Section SF 1449 - CONTINUATION SHEET

INSTALLATION ACCESS

5152.225-5916

MANDATORY ELIGIBILITY FOR INSTALLATION ACCESS

(OCT 2015)

(a) U.S. and Coalition Commanders possess inherent authority to maintain law and order, provide security, and impose discipline necessary to protect the inhabitants of U.S. and/or Coalition installations, U.S. and Coalition personnel operating outside of installations, and U.S. or Coalition-funded developmental projects in Afghanistan.

This authority allows commanders to administratively and physically control access to installations and/or project sites, and to bar contractors – including prime contractors, subcontractors at any tier, and any employees, from an installation or site. A commander’s inherent force protection (FP) authority is independent of an agency’s contracting authority, and it may not be superseded by any contractual term or provision.

(b) The prime Contractor/Vendor acknowledges that: submission of a bid, offer, or a proposal; acceptance of contract award of any type; or continuing effort under any contract that includes this clause; requires that the prime

Contractor/Vendor, and all subcontractors under any affected contracts be initially eligible -- and remain eligible during the entire period of contract performance to include any warranty period -- for installation access to a U.S.

and/or Coalition installation, regardless of whether the performance will take place on or off a U.S. or Coalition installation.

(c) To be eligible for installation access, Contractors and subcontractors at all tiers are required to register for installation access in the Joint Contingency Contracting System (JCCS) and are responsible for keeping the information in this system updated at all times. Prime Contractors and subcontractors at any tier may verify their registration at https://www.jccs.gov/jccscoe/ by selecting the “Vendors Login” module and logging in with their user name and password. The offeror must be registered, approved, and eligible for installation access prior to award, and remain eligible for installation access for the life of the contract.

(1) The offeror is required to submit a listing of all proposed subcontractors, at all tiers, to the contracting officer with the submission of the proposal, and provide updates during the life of the contract when subcontractors are added or removed. If no subcontractors are expected to perform during the life of the contract, the offeror must submit a negative response to the Contracting Officer with its proposal. After award, the prime contractor must submit a negative response to the contracting officer at the beginning of each performance period.

(2) Failure to be approved in JCCS -- and thereby be eligible for installation access at the prime and subcontractor levels -- or failure to inform the contracting officer of the names of all prospective subcontractors (or provide a negative reply), may render the offeror/contractor ineligible for award or continued performance.

Additionally, any firm that is declared ineligible for installation access will be deemed non-responsible until such time as that firm is again deemed eligible by the appropriate access approval authority.

(d) Installation access determinations arise from the Combatant Commander’s inherent authority and are separate and distinct from any law, regulation, or policy regarding suspension and debarment authority. Contractor queries or requests for reconsideration related to U.S. or Coalition installation base access eligibility must be directed to the authority responsible for base access decisions.

52.212-1 INSTRUCTION TO OFFERS

ADDENDUM TO 52.212-1

ADDENDUM INSTRUCTIONS TO OFFERORS—Commercial Items (OCT 2018)

QUOTES SHALL BE VALID FOR 90 DAYS

1. GENERAL. This procurement will be awarded as a Lowest Price Technically Acceptable contract. The quote will be evaluated in accordance with FAR 13.106-2(b). The quoter will provide a quote for the items with same salient characteristics described in CLIN’s 0001, 0002 and 0003.

a. The Government intends to award a Purchase Order without discussions with Quoters (except for clarifications as described in FAR 15.306(a)). Therefore, the initial quote should contain the Quoters best terms from a price standpoint. Quoters should not assume that they will be afforded the opportunity to clarify, discuss, or revise their quote. However, the Government reserves the right to request clarifications or enter discussions if determined by the

Contracting Officer to be necessary. The Government may reject any or all responses if not in accordance with the

Federal Acquisition Regulation.

b. The Government reserves the right to cancel this solicitation and make no award. By responding to this request for quote and submitting a quote per FAR 13, the Contractor understands that the Government shall not be liable for any costs incurred by the Quoter in response to this request for quote.

mailto:tracey.l.howard8.civ@mail.mil

2. QUOTE SUBMISSION. All Quotes shall be in the form prescribed by this solicitation and shall contain a response to each of the areas identified below in paragraph 4. All responses shall be in English, legible and prepared in the following general format to be properly evaluated. Responses must be complete, self-sufficient, and respond directly to the requirements of this Request for Quote (RFQ).

a. Electronic submission. The Quoter shall provide a copy of its quotation as an electronic file. By submission of a quote on electronic media, the Quoter shall ensure that the submission is readable, in the format specified in the solicitation. The quote shall be emailed to Ryan Hoover, Contract Specialist at ryan.d.hoover.mil@mail.mil with a courtesy copy to Tracey L.

