation and contract writing software application to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software application will replace most existing Army contract writing systems, including the system used to create and release this Contract.

b. During this transition period, Contractors are hereby advised:

1. The Contracting Office may use any combination of contract writing systems to generate distributable copies of this contract during its period of performance, as well as any subsequent modifications or orders (if applicable). As a result:

i. Subsequent documents you receive may appear noticeably different than the original award or previous contractual documents from the same Contracting Office.

ii. A change between contract writing systems may cause important information concerning contract terms and conditions to take on different formatting or appear in different parts of later documents issued.

iii. Contractors shall ensure Customer Relationship Management (CRM) systems and personnel interacting with this contract are prepared to identify and respond appropriately to differences between document versions.

2. The Government does not intend to use the shift between contract writing systems to effect any changes to Contract terms and conditions. Therefore:

i. Contractors should view changes to terms or conditions between document versions as system-generated and potentially erroneous unless accompanied by narrative(s) designating such changes as deliberate and desired.

ii. Contractors shall inform the Contracting Officer listed on the first page of the most recent document issued for guidance regarding any suspected or observed inadvertent or system-generated changes (i.e., noticing something missing in a new conformed copy).

iii. The Government will correct any inadvertent or system-generated changes, additions, or omissions discovered by either party, via bilateral modification, at no cost to the Contractor.

iv. The terms and conditions contained in the latest document reflecting deliberate action by the Contracting Officer (i.e., the last conformed copy of the award not affected by the observed issue) will take precedence until the problems are corrected.

3. In the unlikely event award information is corrupted or mutilated during system migration and replacement or re-issuance of this contract is necessary for continued contract administration, the Contracting Officer will:

i. Issue a continuation contract in accordance with DFARS 204.1601(c) and DFARS PGI

204.1601(c), carrying over all terms and conditions from the last-known version of this contract to accurately reflect mutual agreement of the parties.

ii. Incorporate the last-known version of this contract to accurately reflect mutual agreement of the parties as an attachment to the replacement or continuation contract for future reference.

iii. Ensure any such reissuance or continuance is properly reported to preserve the integrity of Contractor performance measurement data, if any (i.e., FAPIIS, CPARS).

(End of provision)

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

See ADDENDUM TO FAR 52.212-2, EVALUATION --COMMERCIAL ITEMS (JAN 1999)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO FAR 52.212-2, EVALUATION --COMMERCIAL ITEMS (JAN 1999)

A. Basis of Award:

In accordance with FAR Part 12 - Acquisition of Commercial Products Commercial Services and 15-Commercial Services, Award will be made to the responsible offeror submitting the Lowest Price Technically Acceptable (LPTA) offer that satisfies all terms and conditions of this solicitation and who is determined to be responsible in accordance with (IAW) FAR 9.104-1 General standards. The proposals are intended to be evaluated, and award made, without discussions with the offerors (other than discussion conducted for award that cannot be made on initial proposals and the Government determines discussions to be necessary, the Government will establish a competitive range which may consist of the most highly qualified proposals, considering technical, past performance and price evaluation factors, and conduct the negotiations with all offerors in the competitive range. IAW FAR 15.306(c)(2) Exchanges with offerors after receipt of proposals (Competitive Range) , if the Government establishes a competitive range to hold discussions, the Government reserves the right to limit the number of most highly qualified offerors selected for the competitive range discussions for the purposes of executing an efficient competition.

B. FACTORS AND SUB-FACTORS TO BE EVALUATED: The following evaluation factors and sub factors will be used to evaluated proposals:

FACTOR 1 Technical Subfactor A Management Approach Plan Subfactor B Licenses

FACTOR 2 Past Performance

FACTOR 3 Price

Technical capability of the offered proposal meets the Government’s technical requirement, past performance, and price. The Government intends to award this contract to the lowest price offeror who is acceptable in the Technical and Past Performance Factors. Each factor and subfactor (except Price) will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or subfactor will result in an overall unacceptable rating.

The following ratings will be used in evaluating technical factor and Subfactors. NOTE: Elements are not given a separate rating

Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 1 Technical

The technical proposals will be evaluated to determine each offeror’s ability to accomplish the technical requirements as specified in the solicitation. The technical proposals will be evaluated to determine the extent to which each technical requirement of the solicitation has been addressed in accordance with the proposal submission section of the solicitation.

SUBFACTOR A MANAGEMENT APPROACH PLAN

This overall factor considers adequacy, effectiveness, and comprehensiveness of the offeror’s technical execution approach, as well as the offeror’s ability to meet all the requirements of Part 5 the PWS.

The offeror’s plan shall address at a minimum each element/task as follows:

Element 1 Contractor / Service Provider Service Implementation Plan (Activation/Deactivation) Element 2 Contractor / Service Provider Service Transition Plan Element 3 Contractor / Service Provider Leased Communication Service Coverage

SUBFACTOR B LICENSES.

Element 1 Contractor/ Service Provider requirement:

The Contractor shall provide ACTIVE “Communication Infrastructure Business License Certificate”

(기간통신사업사 증명서) issued by ROK “Ministry of Scient and ICT” (과학기술정보통신부).

The Contractor shall provide ACTIVE “Information and Communication Construction License”

(정보통신공사업자증) and registered to “Korea Information & Communication Construction Associate

(KICA |한국정보통신공사협회)”

The Contractor shall provide ACTIVE “Certification of possession of information and Communication

Engineer” (정보통신기술자 보유 확인서) and registered to “Korea Information & Communication

& Bradstreet)” (나이스디앤비) or equivalent.

Element 2 Business License: The offeror shall submit copy of valid business registration issued by ROK Government Authorities in both Korean and English.

Factor 2: PAST PERFORMANCE.

The following ratings will be used in evaluating Past Performance Factor:

Acceptable Based on the offerors performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offerors performance record is unknown.

(See note below)

Un-acceptable Based on the offerors performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable".

The Contracting Officer will evaluate past performance to determine the offeror’s capability to perform the contract.

Evaluation of past performance will be done only on proposals that receive a technically acceptable rating on Factor A Technical.

The offeror shall provide documentation outlining Past Performance on up to five (5) contracts under which they performed as a prime or subcontractor for work that is the same or similar in nature and similar size and complexity as the RFP’s requirements (relevant) for the past three (3) years (recent) as of the closing date of the solicitation.

Past Performance will be evaluated in accordance with FAR 15.305(2).

Past performance will be evaluated in the following manner:

Relevance. Review of the detailed explanation submitted by offerors demonstrating the relevance of the referenced work to the requirements of the solicitation.

Quality Assessment. The Government will obtain past performance information from any reasonable source available, including Government databases in order to evaluate the offeror’s past performance. Additionally, Past Performance References may be contacted by phone or e-mail to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical capability and quality of services.

Factor 3: PRICE.

The price proposal will be evaluated utilizing price analysis techniques identified in FAR Part 15.404-1(b) to determine if the price proposal is complete and reasonable.

Completeness: Offerors shall propose the Leased Communication Service plans with fixed unit prices using “TE

04. BOA Leased Communication Service_Price Table” commercially available in each monthly plan.

Price Reasonableness: Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, previous prices for same or similar services and/or when compared among other technically acceptable offers.

Price is not scored. The Government intends to evaluate proposals and award a contract without discussions.

Therefore, Offerors are instructed that submitted proposals should contain their best pricing.

Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.

All pricing will be quoted in Korean currency (KRW). Contracts will be issued, and invoices paid in KRW currency.
