52.212-1 ADDENDUM

52.212-1 - INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS (AUG 2018) *ADDENDUM*

A. GENERAL INSTRUCTIONS

(1) This is a competitive Request for Proposals (RFP). It is the United States Government’s (USG) intent to competitively award one FFP contract as a result of this solicitation. The USG reserves the right to make no award if it is in the best interests of the USG.

(2) It is the USG's intent to competitively award one FFP contract without discussions (except clarifications if necessary as described in FAR Part 15.306(a), Clarifications and award without discussions). Therefore, the Offeror’s proposal shall represent the Offeror’s best terms offer. The USG reserves the right to conduct discussions if the KO determines discussions are necessary. In the event that discussions are held, a competitive range determination will be made. If the KO determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the KO may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(3) Award will be made on the basis of Lowest Price Technically Acceptable (LPTA) proposal. To ensure timely and equitable evaluation of proposals, Offeror(s) shall follow the instructions contained in the solicitation to be considered responsive. Proposals must be complete, and respond to all requirements of the solicitation. Offeror(s) shall assume that the USG has no prior knowledge of their experience, and will base its evaluation on the information presented in the Offeror’s proposal.

B. PROPOSAL PREPARATION AND SUBMISSION INSTRUCTIONS

(1) ONLY ELECTRONIC PROPOSALS WILL BE ACCEPTED. All proposals must be received by the contracting office no later than the offer due date and time listed in block 8 of the SF 1449. (2) "IAW FAR Part 15.208(a), "Offerors are responsible for submitting proposals, any revisions and/or modifications, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.” Due to the austere environment of Afghanistan, Offerors should anticipate delays in the delivery of electronic proposals. Offerors are encouraged to request “Delivery and Read Receipts,” to confirm delivery.

(3) An offer received, in the office designated in the request for proposals, after the exact date specified for receipt of initial and final proposals may not be considered eligible for award.

(4) Solicitation Questions. Offerors may email questions regarding this solicitation to Brenda Simmons, Contract Specialist at brenda.n.simmons.ctr@mail.mil with a courtesy copy to Elizabeth Zaharapoulos, Contracting Officer at elizabeth.w.zaharopoulos.civ@mail.mil and SSG Jason Rinehart at jason.s.rinehart.mil@mail.mil. The email shall be submitted with the subject line as W91B4N-19-R-0006–Questions. Questions/inquiries are due no later 12:00 pm local Afghanistan Time, 30 June 2019. All reasonable questions received before the question due date will be answered via a solicitation amendment. Answers shall be posted without Offeror identification. Questions received after the deadline may not be answered. The USG will not provide responses to questions that would reveal a potential Offeror’s confidential business strategy, technical solution, or any information that is considered unique to a particular Offeror.

52.212-2 ADDENDUM

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) **ADDENDUM**

A. Basis for Award. This acquisition will utilize LPTA procedures and make an award in accordance with FAR Part 15.101-2. The USG will select the proposal with the lowest Total Evaluated Price (TEP) from among those offers meeting the acceptability standards for non-price factors. A contract may be awarded to the Offeror who is deemed responsible in accordance with FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation requirements (to include all stated terms, conditions, representations, certifications, and all other information required in this solicitation) and is judged, based on the evaluation factors and sub-factors to represent the LPTA proposal. Trade-offs between price and non-price factors is not permitted.

B. Evaluation Process. Timely proposals will be reviewed for compliance with the solicitation. Offerors shall comply with Addendum to FAR Clause 52.212-1 (General Instructions, Proposal Preparation and Submission Instructions). If the proposal is not compliant to the solicitation, it will not be evaluated and the Offeror will be notified that the proposal is non-compliant.

C. Evaluation Criteria. Evaluation criteria consist of price and non-price factors. The USG technical evaluation team will evaluate the non-price factors on an Acceptable/Unacceptable basis. An Offeror must be considered acceptable under all non-price Factors and sub-factors to be deemed eligible for award. Therefore, a proposal rated Unacceptable for any non-price Factor, or Sub-factor, will not be considered for award.

