2. Price

3. Past Performance

FACTOR 1: TECHNICAL CAPABILITY. The technical proposal shall define the policies and procedures for the overall management and execution of the requirements of the contract to ensure quality, efficiency, and timeliness.

The technical proposal should be practical and be prepared simply and economically, providing straightforward, concise delineation of what the offeror will do to satisfy the requirements of the contract. The technical volume shall provide evidence that you recognize the scope of work that you will be required to provide under the proposed contract by providing the following information:

(1) SUB-FACTOR 1 – Job Experience/ Education: Quoter shall describe the one year of paralegal or legal assistant experience and familiarity with U.S. Criminal Law, preferably with International Humanitarian Law or Human Rights Law, for work to be performed or shall provide International Relations, Arts, Humanities, or Political Science Bachelor's Degree or Paralegal certificate. The Government’s will evaluate the quotes for acceptability, assigning one of the ratings described below for each sub-factor. To be "Acceptable" under Factor 1, a quote must be evaluated as "Acceptable" for all sub-factors in Factor 1. Any sub-factor evaluated as “Unacceptable” will render the Factor 1 "Unacceptable."

TECHNICAL RATINGS

Rating Description Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

FACTOR 2: PRICE. Price will not be scored or rated. All CLIN pricing must be complete and accurate.

Furthermore, prices will be assessed IAW FAR 13.106-3 for fair and reasonableness. The list of materials and their associated costs may also be used to determine price fair and reasonableness of quoted items and services. The Government reserves the right to require the submission of Other Than Certified Cost or Pricing Data as is deemed necessary to arrive at a fair and reasonable price. Offerors are advised that the Option to Extend Services Clause at FAR 52.217-8 is included in this solicitation and will be included in the awarded contract. During the evaluation of offers, the Option to Extend Services (FAR 52.217-8) will be evaluated in accordance with FAR 52.217-5 provision.

FACTOR 3: PAST PERFORMANCE. The past performance evaluation will assess the quoter’s probability of meeting the solicitation’s requirements as indicated by that quoter’s record of past performance. Past performance is assessed at the factor level after evaluating aspects of the quoter’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. The offeror shall provide a narrative summary describing recent (within three years), and relevant experiences in order to substantiate past performance and ability to perform the requirements of the PWS. The following information should be provided in addition to the summary: contract number, dollar value, geographic location(s), point of contact name; telephone number, email address, and capabilities statement to include the list of equipment.

(1) Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. Past performance information that fails this condition will not be evaluated.

(2) Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services being procured under this solicitation. A relevancy determination of the quoter’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the quoter, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to what aspects of a quoter’s contract history would give the most confidence that the quoter will satisfy the current procurement. The past performance information provided in the quotation and obtained from other sources will be used to establish the relevancy of past performance.

(3) Ratings. Past Performance will be assigned one of the confidence ratings defined below.

Performance Confidence Assessments

Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
