SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible 8(a) Women-Owned Small Business or 8(a) Service-Disabled Veteran-Owned Small Business offeror that submits the lowest priced, technically acceptable offer. Only those proposals determined to be technically acceptable and have acceptable past performance, either initially or as a result of discussions, will be considered for award. For proposals determined acceptable in technical capability and past performance, an award will be made to the lowest priced offer. All offers will be evaluated with the following factors:
(i) Technical Capability;
Technical acceptability is defined as the offeror’s demonstration that it meets all minimum requirements of the solicitation, including the sub factors below. Proposals will be assigned a factor rating of “acceptable” or “unacceptable”.
(1) Licensing and Qualifications Proposed employees must meet the minimum licensing and qualifications of the State of Maryland including personnel specifically trained and qualified to work on fire protection systems and equipment and can perform all work according to manufacturer’s instructions. The contractor shall have knowledge and experience in installing Class 1, 2, & 3 wiring and be licensed as a Master electrician in the State of Maryland DLLR Division of Occupational and Professional Licensing. The contractor shall be able to insure installation meets the requirements of NFPA 25, NFPA 72, UFC-3-600-02 & UFC-4-0021- 01 and UFC-3-600-1 and other appropriate NFPA Sections. Any contractor personnel working with any aspect of existing Fort Detrick or Forest Glen fire alarm systems shall also have a NICET level 3 certification. The contractor shall also indicate they are capable to reprogram the existing Fire Alarm systems located at Fort Detrick and Forest Glen. The on-site technician (OST) shall have such Licenses and Qualifications as noted here in. The contractor shall provide at least three (3) technicians to perform the necessary duties for the required services.
(2) Staffing Plan Contractor must provide a staffing plan demonstrating that they can meet the minimum staffing levels. The contractor shall provide at least three (3) technicians to perform the necessary duties for the required services. At least one Lead Technician shall be provided with at least a minimum of 7 years experience in maintaining fire protection systems. At least two junior technicians shall be provided with at least a 3 years experience in maintaining fire protection systems.
(ii) Price;
An offeror’s total evaluated price will be determined by adding together Cells H4, I4, J4, K4, L4, H534, I534, J534, K534, and L534, 50% of cell L4 and 50% of cell L534 of the Pricing Spreadsheet. Price will be evaluated for completeness and reasonableness using the techniques in FAR 15.404. Price reasonableness will be determined based on the offeror’s total overall price. No adjectival ratings will be used to evaluate price.
The sums in cells H534, I534, J534, K534, and L534 will be utilized for evaluation purposes ONLY. $25k not to exceed dollar amounts on CLINs X002 of the solicitation shall be the awarded CLIN dollar amounts for those CLINs. $50k not to exceed dollar amounts on CLINs X003 of the solicitation shall be the awarded
W91QV1-18-R-0028
CLIN dollar amounts for those CLINs. The pricing for the parts and labor contained in Columns B, C, D, E and F on the spreadsheet shall be employed during post contract award.
(ii) Past Performance;
Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table 1. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.” Intentional failure to provide past performance reference information will also be a basis for a finding of unacceptability.
Past performance shall be evaluated to determine whether the offeror’s present/past performance is recent, and relevant to the effort to be acquired. The offerors’ Past Performance shall also be evaluated on the basis of quality. To be considered recent, the offeror shall present past performance that has occurred within the last 3 years of solicitation issuance. To be considered relevant, the offeror shall present past performance that demonstrates experience with either installation or inspection/testing/maintenance of fire detection, fire suppression and control systems, sprinkler systems and other fire alarm related devices. To be considered having an acceptable quality of past performance, the Past Performance evaluations must evidence of ratings and performance no less than acceptable.
Table 1: Past Performance Acceptable/Unacceptable Rating Method
“Acceptable”: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
“Unacceptable”: Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