VOLUME I - PRICE

FACTOR 1: Price.

(1) Adequate price competition is anticipated, therefore only price information is requested at this time;

however, the USG reserves the right to request cost and pricing data in the event price reasonableness cannot be determined based on adequate price competition. The proposed price will be evaluated for price reasonableness and unbalanced pricing.

(2) Price Reasonableness will be evaluated in accordance with FAR 15.4 utilizing the price analysis techniques in FAR 15.404-1(b) that are deemed appropriate based on the TEP.

(3) The TEP for award purposes will be the aggregate of all FFP CLINs. The TEP excludes the cost reimbursable CLINs for Defense Base Act (DBA) insurance. As part of the TEP Price, the USG will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Offeror’s final option period price to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, all options and ½ of the last option period. Offerors are not required to enter a price for the six-month period.

(4) Unbalanced Pricing: Unbalanced Pricing between option years will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high or low prices during performance.

VOLUME II – TECHNICAL CAPABILITY

FACTOR 2: Technical Capability. The Technical evaluation provides an assessment of the Offeror’s capability to satisfy the USG’s minimum requirements. The evaluation will determine if the Offeror adequately provides an understanding of the functional areas with associated technical expertise with its management, technical and staffing plan. The Offeror’s proposal must be acceptable in all Sub-factors to be determined acceptable for Factor 2.

Sub-factor 1: Management Approach. The USG will evaluate the offeror’s capability to provide a comprehensive management approach to monitor and manage a workforce capable of accomplishing all requirements outlined in the PWS. To be acceptable, the standard is met when the Offeror demonstrates at a minimum the following:

(1) The proposed organizational structure provides adequate oversight for all functional areas; delineate lines of management authority, supervision, span of control, and accountability for all tasks.

(2) The proposal identifies individual authorities and decision making authority within the organization that is at a level that is practical for efficient operations.

(3) If applicable, the proposal includes a realistic and feasible process for integration of teaming partners into the overall organization.

(4) The proposal identifies a realistic and feasible plan to timely reprioritize work and adapt to fluctuating work priorities as dictated by ASG-A.

Sub-factor 2: Recruitment & Retention Plan. The USG will evaluate the adequacy and feasibility of the Offeror’s proposed approach to recruiting and retain qualified personnel. To be acceptable, the standard is met when the Offeror demonstrates at a minimum the following:

• The Offeror’s Recruitment and Retention Plan delineates a realistic and feasible approach with processes in place for hiring and retaining qualified employees as identified in the PWS for the duration of the contract.

Sub-factor 3: Technical Approach. The USG will evaluate the adequacy and feasibility of the Offeror’s Technical approach. To be acceptable, the standard is met when the Offeror demonstrates at a minimum the following:

(1) The Offeror provides a technical approach that clearly demonstrates the Offeror’s understanding of the technical requirements and describes how the proposed personnel will be able to successfully perform the requirements of the PWS.

Ratings. The Technical Factors and sub-factors will receive one of the adjectival ratings defined below in Table 1.

The Sub-factor ratings will be used to determine an overall rating for factor 2.

Table 1. Technical Acceptable/Unacceptable Ratings Adjectival Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

VOLUME III – PAST PERFORMANCE

FACTOR 3 – Past Performance. The Past Performance evaluation will access the offeror‘s probability of meeting the solicitation’s requirement’s as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror’s proposal and data obtain from other sources, such as Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; and may be obtained from other sources available to the USG, such as the Defense Contract Management Agency; and interviews with Program Managers, and Contracting Officers. Past Performance areas of evaluation include:

Business Relations Quality of Service Schedule Customer Satisfaction

a) Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past three years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

b) Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity.

The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services being procured under this solicitation.

A relevancy determination of the offeror’s (including joint venture partners(s) and major and critical subcontractor(s)) past performance will be made. IN determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The past performance information provided in the proposal and obtained from other sources will be used to establish the relevancy of past performance.

c) The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to performance confidence assessment.

d) Assigning Ratings. The Past Performance factor will be assigned one of the ratings defined below.

Table 1. Past Performance Ratings Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
