AMENDMENT 0001
a. The purpose of this amendment is to answer questions from Offerors as follows:
Questions and Answers from Offerors for W91QVN-19-R-0004, CARC Painting
1. IAW Addendum to FAR 52.212-1, Instructions to Offerors (Oct 2015), and FAR 52.212-2 Evaluation-
Commercial Items (Oct 2014), sub-factor 5, Contractor Furnished Facility, Part 1, General Information, para 1.6.3
Place of Performance and Part 4 Contractor Furnished Items and Services, we are confirming that the contracted
PWS works shall be performed at the Contractor furnished facilities (CFF) of KTO and asking questions below.
1-1. Buildings: Considering wider military tracked vehicles i.e., Carrier, Ammunition (3.1 m), Howitzer self-propelled (3.2 m), Tank series (3.7 m), Full track tractor (2.5 ~ 3 m), Recon, SUS, Armored Vehicle Launcher
Bridge ( 4 m), M989 Tri & Semitrailer Series Vehicles (2.5 m ~) even HEMTT (2.4 m), the minimum suggested of five (5) meters width of building and indoor paint spray booths would seem too conservative from the view of government’s receiving quality works and providing safety of contractor workers. Because the minimum requirement width five (5) meter of the paint shop only allow painter’s working space at back against the wall, less than one (1) meter, one side that would be too impractical. Because the contractor’s standing in the narrow space, spraying painting 3 meter height up and 15 meter length swing, back and forth. The paint booth is to be enclosed, surrounded and sealed by 4 side walls and roof. What’s more is IAW the Chapter 12, TM 43-0139 inspection procedures for full camouflage paint pattern drawing, it also requires to inspect visual conformation check from 50 feet or more under even Level 1 inspection. It is not only to ensure the Government receiving the quality service delivery but also secure safety of the government property in case of emergency like accidental fire. We are asking question if it is more reasonable requirement of paint booth, the size change to at least, 15 (fifteen) meter width or more, from the five (5) meter. CARC painting of US military vehicles requires some level of contractor’s facility to provide the Government with quality services and ensured safety.
Answer: The requirement of the necessary Facility (Building and Indoor Paint Spray Booths minimum of five (5) meters width x five (5) meters height x 15 meters length) is minimum. Therefore, if the offeror possesses more than five (5) meters width, it is acceptable.
1-2.The vehicles inducted into the contractor plant, before CARC paint application, shall be washed for surface cleaning. As the contractor shall provide the high pressure water washing facilities/equipment as Contractor
Furnished Facilities (CFF), with no additional cost to the government, we are asking question if the offeror shall present washing equipment/facilities clearly as contractor furnished facility (CFF).
Answer: Please see the PWS paragraph 1.1.
PWS 1.1. Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Chemical Agent Resistant Coating (CARC) with Camouflage Pattern Painting and Corrosion Treatment of
Tactical Wheeled Vehicles (TWV) and Trailers as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1-3. Following the washing process, before applying CARC paints in the painting booth, all necessary preparation of intensive vehicle surface pretreatment process including blasting, sanding, wire brushing and grinding in addition to masking works are required that cause considerable amount of industrial dust of metallic or chemical forms and noise, and are to be performed inside enclosed separate space of 4 side walled under the roof with isolation system of the environmental issues. It is also prohibited in open air. Beside if a minimum pretreatment booth is not available, after/at camouflage CARC painting works completed, the government would not be able to inspect/check if underneath surface pretreatment were made complete with conforming the requirement, but it will covered by camouflage painted over. Thus we are asking question if a similar size of surface pretreatment workshop is provided separately.
Answer: Offeror’s are required to possess the expertise necessary to provide CARC painting services as outlined in the PWS, that means providing adequate facilities to perform the requirement. Please see the PWS paragraph 1.1.
The contractor shall perform to the standards in this
2. IAW Part 1. General Information, 1-1 Description of Services/Introduction: Under the contract, materials of
CARC paint and Corrosion Treatment compounds shall be furnished by the contractor. This solicitation seems to omit technical specification of the materials while the previous solicitation states under the PWS, quote “The contractor shall furnish the CARC paint and CPC compounds. The contractor shall obtain the CARC paint from a
QPL vendor capable of supplying sufficient CARC paint and CPC compounds and equipment specified in TB 43-
0213 (CPC compound: US army fielded vehicles CPC compounds) as CFM in a timely manner” unquote. We are asking question if the technical specification of the materials is provided under the section of contractor furnished material (CFM), so that the offeror could supply the materials in timely manner by indicating what CARC paint material from what specific QPL supplier US Army approved.
