Control Number: N3-FY13-JA02
LIMITED SOURCES-
JUSTIFICATION
UNDER FAR 8.405-6

2. Description of Action:
Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number
Pricing: Firm-Fixed Price Time & Materials Cost
For Hybrid Contracts, list percentage of each type of pricing:
Firm Fixed Price: 66% Cost: 34%
Funds: Operations and Maintenance, Army (OMA) Other Funds:
Fiscal Year of Funds: FY 13
Name of Proposed Contractor(s): BMC Software Distribution, Inc.
Street Address: 8401 Greensboro Drive, STE 100 City, State, Zip: McLean, VA 22102-5100 Phone: 301-788-5474
3. Description of Services or Supplies:
The total estimated value of the proposed action is $2,348,095.81.
The Contractor shall provide a fixed price block of BMC Remedy ITSM senior consulting hours in support of engineering, test and evaluation, training, integration and sustainment support, configuration management, and life-cycle support of the Army Enterprise Configuration Management Database/Service Support (CMDB/SS) system. The Contractor shall provide 1,034.79 Learning Pass Credits, and associated formal BMC Remedy/ITSM training provided by Certified BCM trainers. The Contractor shall administer and provide BMC/Remedy ITSM just-in-time training to NETCOM Operations and Engineering Staff. The training must synchronize with the build, deployment, and operational requirement of Global Ticketing Consolidation (GTC) Bridge to Enterprise Service Management System (B2E). The Contractor shall support the integration of information/data exchange of Army Land War Net (LWN) Network Operations (NetOps) Architecture (LNA) capabilities with the CMDB/SS. The Contactor shall provide subject matter expertise in Asset and Change, Configuration and Release Management, Service Level Management, and Service Request Management modules in Remedy ITSM, Dashboards and Analytics, Knowledge Mgt, and other modules as required.
Personnel will not be permanently assigned to a physical location. The support is not for individual employees to be assigned for the duration of the call order, but rather a block of consulting time where senior consultants can be requested based on which BMC Remedy modules the Army is deploying or modifying. BMC Remedy Certified Senior Systems Engineers/Consultants are required. The support may include telephonic support or on-site support for two weeks to three months at a time, depending on the complexity of support requested. The Contractor remains responsible for compliance with PWS requirements and for ensuring that their employees meet the qualifications set forth in this call order. Training shall be tightly synchronized with the design, build, deployment and transition to operations phases, providing the right training to the right personnel at the right time, based on GTC B2E requirement and Theater assessed needs. This just in time delivery will enable the Government to ensure that support personnel are adequately trained to support the services provided by GTC B2E and will eliminate Government administrative overhead in coordinating training sessions.
This is a continuing requirement for NETCOM Headquarters, the previous call order W91QUZ-07- A-0006 E115 was awarded in the amount of $390,835.04, with a Period of Performance (POP) of 30 September 2012 through 30 March 2013. NETCOM Headquarters still has a bona-fide need for these services and this call order will be issued for 12 month with a POP of 30 June 2013 through 29 June 2014.
4. Authority:
FAR 8.405-6 (b) “Only one source is capable of providing supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”
5. Reasons for Authority Cited:
BPA W91QUZ-07-A-0006 was established by ITEC-4 as an ESA with BMC Remedy and in accordance with AFARS 5139.101(A) the contracting office is required to use Army’s C.H.E.S.S.
website as the primary contracting vehicle for IT product and service. The AFARS requirement complies with Army and DoD ESI policy and standards (DFARS 208.74 and DFARS PGI 208.7403).
The use of BMC-authorized consulting services enables NETCOM to take advantage of a single point of contact for speedy issue resolution and avoid time lost due to indentifying the issue owner.
Integration of any products other than Remedy into the existing structure would require a complete re-engineering effort to meet Army architecture, compliance, and guideline criteria. BMC Software will not provide the operating system code to any other manufacturer.
By placing a call order against a BPA using the procedures in 13.303-5, it has been determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. This will ensure the systems remain compatible and interoperate with existing systems within NETCOM and the Joint community. NETCOM must continue to employ the same Remedy software; otherwise its “trouble tickets” will not be visible to all Army Network Operations Control Centers. If trouble tickets are not visible, NetOps Managers will not be able to capture, record, track, resolve, or inform users, customers, and commanders of Network and service outages.
BMC Software is the developer and marketer of the Remedy IT Service Management (ITSM) suite of applications. As such, only BMC Software is positioned to provide the subject matter expertise and support services as needed by the Army. As is often the case with the implementation of large and complex software systems, technical issues come up. Because the full suite of Remedy software is so tightly integrated into the network and operating systems, using BMC-authorized consulting services enables NETCOM to take advantage of a single point of contact for speedy issue resolution and avoid time lost due to indentifying the issue owner. It is critical to provide reach-back support from the vendor who has deep insight into the software that extends beyond the capabilities of local contractor support.
6. Actions to Increase Competition: Integration of any products other than Remedy into the existing structure would require a complete re-engineering effort to meet Army architecture, compliance, and guideline criteria. BMC Software will not provide the operating system code to any other manufacturer. Between 21 May 2013 and 23 May 2013 the contracting office communicated with the Point of Contact (POC) of the Global Network Enterprise Solutions Support Center (GNESSC). The POC, when asked whether future opportunities exist to compete the requirement, said that bringing in another company to build or help do the process and work flows is not feasible in the short term. BMC’s knowledge helps the Army to review other commands process and work flows to determine if they have a mature process that can be leveraged to support the Army globally.
Although this particular requirement is a one year effort, which may appear to lend itself to future competition, the GNESSC POC explained this is not a short term effort. BMC ITSM consulting is involved in an integrated Army global process. The plan is to have all theatres and commands on the new system to enable the migration to the new managed service, which is expected to take until the end of FY 17. Ideally, the requirements related to Remedy would contain option years, but the POC noted that funds are difficult to obtain and efforts to acquire more money would slow down the process.
7. Market Research: The C.H.E.S.S. website and GSA Advantage have been reviewed. There is a mandatory DoD ESA available for this requirement. On 1 May 2013, the contracting office spoke with the Army Services Manager for BMC Software, LLC. The Army Services Manager confirmed that the level of consulting support under this proposed task order is only provided by BMC, and isn't available through third-party vendors While the training itself may be available through other vendors, only BMC is suited to provide the level of required consulting and training at the appropriate time in synchronizing with the build, deployment, and operation requirement of GTC B2E. Additionally, the consulting and training are not considered separate requirements. Splitting the training portion would create an undue administrative hardship, unnecessary duplication of resources, and would adversely impact the mission as outside trainers would not have critical knowledge related to specific integration to impart to trainees, and synchronization flexibility would be severely impaired.
8. Procurement History:
Previous Purchase Order(s) or Contract(s): Yes No
If "Yes", for each purchase order or contract provide:
Purchase order or contract number: W91QUZ-07-A-0006-E115 Was action competed? Yes No If action was not competed, state the cited authority, summarize rationale, and describe the actions that were supposed to be taken to increase competition and the results thereof:
The prior contract utilized the same authority as this procurement (FAR 8.405-6 (A) (1) (i) (B)).
The level of consulting support is only provided by BMC Software, which is not available by third-party vendors. Additionally, GMC Software will not provide the operating system code to any other manufacturer.