Howard, Contracting Officer at tracey.l.howard8.civ@mail.mil before 10 September 2019 at

1:00 pm local Afghanistan time as identified in Block 8.

b. To be eligible and responsive for award, prime and all subcontractors must be registered at the time the quote is submitted and approved at time of award in Joint Contingency Contracting

System (JCCS). U.S. companies must also be registered and approved in JCCS and System for

Award Management (SAM) by the award date. In addition, all subcontractors at all tiers who will be contracted by the prime during the life of the contract shall also be registered and approved in

JCCS and SAM by the award date. The contractor is required to submit a listing of all proposed subcontractors, at all tiers, to the contracting officer by the quotation date. If no subcontractors are expected to perform during the life of the contract, the prime must submit a negative response to the contracting officer before the award date. Failure to be registered in JCSS and SAM at the prime and subcontractor levels and failure to inform the contracting officer of the names of all subcontractors (or provide a negative reply) may deem the Quoter non-responsive and ineligible for award.

A "subcontractor" means any supplier, distributor, vendor, or firm (company) that furnishes supplies or services to or for a prime contractor or for another subcontractor.

3. Questions/Amendments/Exceptions.

a. Solicitation Questions. Quoters may email questions regarding this solicitation to Ryan Hoover, Contract

Specialist at ryan.d.hoover.mil@mail.mil with a courtesy copy to Tracey L. Howard, Contracting Officer at tracey.l.howard8.civ@mail.mil. The Government will answer all questions received by 6 September 2019 at 1:00 pm local Afghanistan time. All e-mailed questions shall be submitted with the subject line as W91B4N-19-Q-

0002 -Questions. The Government reserves the right not to respond to any questions received concerning this solicitation after the Solicitation Questions receipt date and time above. Accordingly, Quoters are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the solicitation process. Government responses to questions will be provided to all Quoters.

b. Amendment. The Government reserves the right to revise or amend the specification prior to and/or after the date set for receipt of quotations as necessary. Such revisions, if any, will be announced by an amendment(s) to this RFQ.

All information related to this RFQ, including pertinent changes/amendments and information prior to the date set for receipt of quotation, will be emailed to the companies listed in the solicitation. When an amendment is released by the Government that makes changes that affect the statement of work the contractor will be provided the opportunity to resubmit their proposals.

c. Exceptions. If the Quoter takes exception to any of the requirements specified in this solicitation, the Quoter shall clearly identify each exception and include a complete explanation of why the exception was taken and what benefit it provides to the Government. All exceptions to the solicitation requirements and supporting rationale shall be included in an addendum to the quotation clearly labeled "Exceptions Addendum."

An addendum is only required if the Quoter takes exception to any requirement in the solicitation. The Exceptions

Addendum does not have a page limitation, but shall only include information relevant to exceptions taken to the solicitation requirements. The Government will assume the Quoter takes no exceptions to any solicitation requirement if the Quoter does not submit an Exceptions Addendum identifying exceptions. Quoters are advised that mailto:ryan.d.hoover.mil@mail.mil mailto:tracey.l.howard8.civ@mail.mil mailto:ryan.d.hoover.mil@mail.mil solicitation requirements are not necessarily negotiable and such exceptions may render a Quoter's quote unacceptable and ineligible for award.

4. FORMAT AND CONTENT OF QUOTATION. Each quotation shall be submitted as set forth below and all information shall be confined to the appropriate part to facilitate independent evaluation. Quotations which do not include the requested minimum information, will be deemed non-responsive to the solicitation and will be eliminated from further consideration for award at the Government’s discretion. Quotation sections shall be labeled by section (i.e., Volume I - Price).

Volume I - Price. Information and required documents. Quoter shall provide all price information necessary to provide a meaningful basis for Government's analysis and evaluation of price for the project set forth in Section B of this solicitation. Prices shall include all related costs, (i.e., labor, wages, transportation, etc...), if applicable. The

Basis of Award. This acquisition will utilize Lowest Priced Technically Acceptable (LPTA) procedures and make an award IAW FAR 13.106. A decision on the technical acceptability of each quoter’s quotation will be made. For those quoter’s which are determined to be technically acceptable, award will be made to that vendor with the lowest

Total Evaluated Price (TEP). Trade-offs between price and non-price factors is not permitted.

Evaluation Process. The Government’s evaluation process consists of two factors: 1)Technical compatibility with the items and their salient characteristics listed at CLIN 0001, CLIN 0002, CLIN 0003 and 2) Price. Technical quotes will be evaluated on an Acceptable/Unacceptable basis. A quoter must be considered acceptable under all non-price Factors to be deemed Technically Acceptable. Therefore, a quote rated unacceptable for any non-price

Factor will not be considered for award. Quoted prices will be evaluated for reasonableness using price analysis techniques in accordance with FAR 13.106-3(a).

Evaluation Criteria. The quotes will be evaluated based on the following factors:

Factor 1 – Technical Capability

Factor 2 – Price

Factor 1 – Technical Capability – The Government will evaluate the quoter’s technical quote to assess the quoter’s understanding of the technical requirements to provide an item with the same salient characteristics as listed in

CLIN 0001, CLIN 0002, CLIN 0003. To be acceptable, the standard is met when the quoter demonstrates at a minimum the following:
