GENERAL DESCRIPTION

B-1. DESCRIPTION

a. The Contractor shall provide all labor, materials, equipment, transportation and other necessary resources for the Area IV, DAEGU AB, GIMHAE AB, GWANGJU AB, KUNSAN AB, and CHINHAE Navy compound

General Construction contract in accordance with the Statement of Work (SOW), specifications, drawings, and terms and conditions contained herein.

b. The Statement of Work (SOW) in Section C defines the repair and upgrade of USFK facilities located in

Area IV, DAEGU AB, GIMHAE AB, GWANGJU AB, KUNSAN AB, and CHINHAE Navy compound, Republic of Korea. Each individual task orders shall be issued and will specifically define the scope of work to be performed therein.

B-2. CONTRACT TYPE: This is a Multiple Award Indefinite Delivery, Indefinite Quantity (MA IDIQ) contract. All supplies/services will be obtained by individual task orders issued by the Contracting Officer, 411 th

CSB, Korea.

B-3. MINIMUM GUARANTEE/MAXIMUM POTENTIAL COMBINED CEILING AMOUNT:

a. If the Government determines to make multiple awards, each IDIQ contract award will have a minimum guarantee of $5,000 for base year only regardless of the number of awards. The maximum potential combined ceiling amount under each MA IDIQ contract awarded for Area IV, DAEGU AB, GIMHAE AB, GWANGJU AB, KUNSAN AB, and CHINHAE Navy compound General Construction will be $245,000,000 including all options.

The maximum potential combined ceiling amount under all contracts awarded as result of this solicitation will be base year; $49M, 1st option year; $49M, 2nd option year; $49M, 3rd option year; $49M and 4th option year; $49M.

b. The minimum guarantee for the total IDIQ is provided in the amount of $5,000 and shall be obligated by issuance of a task order during the base period. The guarantee/limitations by year will be equivalent to the Contract

Korean Won Rate for the following dollar amounts.

c. The Maximum Potential Combined Ceiling Amount may be increased upon Contracting Officer determination.

B-4. The Government anticipates award of multiple contracts as a result of this solicitation.

B-5. ELIGIBILITY FOR AWARD

All sources may submit a proposal or quote as applicable. However, the Republic of Korea (ROK)-United

States (U.S.) Status of Forces Agreement (SOFA), precludes the U.S. Government from granting Invited Contractor or Technical Representative Status to any offeror, for this requirement. All sources submitting a proposal or quote, as applicable, including U.S. sources, must already have, or obtain the requisite business licenses directly from the

ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. Any contractor not already doing business in Korea as a local source, must submit adequate verification in its initial proposal or quote, that it has the requisite authorization and capacity to compete for the requirement as a local source, and to perform the contract as a local source. If the initial proposal does not fully demonstrate this authorization and capacity, it will not be further considered for award. Whether an offeror qualifies as a local source shall be determined by the Contracting Officer."

B-6. The Maximum Potential Combined Ceiling Amount in this solicitation and the resulting contract is not the actual contract amount. The Maximum Potential Combined Ceiling Amount is the ceiling amount for the total price of task orders that the Government will issue in a given contract period, not to exceed the stated maximum amount in B-3.

Section C - Descriptions and Specifications

TECHNICAL PROVISIONS - I

STATEMENT OF WORK (SOW)

1. DESCRIPTION: The Contractor shall provide all labor, tools, equipment, transportation, materials and other necessary resources to accomplish the scope of work contained in the schedule and in accordance with the drawings, statement of work, specifications and terms and conditions of the individual task order. The type of work anticipated hereunder shall consist of but is not limited to the following: ceilings, walls, floors, doors, windows, latrines, roofing, mechanical work, civil work, and electrical work.

2. PRINCIPAL FEATURES: This project includes the following principal features. Korea Wide General

Construction contract in accordance with the detailed specifications and drawings as provided under individual task orders. In performing work under individual task orders, contractors must comply with the following:

PERFORMANCE OF WORK BY THE PRIME CONTRACTOR: The Contractor shall perform on the site, and with its own organization, work equivalent to not less than 50 percent of the total amount of work to be performed under each task order. The prime contractor shall provide evidence document for direct employees. The evidence documents shall be one of national pension payment record (국민연금 납부기록) or medical insurance payment record (의료보험 납부기록). This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government. (See FAR 52.236-1)

TECHNICAL PROVISIONS – II

TECHNICAL DETAIL SPECIFICATIONS

GENERAL: Technical detail specification will be specified at each task order.

GENERAL CONDITIONS (FOR BOTH ARMY AND AIR FORCE LOCATIONS)

1. CONTRACTOR RESPONSIBILITY:

a. The contractor shall employ individuals qualified to perform the type of work required under the terms of this contract.

b. The contractor shall have full control of all contractor personnel during performance of work under the terms of contract. The Contractor shall ensure that its personnel and subcontractor personnel do not follow any contract performance instructions for addition/deletion of work from any Government employee other than the direction of the Contracting Officer. The Contracting Officer is the only person authorized to modify the contract terms or take any action to enter into a change or contractual commitment on behalf of the Government. The

Government will not be responsible for any cost incurred for any additional work, which is not identified in the task order, contract specifications or on the contract drawings.

c. Contractor team arrangements including partnership, joint venture, subcontractors shall be fully disclosed in an offer identifying the arrangements and company relationships or for arrangements entered into after submission of an offer, before the arrangement becomes effective. Joint venture and partnership teaming arrangements shall propose under a joint DUNS number or provide proof of submission and status with their offer.

2. KEY PERSONNEL: All key personnel as described below, shall be employed by the prime contractor during the performance of the contract. The employee’s national pension and medical insurance shall be paid by the prime contractor. The name and qualifications of the contractor’s key personnel shall be designated in writing to the

Contracting Officer. The Contractor shall not substitute any key personnel, even on a temporary basis, without prior written notification and approval from the Contracting Officer (KO), and any such substitute must satisfy the same qualifications and must be employed by the prime. Within one week after a key personnel position becomes vacant, the contractor must resubmit all impacted documentation to the Government for review and concurrence of the proposed replacement.

a. Contract Manager (CM): The Contractor shall provide a Contract manager who will be the single point of contact for all administration responsibilities during the period of performance on the contract. The name of this person shall be designated in writing to the Contracting Officer. The Contractor shall provide written notification to the Contracting Officer when CM is to be replaced and must have the Contracting Officer’s approval prior to the change.

(1) Dependent upon the Contractor’s management’s decision, the CM may be the same designate for more than one task order whereas, the Contractor has determined their workload is sufficient to demonstrate satisfactory performance on the task orders under the CM’s authority. The CM shall be available within four (4) hours notice by the Contracting Officer to meet on the installation with Government personnel to discuss any issues relative to the contract. The contractor shall designate in writing an alternate CM to meet on the job site with

Government personnel whenever the primary CM is not able to attend. The alternate CM shall have the same qualifications as the primary CM. The Contracting Officer, at any time, may request dismissal of any CM from any task order for unsatisfactory performance. The CM shall not manage more than five (5) task orders at the same time.

(2) The primary and alternate CM are required to have a good working knowledge of both written and spoken English. The employee should be able to read and understand agency regulations, operating instructions, memoranda, and related material concerning the field of work, to prepare correspondence and standardized reports, and to communicate effectively with English speaking staff members and the general public, including both English speaking and non-English speaking persons.

b. Project Manager (PM) shall be a first class licensed engineer (기사) for construction issued by Human

Resources Development Services of Korea (한국산업인력공단) with a minimum of three (3) years relevant experience within the last five (5) years. The contractor shall provide certificate of employment(s) or copy of the employment contract(s) in a PM position to validate at least three (3) years of relevant experience. Relevant experience is defined as experience gained as a Project Manager for a Construction Contractor performing work similar in nature (repairs or minor construction) to the work that is required under this contract in the SOW. The proposed PM may satisfy this requirement by working as a PM for three (3) years for more than one company.

(1) Dependent upon the Contractor’s management’s decision, the PM may be the same designate for more than one task order whereas, the Contractor has determined their workload is sufficient to demonstrate satisfactory performance on the task orders under the PM’s authority. The PM shall be available during normal duty hours, and within two (2) hours notice by the Contracting Officer or COR to meet on the job site with Government personnel to discuss task order matters. The contractor shall designate in writing an alternate PM to meet on the job site with Government personnel whenever the primary PM is not able to attend. The alternate PM shall have the same qualifications as the primary PM. The PM shall not manage more than three (3) task orders at the same time.

The Contracting Officer may request a reduction of workload or dismissal, of any PM for unsatisfactory performance at any time.

(2) The primary and alternate PM are required to have a good working knowledge of both written and spoken English. The employee should be able to read and understand agency regulations, operating instructions, memoranda, and related material concerning the field of work, to prepare correspondence and standardized reports, and to communicate effectively with English speaking staff members and the general public, including both English

c. Contractor Quality Control System Manager (CQCSM) shall be a first class licensed engineer (기사) for construction issued by Human Resources Development Services of Korea (한국산업인력공단) with a minimum of five (5) years construction experience within the last seven (7) years on construction similar to this contract. The contractor shall provide a certificate of employment(s) or copy of the employment contract(s) in a CQCSM position to validate at least five (5) years of experience. Relevant experience is defined as experience gained as a CQCSM for a construction contractor performing work similar in nature (repairs or minor construction) to the work that is required under this contract in the SOW. The proposed CQC System Manager may satisfy this requirement by working as a CQCSM for more than one company. OMA specification, SECTION 01 45 00.00 10, paragraph 3.4.2

CQC System Manager, will not be applicable. However, CQCSM shall obtain training certificate from 411th CSB

QA office.

(1) Dependent upon the Contractor’s management’s decision, the CQCSM may be the same designate for more than one task order whereas, the Contractor has determined their workload is sufficient to demonstrate satisfactory performance on the task orders under the CQCSM’s authority. The CQCSM shall be available during normal duty hours, and within two (2) hours’ notice by the Contracting Officer or COR to meet at the job site with

Government personnel to discuss task order matters. The contractor shall designate in writing an alternate CQCSM to meet on the job site with Government personnel whenever the primary CQCSM is not able to attend. The alternate CQCSM shall have the same qualifications as the primary CQCSM. The CQCSM shall not manage more than three (3) task orders at the same time.

(2) The primary and alternate CQCSM are required to have a good working knowledge of both written and spoken English. The employee should be able to read and understand agency regulations, operating instructions, memoranda, and related material concerning the field of work, to prepare correspondence and standardized reports, and to communicate effectively with English speaking staff members and the general public, including both English speaking and non-English speaking persons.

d. Site Safety and Health Officer (SSHO) shall have at least five (5) years of construction industry safety experience within the last seven (7) years or three (3) years within the last seven (7) years if he possesses a safety engineer license issued (안전기사) by Human Resources Development Services of Korea (한국산업인력공단).

The contractor shall provide a certificate of employment(s) or copy of the employment contract(s) in a SSHO position to validate their experience. Relevant experience is defined as experience gained as a SSHO for a

Construction Contractor performing work similar in nature (repairs or minor construction) to the work that is required under this contract in the SOW. The proposed SSHO may satisfy this requirement by working as a SSHO for more than one company.

(1) Dependent upon the Contractor’s management’s decision, the SSHO may be the same designate for no more than 3 task orders whereas, the Contractor has determined their workload is sufficient to demonstrate satisfactory performance on the task orders under the SSHO’s authority. The SSHO shall be available during normal duty hours, and within two (2) hours notice by the Contracting Officer or COR to meet at the job site with

Government personnel to discuss task order matters. The contractor shall designate in writing an alternate SSHO to meet on the job site with Government personnel whenever the primary SSHO is not able to attend. The alternate

SSHO shall have the same qualifications as the primary SSHO. SSHO shall obtain training certificate from 411th

CSB QA office.

(2) The primary and alternate SSHO are required to have a good working knowledge of both written and spoken English. The employee should be able to read and understand agency regulations, operating instructions, memoranda, and related material concerning the field of work, to prepare correspondence and standardized reports, and to communicate effectively with English speaking staff members and the general public, including both English

3. PRIME CONTRACTOR’S REQUIRED CONSTRUCTION REGISTRATION: In accordance with Laws of

South Korea, the prime contractor must possess the Construction Registration for General works (Civil &

Architecture) (건설업등록증/토목 & 건축공사업), and Specialized work for Electrical (전기공사업). The prime contractor shall have valid registrations/licenses and shall maintain valid registrations/licenses during the entire performance period of the contract. The prime contractor may not allow subcontractors to use their certificate for this requirement.

4. CONTRACT MANAGEMENT PLAN: The Contract Management Plan shall include the contractor’s detailed processes that allow them to manage the contract IAW Statement of Work and drawings. As a minimum, the contract management plan shall include:

a. Contract Management tools to: 1) successfully plan, schedule and track the progress of individual task orders, 2) control project quality including tracking individual and overall contract discrepancy reports (CDR), 3) resources to manage multiple task orders.

b. Organization chart for overall management showing the functional relationships and individual team members. As a minimum, chart shall include personnel listed in paragraph entitled “Key Personnel” and clearly show lines of authority.

c. The standard for Contract Management Plan submittals is electronic format, unless hard copies are specifically requested in a Task Order. Contract Management tools shall be software-based using commercially available software capable of producing MS Office-compatible (Word or Excel) or Portable Document Format

(PDF) files and documents. PDF files containing text should be searchable.

d. Master Project Schedule. The Master Project Schedule shall be resource loaded with key personnel and sub-contractor personnel for commercial and federal projects. The contractor shall maintain the Master Project

Schedule current and provide a copy to the Government upon request.

5. CONTRACTOR QUALITY CONTROL (CQC) PLAN AND SAFETY PLAN/ACCIDENT PREVENTION

PLAN (SP/APP):

a. The CQC plan shall include the Contractor’s detailed CQC plans that incorporate O&M section numbers

01 45 00.00 10 paragraph 3.2. As a minimum, the Contractor’s CQC plan shall include:

(i) A description of the quality control organization, including a chart showing lines of authority.

(ii) Control, verification, and acceptance testing procedures for each specific test to include the test name, specification paragraph requiring test, feature of work to be tested, test frequency, and person responsible for each test.

(iii) Procedures for tracking preparatory, initial, and follow-up control phases and control, verification, and acceptance tests including documentation.

(iv) Procedures scheduling, reviewing, certifying, and managing submittals, including those of the subcontractors, offsite fabricators, suppliers, and purchasing agents. These procedures must be in accordance with

Section 01 33 00 SUBMITTAL PROCEDURES.

b. The SP/APP shall include the Contractor’s detailed plans that incorporate O&M section 01 35 26 paragraph 1.6 and USACE EM 385-1-1, Appendix A. As a minimum, the Contractor’s SP/APP shall include:

(i) A description of the safety organization, including a chart showing lines of authority.

(ii) A description of the safety and health inspections during periods of work activity. Type of inspection

(Daily, Weekly, Monthly), who will conduct the inspections, when inspections will be conducted. A description of the procedures for documenting the safety and health inspections.

(iii) A description of the safety deficiency tracking, and follow-up procedures. Establish verification procedures that identified safety deficiencies have been corrected.

(iv) A description of the contractor’s Risk Management Process. The plan shall provide project-specific hazards and controls by an Activity Hazard Analysis in accordance with USACE EM 385-1-1 paragraph 01.A.14.

6. CONTRACTOR REGISTRATION: All contractors shall be registered in System for Award Management

(SAM) at https://www.sam.gov/.

