SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

a. The purpose of this amendment is to response to requestions received:

QUESTION-1: Article 18(3) and Article 45 of ROK Waste Control Act regulate the entire process of waste discharge, transportation, and final disposal transparently. (see attached files)

Additionally, although the solicitation specifies that ownership and title to all removed oil/water mixture and POL-laden sand/soil mixture from the US Government is immediately transferred to the contractor (PWS 8.10. Transfer of Ownership), there may still be criticism regarding the lack of post-supervision over the contractor's discretionary handling.

Therefore, it is deemed necessary to clarify PWS 8.11.2. Disposal of waste, and it is advisable to include the following wording;

The contractor shall register in www.allbaro.or.kr (올바로) to perform requirement by ROK Waste

Control Act (페기물관리법 제18조 제3항 및 제45조). For every disposal, a disposal certificate by the Allbaro System must be submitted to the COR for proper environmental and record documentation purposes after disposal is complete.

RESPONSE-1: The Government acknowledges that the industry practices system for tracking “on-site information on waste treatment” which is mandated by the ROK Government. Based on recent business practices in similar USFK contracts, DPW verified that contractors have provided the on-site information on waste treatment to CORs for fulfilling contractual obligation to track waste treatment results associate with pick-up, transport and disposal of waste. The Government does not need to revise or add the inquired paragraph in the RFP, as the PWS 8.10 and 8.11 prescribes contractor responsibility to meet the Government requirement. Many CORs in the Government have experience in monitoring and confirming that contractors comply with contract requirement as well as the ROK Government law, specifically in waste treatment.

QUESTION-2: Para 8.5 of PWS, Pick-up and Transport Water from Oil/Water Separator (CLIN X003): The water with oil sheen in the OWS are not necessary to dispose at the disposal facility. However, these water with oil sheen in the OWS shall be transported to the installation Land Farm Area for a waste treatment. The contractor shall pump-up those water with oil sheen from the OWS, transfer to contractor’s truck, and transport them to a designated installation Land Farm Area nearby building 8750.

The contractor shall coordinate with the COR for DPW shop backfill oil water separators with fresh water.

Examples of the OWS conditions that water with oil sheen are shown on the Technical Exhibit 04 – Examples of Oil Water Separators.

How to distinguish [Dispose of Oil/Water Mixture from OWS] and [Water from OWS]?

RESPONSE-2: The Technical Exhibit shows differences between oil/water mixture and oil sheen.

Decision to the oil sheen is the Government discretion, along with coordination with DPW management teams.

QUESTION-3: If they are distinguished, what are the location numbers for Dispose of Oil/Water Mixture from OWS and Water from OWS?

RESPONSE-3: The location number of the Land Farm Area is not assigned at this moment, due to construction is not accepted to the Government. The Land Farm facility will be operational prior to the subject contract award.

QUESTION-4: Should Wash Rack be classified as Water from OWS?

RESPONSE-4: The wash racks are normally connected to OWS. In the event the water in the wash rack is necessary to collect, the Government may issue a task order to perform unscheduled work in CLIN X005 which articulated in the paragraph 8.12 of PWS, to remove water from the wash rack.

QUESTION-5: The Contractor shall coordinate with the COR for DPW shop backfill oil water separators with fresh water.

Does the above phrase mean that 400,000 Kilograms of fresh water must be filled into the OWS after moving the Water from OWS to [Land Farm Area]?

So where should the water be obtained? Should it be brought from within Humphreys or from outside?

RESPONSE-5: The paragraph 8.5 illustrates contractor responsibility on notifying the COR with completion of pick-up water from OWS. Once COR receives and accepts a result of pick-up water from OWS, the COR arranges DPW shop execute to backfill OWS with fresh water.

QUESTION-6: Quantity of Dispose of Oil/Water Mixture per OWS?

RESPONSE-6: The quantity of disposal reflects historical data. However, actual quantity would be subject to change depending on the tenant activities or events.

QUESTION-7: Quantity of Dispose POL-Laden Sand/Soil Mixture per OWS?

RESPONSE-7: The quantity of disposal reflects historical data. However, actual quantity would be subject to change depending on the tenant activities or events.

QUESTION-9: How many collection requests are made per year? In the last on-site explanation, I heard that DPW comes in and does the work when requested. How many times a year does the work happen?

Is it once or twice a month?

RESPONS-9: The frequency of the disposal is subject to change. However, the frequency would be longer than a once or even twice a month.

QUESTION-10: Individual task order shall specify the OWS facility location.

RESPONSE-10: Individual task order shall specify the OWS facility location.

QUESTION-11: Are payments made according to the quantity each time the work is done or are payments made on a regular basis?

RESPONSE-11: The payment shall be made each time the work is done, not regular basis.

QUESTION-12: What is the payment standard if the contract and actual collection volume are different?

RESPONSE-12: The paragraph 8.9 indicates contractor measure weight of remove quantity at the measuring point, before and after work. The payment would be made based on measured record of measuring point. The facility number of the measuring point is building 8512.

Can I participate in this bidding?

RESPONSE-13: In order to be evaluated as acceptable offeror, you should provide a copy of valid permission or license(s) as shown on the RFP.
