These parts are necessary to assemble a previously purchased LAMS (Large Area Maintenance Shelters) tent. The delivery timeframe is four to six weeks and the estimated value of this action is $83,118.

4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

The U.S. Government (USG) previously purchased two LAMS tents with the required parts from Clamshell Structures in summer 2018. However, the parts went missing after being in storage at Bagram Air Field while in the control of the USG. The Clamshell Structures LAMS tents are designed to be compatible with the distinct parts being ordered as part of this purchase. Only Clamshell Structures’ parts are compatible with the previously purchased Clamshell Structures LAMS tents. If the USG does not purchase these particular parts from Clamshell Structures, the USG will not be able to assemble a tent valued at $350,000.

These items will complete the second LAMS tent. The tent will be used to perform aviation maintenance in support of aircraft expansion at Camp Dwyer, Afghanistan. If these parts are not ordered there will be significant impacts to aviation maintenance at Camp Dwyer. The lack of maintenance bay capacity limits the number of rotary wing operations performed within the southern region of the CJOA-A. This limitation has the potential to cause unnecessary risk to life and limb as required maintenance is deferred due to lack of required space.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed.

7. Market Research: Market research was completed by the Contracting Officer on May 21 and 22, 2019. The Contracting Officer performed an internet search of LAMS tents, and clamshell structures and found several sources: Creative Tent International, Guard-All, Allsite, Creative Tent, Big Top Shelters, Sprung, and Clamshell Structures to name a few. However, each manufacturer designs its structures to be compatible with its own proprietary parts. LAMS tents are marketed to the military and in the commercial marketplace alike across the world.

8. Other Facts: The LAMS tents were previously purchased in 2018 from Clamshell Structures.

9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