7. WORK HOURS: The work will be accomplished from 0730 hours through 1730 hours, from 1 October through 30 April and from 0730 hours through 1930 hours from 1 May through 30 September, Mondays through

Saturdays, except for Korean and U.S. legal holidays. Any proposed change in working hours should be approved by the Contracting Officer (KO). These hours may be unilaterally adjusted to accommodate military exercises or any other Government requirements.

8. NOTIFICATION OF INSPECTION: The Contractor shall give the COR three (3) working days written notice prior to each concrete placement, field test, weld application, protective coating application, or any other work determined to require Government inspection per the task order applicable specifications.

9. COORDINATION: The Contractor shall coordinate its work with all others (subcontractor and government agencies) involved in the project and shall cooperate with all other contractors and government agencies to facilitate the general progress of the work. The contractor shall be provided a list of other government agencies and other contractors as applicable, at the pre-construction conference for coordination purposes.

10. CONSTRUCTION: Prior to start of any work for civil, mechanical and electrical, the contractor shall obtain written permission from the COR. The contractor shall submit a request for the construction permit in writing, at least ten (10) working days prior to the anticipated start of work. The request shall be submitted to the COR.

11. HOISTING AND MOVING EQUIPMENT: The prime contractor and subcontractor shall provide all cranes, lifts, and any other moving equipment necessary for the proper and efficient movement of materials. The equipment shall be provided with proper guidelines, bracing, safety devices, and any other associated safety measures, as required by USACE EM 385-1-1. Prime contractor and subcontractors are responsible for safe operations.

12. EQUIPMENT: All Contractor equipment shall be functional and must meet safety standards in accordance with USACE EM 385-1-1. It is the responsibility of the contractor to inspect all of its equipment prior to use.

Equipment not completely safe or functional as determined by the Government, shall be repaired and replaced before work is initiated.

13. RECORD DRAWINGS: During performance under this contract, the contractor shall accurately record and delineate on a set of full-size blue line prints of contract drawings, all changes in such work which constitute departures from the original contract drawings. The set of drawings (one original and one blue line print), thus corrected and changed, usually referred to as “As-Built” drawings, shall be delivered to the COR at the final acceptance inspection by the Government of the completed work.

14. MATERIALS COMPLIANCE: The Contractor shall ensure that all materials used meet the requirements of the contract and provide proof, upon request, to the COR. Materials not meeting the requirements of the contract shall not be brought to the job site. All materials shall be new and shall be the standard products of a manufacturer engaged in the manufacturing of such products. Any materials used in the performance of this contract not compliant with applicable contract specifications and/or requirements, shall be removed and replaced at the expense of the contractor and not the U.S. Government.

15. MATERIAL APPROVAL SUBMITTALS: Prior to ordering or purchasing any material(s) requiring

Government Approval, the Contractor shall prepare and submit an ENG Form 4025 for the ARMY and AF Form

3000 for the Air Force, Transmittal of Shop Drawings, Equipment Data, Material Samples, or Manufacturer’s

Certificate of Compliance. The required submittal date will be specified in each task order. It will take fifteen (15) calendar days to approve material submittals. Any materials used at the worksite without prior approval, will be rejected by the COR. Resubmission or revisions of material submittals shall be accomplished within seven (7) calendar days after receipt of any disapproved/rejected material submittal packages. The Contractor shall be responsible for any delay or adverse impact that disapproved/rejected material submittals may have on the performance of the task order. The contractor shall submit all material submittals in electronic format via email to the COR.

16. OFFSHORE AND LOCAL MATERIALS: All offshore and local materials shall be ordered in accordance to the direction provided below:

a. ARMY PROJECTS: All offshore and local materials requiring approval by the Government shall be ordered within two (2) calendar days after approval by the Government of ENG Form 4025. All offshore and local materials not requiring approval by the Government shall be ordered within ten (10) calendar days after notice to proceed (NTP).

b. AIR FORCE and NAVY PROJECTS: All offshore and local materials shall be ordered within two calendar days after approval of AF Form 3000, Material Approval Submittal.

c. Any materials used at the work site that do not comply with the drawings and specifications will be rejected by the COR.

17. RELEASE OF FACILITIES: Building/facility will not be released to the Contractor by the COR until all building construction supplies are available or due within such a time frame that there will be no delay in project completion.

18. PROJECT WORK SCHEDULE: Preliminary, Initial and Progress work schedules shall be submitted to the

COR in accordance with the O&M Specification, Section 01 32 01.00 10. Project schedule submittal requirements are defined in section 01 32 01.00 10 of the O&M specs. Preliminary project schedule is due within five (5) calendar days after NTP. The project work schedule shall be Network Analysis Schedule (NAS). NAS shall include all activities to complete project. Each activity shall specify the prime contractor work and subcontractor work portions. The Contractor shall perform on the site, and with its own organization, work equivalent to not less than

50 percent of the total amount of work to be performed under each task order. The contractor shall maintain an updated progress schedule and submit a complete update no later than 4 working days after each periodic scheduled meeting or upon COR request. The schedule shall be current within one month, upon government inspection.

19. UTILITIES: All reasonable quantities of water and electricity necessary to perform the requirements of this contract shall be furnished to the contractor at no charge. The Contractor shall have the capability to provide back-up electricity and water in the event of utility failure. Temporary connections shall be made and removed at the contractor’s own expense. The Contractor shall pay for costs for repair of utility lines damaged by the Contractor.

Experienced and certified craftsmen as applicable, shall make all connections, and coordination shall be made with the COR. Connections to existing utility systems will be made either by or under the supervision of the

Government.

20. UTILITY CUTOVERS AND INTERRUPTIONS: Ensure utility cutovers and interruptions are conducted after normal working hours or on Saturdays, Sundays, and U. S. Government holidays as identified in Local Clause

5152.222-4007. Ensure that new utility lines are complete, except for the connection, before interrupting existing service. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm, compressed air, shall be considered utility cutovers. All utility cutovers and interruptions shall be coordinated with the Contracting Officer Representative (COR).

21. WORK OUTSIDE REGULAR HOURS: Unless specified in the task order, work outside regular working hours requires Contracting Officer’s approval. A written request, substantiating the reason for this consideration, should be made at least fourteen (14) calendar days prior to such work to allow arrangements to be made by the

Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During period of darkness, the different areas at the work site shall be lighted in a manner approved by the Contracting Officer. The Contractor shall make utility cutovers after normal working hours or on Saturdays, Sundays, and U.S. Government holidays, unless directed otherwise.

22. DEBRIS REMOVAL DISPOSAL INFORMATION: The Contractor shall remove and dispose of all debris generated by the Contractor in accordance with ROK Ministry of Environment (MOE) laws and regulations.

23. WINTERIZATION: The contractor may be required to perform weather sensitive work during the winter season, which may cause additional costs to be incurred for the contractor. These additional costs are the contractor’s responsibility in the event it is required to work during the winter.

24. VERIFICATION OF ACTUALITIES: The contractor shall visit the job site to familiarize itself with all details of the work and working conditions. If discrepancies between the task order drawing, design, and actual site conditions are discovered, the Contractor shall give a written notice to the Contracting Officer. Upon receipt of written notification from the Contracting Officer, the Contractor shall prepare shop drawings of any necessary field change(s) and submit them to the COR for approval. The Contractor shall not perform any field changes without proper notification from the Contracting Officer. In the case of a differing site condition, the Contractor shall notify the Contracting Officer in writing of the alleged differing sites in accordance with Section I, FAR Clause 52.236-2.

25. SAFETY: The contractor shall comply with applicable sections of EM 385-1-1, U.S. Army Corps of Engineers

Safety and Health Requirements Manual. For Air Force project, the contractor shall also comply with the Air Force

Regulation (AFR), AFI 91-203 Safety OSHA Std 1910, and General Industry Regulations OSHA Std 1926, General

Construction Regulations. Additional requirements may be supplemented per each task order requirements.

26. FIRE PROTECTION: The contractor shall be responsible to comply with the Installation Fire Protection

Program or provisions of the Base Fire Protection Program at each installation. The contractor shall provide suitable fire extinguishers at any material storage area constructed by the contractor as well as at the work site(s). The contractor shall also be responsible to ensure that all contractor employees understand that there will be no smoking inside of any U.S. Government facility at any time during performance of work under this contract. Any contractor employee found smoking in any U. S. Government facility will be removed from the work site by the COR.

27. REPAIR WORK: It is the responsibility of the contractor to repair all areas of patchwork to match existing areas. This work will include all areas inside of the facility as well as any other areas that the contractor may have damaged during performance of work under the terms of this contract.

28. SECURITY REQUIREMENTS:

a. Contractor’s personnel or any representative of the contractor entering installation/base shall abide by all security regulations imposed by Installation Commander or Base Commander at all times and shall be subject to security checks. Contractor’s personnel and property shall be subject to search and seizure upon entering the confines of the installation/base, while on, and upon leaving confines of the installation/base.

b. Escort Privileges: Escort Privileges: The contractor shall be responsible for adhering to the escorting privileges on base passes for the Program Manager, Contract Manager (CM), CQC System Manager, SSHO and team leaders with a limitation of three (3) persons and one (1) vehicle access per base pass. It is the contractor’s responsibility to ensure that the escorting official shall be with all escorted individuals at the site at all times. Any individual found on the installations unescorted will be removed from the installation or base and the escort officials escorting privileges will be immediately withdrawn. Any individual removed from these installations/locations will not be authorized further access to these installations/locations and may further be subject to other Government actions. Base pass and vehicle access request will be submitted within five (5) working days after receipt of NTP.

c. Return Post/Base Passes: On the contract completion date, the contractor shall turn in all passes to the sponsor that were issued for the contract and final payment will not be made until such items are returned.

29. Contract Discrepancy Report (CDR): Whenever the government identifies a contract NC (Non-Conformance) that cannot be corrected on-the-spot, the Contracting Officer will issue a written CDR. The Contractor shall submit the contractor’s Corrective Action Plan (CAP) signed by one level above the Project Manager or Contract Manager to the Contracting Officer within seven (7) days for a level-2 (L2) and three (3) days for a level-3 (L3) after receipt of CDR.

a. A Level II CDR will be issued for a major NC (other than critical), that is likely to result in failure of the supplies or services, or is likely to materially reduce the usability of the supplies or services for their intended purpose. Deficiencies that are recurring (repetitive Level I NCs documented by the Government) or for a non-responsive contractor to negative trends or failure of the contractor's quality control can also be elevated to a Level

II CDR.

b. A Level III CDR will be issued for a critical NC that is likely to result in hazardous or unsafe conditions for individuals using, maintaining, or depending upon the supplies or services is likely to prevent performance of a vital agency mission; is for a repeated or uncorrected Level II CDR; or is for a non-responsive contractor to a Level

II CDR. Critical NCs shall result in the issuance of a written CDR to the contractor requiring the development of a

CAP by the contractor which identifies the root cause, corrective action for the root cause and for the specific NC, and the target date for implementation of planned actions.

SPECIAL PROVISIONS FOR AIR FORCE LOCATIONS

1. DAILY REPORTING: It is the responsibility of the contractor to coordinate with the COR to schedule daily reporting responsibilities in accordance to AF Form 1477 (Blue Book). The Contractor shall provide the COR or project inspector with a written or verbal daily report detailing the work which is being accomplished at the worksite. Failure to meet this reporting requirement may result in a corrective action request from the COR.

Continued failure to report may result in a suspension from receiving future solicitations for task orders.

2. AS-BUILT DRAWINGS: A complete set of As-Built drawings shall be provided by the Contractor to the U.S.

Government. When all drawing updates (if any) have been made, the COR will notify the Contracting Officer so that the final payment may be released. Up to ten (10%) percent of the total contract amount may be withheld pending completion of As-Built drawings.

3. MATERIALS: All salvageable materials removed from the work site and excess Government-Furnished

Materials (GFM) shall remain the property of the U.S. Government. All such materials shall be stored as directed by the COR.