Answer: The Contracting Officer’s Representative or other appointed Government official will approve of the use of any contractor furnished material (CFM) before use.
Please see the PWS paragraph 1.1.
The contractor shall perform to the standards in this
3. IAW para 5.9 PWS, PRS#2, requires the Corrosion Treatment Work, Corrosion Treatment or Corrosion
Preventive Compound (CPC) coating material in addition to the CARC paint material, could be considerable portion of the contract in costing while Corrosion Treatment coating is also more complicated process, for example while
CARC paint involving 3 or more paint related materials, as Technical Bulletin, TB 43-0213 Corrosion Prevention and Control (CPC) requires 45 different kinds, technically unique and different of CPC items to use by different types of vehicles and/or specific locations of CPC application on the vehicles. We are asking question if the offeror is to wait any corresponding ELINs and quantities for CPC Coating works are to be included and the technical specification of the compound in accordance with the TB 43-0213.
Answer: All of the corrosion treatment ELINs are removed because there are no task order issued for current contract based on historical data and RA performed the market research and found that there is no special corrosion protection required for paint currently used.
4. The CARC paint material is of International Traffic in Arms Regulation (ITAR) controlled items requiring the export license from the Department of State, USA and the ITAR compliance in supplying CARC paint material is must for the contract services. The International Traffic in Arms Regulations (ITAR) and the Export Administration
Regulations (EAR) are two important United States export control laws that affect the manufacturing… distribution of technology. Export control laws provide for substantial penalties, both civil and criminal. Failure to comply with
ITAR can result in civil fines as high as $500,000 per violation, while criminal penalties include fines of up to
$1,000,000 and 10 years imprisonment per violation. As none without complying with the regulation can import the materials in timely manner, we are asking question if an offeror is encouraged to indicate their eligibility how to furnish the CARC paint materials, via providing a copy of Export License under CFR Certification requirements or in any other ways, Answer: Offerors must understand the required laws and regulations in order to comply with ITAR however, the solicitation does not require offerors to provide a copy of their export license.
Please see the PWS paragraph 1.1.
The contractor shall perform to the standards in this
5. IAW Part 5, Specific Task, the Government anticipates to deliver approximately 77 to 100 vehicles monthly and the contractor shall complete the service works within twenty (20) working days and the contractor shall store and protect all military assets secured during the said period, we are asking if the contractor shall provide evidences being capable of storing at least minimum 30 units or more, from induction unloading to loading delivery on transportation by presenting facility layout and photos of a parking space justifiable that shall be surrounded by security fence and being equipped with CCTV security surveillance system with recording capabilities, to protect the military assets from unauthorized access of civilians.
The contractor shall perform to the standards in this
6. Regarding requirement of Certificates of noise & vibration discharging facility IAW PWS para 1.7.3 the prime contractor’s certificates and Part 5, Specific Tasks 5.4 Sub-factor 6. Contractor Certifications, IAW the Noise and
Vibration Control Act by the Ministry of Environment, Chapter 1 General Provisions, Quote “it only control such noise and vibration generated in factories, construction work fields, roads, railroad, etc” Unquote. The “factories” under the Noise & Vibration Control Act, meaning of (manufacturing) factories generating noise & vibrations damaging environment while a CARC painting workshop is not necessarily required the Noise and Vibration
Certification by the law and regulation. IAW Enforcement Regulation of Noise and Vibration, Article 2 para 2 define factories that are generating vibrations using machine, machinery such as press, crusher, forging press, woodworking machinery, rice policing by pounding, molding press, manufacturing bricks. The CARC camouflage painting works have been performing since 2003 and not been requested of the noise and vibration certification.
Under the Business Registration of Vehicle Maintenance and Repair, CARC painting works is authorized to perform. We are asking a question if the requirement of noise and vibration certification is taken as waived if unnecessary in performing CARC painting works.
Answer: The US Government requires certificate of noise & vibration discharging facility (소음진동
배출시설설치신고증명서) issued by ROK Government of this solicitation in order to prevent noise & vibration for
Vehicle cleaning.
b. The PWS is revised to remove all corrosion requirements as outlined in above Para 3 of answer as shown in summary of changes below:
c. All other terms and conditions remain the same.
