SOLICITATION/CONTRACT FORM
The required response date/time has changed from 08-Aug-2017 01:00 PM to 25-Aug-2017 01:00 PM.
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Award will be made to the responsible Offeror submitting the Best Value Lowest Priced, Technically Acceptable
(LPTA) offer that satisfies all terms and condition of the solicitation. Offers will be evaluated for acceptability, but not ranked using non-price factors/subfactors. All non-price factors and subfactors will be rated as either
“acceptable” or “unacceptable”. The following ratings will be used in evaluating all non-price technical factors and subfactors. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
The following ratings will be used in evaluating all non-price technical factors and subfactors:
Acceptable Proposal -- clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal -- does not clearly meet the minimum requirements of the solicitation.
The following ratings will be used in evaluating Past Performance:
Acceptable -- Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (See note below)
Unacceptable -- Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the
Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
FACTOR A – TECHNICAL: All subfactors under technical factor are of equal importance and shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor or subfactor will result in technically unacceptable rating. Failure to provide below requirements will result in a rating of “Unacceptable”.
Subfactor 1: Prime Contractor’s Qualification:
The contractor shall submit all valid and current Certificates of Business Registration and Permission in accordance to ROK Law.
Subfactor 2: Staffing Plan: The Contractor shall provide a staffing plan that clearly demonstrates how the offeror will provide training and certification of official or officials for each individual sport.
FACTOR B – PAST PERFORMANCE
Past Performance: The offeror shall have recent and relevant past performance in the same or similar projects related to this requirement. Recent past performance is within the last seven (7) years from the solicitation issue dates.
Relevant past performances those that are the same or similar services based on size, scope, complexity, and contract type.
Past Performance of offerors will be evaluated based on the following processes:
(1) Review of the detailed explanation submitted by offerors, demonstrating the relevance of the references to the requirements of the solicitation.
(2) References will be contacted by phone or email to verify contents by providing a detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including the Government database; Past Performance Information Retrieval System (PPIRS) website http://www.ppirs.gov in order to evaluate offerors' past performance. Also CPARS, if applicable, will be used for evaluation of the past performance.
The offeror’s past performance will be evaluated in accordance with FAR 15.305(a)(2) in the following manner:
Acceptable (A) – Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. The offeror(s) has demonstrated satisfactory timeliness and quality of services within the last seven (7) years.
Unacceptable (U) – Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort and satisfactory timeliness and quality of services within the last seven (7) years.
Note: As part of the Responsibility Determination, the Contracting Officer will evaluate past performance to determine the offeror's capability to perform the contract. Failure to submit data or lack of any performance history will not in itself be a reason for determination of non-responsibility. The Contracting Officer is not limited to the information provided. The Contracting Officer may use this data along with data obtained from other sources the
Contracting Officer determines appropriate to obtain sufficient information on the offeror's past performance to make a responsibility determination.
FACTOR C – PRICE
Price analysis will be conducted for each proposal to ensure completeness, adequacy, and reasonableness. Proposed price shall be evaluated the price on fair and reasonableness in accordance with FAR 13.106-3.
The offeror shall estimate total cost to be expended for each line item unit price per sport and submit fully loaded rates accordingly.
The offeror shall provide complete the pricing information for each Contract Line Item Number (CLIN) and Sub
Contract Line Item Number (Sub-CLIN) identified to include:
(a) Schedule of Services (CLINs/SubCLINs) of the RFP for all five (5) years;
(b) Prices shall be in local currency (Korean Won)
(c) Any escalation in option year pricing shall be identified
Note 1: The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy-in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.
Note 2: Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period five (5) years from the date of award. Price shall include all CLINs and Sub-
CLINs as listed on the Price Schedule including all five (5) years. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
Options
Option Clause 52.217-8. As part of price evaluation, As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period price to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the 1st year, 2nd year, 3rd year, 4th year, 5th year, and one-half of the 5th year. Offerors are required only to price the five (5) years. Offerors shall not submit a price for the potential one-half year extension of services period.
Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