4. CONTRACTOR’S FACILITIES: Erection of any facility by the contractor shall be coordinated with the COR.

An approved U.S. Government Real Estate Permit from the Base Civil Engineer (BCE) shall be in the contractor’s possession before erection is begun. Any contractor-erected facility shall be removed and the area shall be cleaned within seven calendar days after completion of the contract requirements and prior to final invoice payment.

5. AF FORM 103, BASE CIVIL ENGINEERING WORK CLEARANCE REQUEST: Prior to starting any work, it shall be the responsibility of the contractor to have a valid AF Form 103, Base Civil Engineering Work Clearance

Request in his possession. No work shall be performed under this contract without a valid AF Form 103 in the contract’s possession. Request for a Base Civil Engineering Work Clearance Request shall be submitted to the COR a minimum of ten (10) calendar days prior to starting any work under the terms of this contract.

6. BURNING/WELDING OPERATIONS: The contractor shall be responsible to obtain a burning/welding permit prior to any burning or welding operation. The contractor shall notify the COR not less than five (5) work days prior to such operations and shall return the permit to the COR at the completion of the permit period.

7. HOUSEKEEPING: It is the responsibility of the contractor to ensure that the work site is kept clean on a daily basis. This cleaning will include, but is not limited to, removing trash, waste products from construction (such as old floor tile, ceiling tile, lights, dirt, trash, etc.) and any other materials which may present a safety or health hazard or an unsightly condition at the work site. It shall be the contractor’s responsibility to remove this trash from the installation daily. The contractor shall dispose of this trash, at the contractor’s own expense, off base, and in compliance with existing Korean Environmental Laws and Regulations.

8. MATERIAL APPROVAL SUBMITTALS: It is the responsibility of the contractor to prepare and submit an

AF Form 3000 Material Approval Submittal, prior to ordering or purchasing any material(s) to be used in the performance of this contract. It will take fifteen (15) calendar days to approve of AF Form 3000. Any materials used at the worksite without prior approval on an AF Form 3000, will be rejected by the COR. The AF Form 3000 will list which materials require additional information in the form of samples, certificates of compliance, test data, catalog cuts, brochures, as specified in OMA specification 2015. The contractor shall submit all material submittals in electronic format via email to the COR.

9. ALERTS: During military alerts or special operations, the contractor may not be authorized on base or in the work site. When the contractor is prohibited from access to the base or work site for one (1) day or less per month, no adjustment to the contract completion date of affected task orders shall be made. When the contractor is prohibited access for more than one (1) day per month, adjustments shall be made in accordance with applicable clauses of the contract.

10. TEMPORARY SECURITY MEASURES: Whenever a facility or area is not available to perform work, it shall be the contractor’s responsibility to provide temporary measures in order to assure security is maintained at the appropriate levels that existed prior to construction.

11. UTILITY OUTAGES/ROAD CLOSURES: It shall be the responsibility of the contractor to request, in writing, to the COR, a minimum of twenty-one (21) calendar days in advance for any water outage, electrical outage, or road closure. The contractor shall provide a requested date and estimated time for the water outage, electrical outage, or road closure. The KO and the COR will be responsible for determining the impact of the water outage, electrical outage, or road closure. The COR will also be responsible for the processing of the contractor’s request for a water outage, electrical outage, or road closure. Prior to the contractor performing any work for a water outage, electrical outage, or road closure, the contractor shall have written approval for the COR.

12. ENVIRONMENTAL REQUIREMENTS: The Contractor shall be in compliance with current USFK

Regulation 201-1 Korea Environmental Governing Standards (KEGS), Air Force Instructions (AFIs), other applicable ROK laws and regulations, and Air Force Installation policies and plans related with the environment and protection of resources. a. ENVIRONMENAL MANAGEMENT SYSEM (EMS): The Contractor shall ensure all workers are familiar with the goals of Environmental Management System as stated in the base Environmental Policy. All contract personnel working for and/or behalf of US Air Force Bases must remain current with required EMS awareness training and carry out duties in accordance (IAW) with base Environmental Action Plans (EAP).
