99. Q - In our review of the Statement of Work, it appears that A004 is missing from Exhibit A - Contract Data Requirements List (CDRLs). Please confirm that a new CDRL A004 Design Change Report (DIDDI-NDTI- 80809B) will be incorporated into Exhibit A and the subsequent CDRLs will be re-numbered as A005 through A028 to coincide with the Statement of Work. Also confirm that Section J will be adjusted accordingly.

99. A - Refer to Section J - Attachment A, Document Summary List and the revised CDRLs in Amendment 0002.

100. Q - CDRL A020 (A021 in the SOW) titled Configuration Management Plan

103. A - Yes, Refer to Section C and the revised CDRLs in Amendment 0002.

104. Q - Section C - Description and Specifications, page 4, paragraph 5 states that the use of Government test facilities is authorized at Contractor expense. Will you be providing information to identify the cost of those test facilities to ensure this is addressed within our proposal?

104. A - The COSPAS-SARSAT compliancy testing referred to in this paragraph pertains to the Phase II, production PRDs, and not to the initial award for the Phase I production representative PRDs. The contractor awarded the Phase II production contract will be required to obtain the COSPAS-SARSAT compliancy testing, as further explained in Section C, paragraph 4.3. The contractor may contact Fort Huachuca for projected costs. The expense to the contractor will be minimized since the contractor will be testing a device to be delivered under a Government contract, and not for commercial sale.

105. Q - Section I - Contract Clauses:

Since FAR 52.215-22 is included, should FAR 52.215-22 Limitations on Pass-Through charges— Identification of Subcontract Effort also be incorporated?

FAR 52.215-23 Limitations on Pass-through Charges - it is recommended that Alternate I be incorporated since there will be no excessive pass through charges

FAR 52.219-6 Notice of total Small Business Set-Aside – is it the Government’s intent to exclude large contractors from bidding? If not, it is recommended that this clause be removed since it does not apply for large businesses.

FAR 52.219-22 Small Disadvantaged Business Status – this clause has been removed and reserved per FAR; therefore, it should be removed

FAR 52.232-18 “Availability of Funds.” This clause specifies that funds are currently unavailable for this contract. Does this mean that the contract action will be initiated before the funds are available? If yes, will the Government retroactively reimburse the contractors expenditures incurred prior to contract award, if they are awarded a contract?

FAR 52.209-4 – it is recommended that Alternate II also be incorporated to ensure mutual protection FAR 52.222-20 – it is recommended that this clause be removed since FAR 52.222-4 is more applicable for large corporations with Government approved accounting systems and unions FAR 52.227-3 Patent Indemnity - Given that FAR clause 52.227-1 “Authorization and Consent” is already included in the RFP, will the Government remove FAR 52.227-3 Patent Indemnity (APR 1984) from this solicitation?

FAR 52.246-17 Warranty of Services of a Noncomplex Nature - There is a high cost associated with providing a warranty for all supplies furnished to be free from defects and to conform with all contractual requirements required by this clause. Given that high cost, will the Government remove this clause? If the clause will not be removed, please incorporate Alternate II in addition to the basic clause.

* Reason: The inspection and acceptance clauses in the solicitation protect the Government from patent and latent defects, including the Commercial Standard Warranty outlined in paragraph 6.5 on page 11 of the RFP, which requires a warranty of not less than 12 months.

105. A - 52.215-22 – Section L – Clause is NOT applicable as 52.215-23 is not applicable.

52.215-23 – Section I – Clause is NOT applicable as proposed contract is a Firm Fixed Price contract awarded on the basis of adequate price competition (FAR 15.408(n)(2)(B)(2)(i)). Clause will be deleted via Amendment 0003.

52.219-6 – Section I - Subject RFP is NOT a total small business set aside. Clause will be deleted via Amendment 0003.

52.219-22 – Section K – Clause is not currently part of the RFP.

52.232-18 – Section I - The term “contract action” refers to the solicitation and not the award. Award will not be made without funding. The Government will not retroactively reimburse contractors for expenditures.

52.209-4 – Section I - Alternate II will NOT be incorporated into the RFP/contract. The Government will not authorize contractor to purchase material or to commence production before first article approval.

52.222.20 – Section I – No exemptions to the clause found in FAR 22.604.

52.227-3 – Section I – No exemptions to the clause found in FAR 27.201.

52.246-17 – Section I – At this time the Government is not removing the clause and Alternate II will not be incorporated.

106. Q - In Section M of the Solicitation under Factor III Sub-Factor B, reference is made to AFARS Appendix DD-301. It is recommended that AFAR Appendix DD–301 (1) and 301 (2) be removed as a required element of the SB Subcontracting Plan since P.L. 99-661 Section 1207 (codified at 10 U.S.C. 2323) was found to be unconstitutional in “Rothe Dev. Corp. v. DoD”, and expired in 2009. In addition, since the implementing regulation for P.L. 99-661 Section 1207 (10 U.S.C 2323) and essentially P.L. 100-180 are no longer in effect, therefore we recommend that these requirements also be removed.

106. A - AFARS DD was revised in October of 2014. The Army considers its structure compliant with all applicable law and regulation.

107. Q - We have searched the internet and have been unable to locate the following documents reflected within the solicitation. Please provide copies of these documents to all bidders:
