ORDERING PROCEDURES

Ordering Procedures

1. Individual Delivery Orders (DO) will be competed to give Fair Opportunity to all Awardees. DO will be awarded through a Request For Delivery Order Proposal (RFDOP) process and award will be based at a minimium, the Total Evaluated Price (TEP) of a Corps Region or CLIN and an Offerors performance under this contract.

2. A DO will be awarded for all fuel quantities and locations based on the evaluation factors stated within the

RFDOP.

3. Each RFDOP issued under the Basic Contract will typically be for a 90–day to 180-day period. This will be based on Government requirements, and stated within the RFDOP. The locations will be identified within the Microsoft Excel Spreadsheet included with each RFDOP.

4. Multiple awards may be made off of each RFDOP to the responsible and responsive contractor that offers the lowest price per region, who has satisfactory performance under this contract and who meets all the other evaluation criteria.

a. The RFDOP will specify the relative importance of price and past performance. As mission requirements change, one factor may become more important than the other, though the RFDOP will specify the Government's intent for each DO.

b. Past Performance under this IDIQ will be evaluated in accordance with Section 6.0 – Performance Evaluation. The resulting evaluations will be used, by the Contracting Officer to rate a Contractor’s past performance which will be used and taken into consideration during the RFDOP Source Selection.

5. The resultant DOs awarded under the Basic Contract will utilize “Not To Exceed” (NTE) quantities. The Government is only obligated to pay for the actual quantities delivered up to the NTE ceiling for each Contract Line Item Number (CLIN). Each CLIN will represent all fuel types for a given region where each CLIN represents all POL product to be supplied to a single MOD Corp Region.

6. The contractor may only bill for the fuel that was actually delivered. Any quantity of fuel remaining on any DO CLIN beyond the delivered amount and the NTE ceiling at the end of the delivery period specified within the DO shall be de-obligated from that DO. The contractor shall be responsive to all POL requirements estimated within the DO.

4.10.8 Delivery Quantification

4.8.1 The contractor shall use a calibrated fuel meter as the primary instrument to measure the amount of fuel delivered (in liters) for calculating the amount to be invoiced for deliveries, temperature-corrected to API standards (see 2.1.4).

4.10.8.2 If an MOD-provided fuel meter is not available for any reason, the stick-and-gauge tank gauging method IAW the current version of the API Manual of Petroleum Measurement Standards (MPMS) shall be used. Before off-loading operations begin, contractor personnel shall ensure the receiving tank has sufficient available volume to receive the product. If using the stick-and-gauge method, the receiving tank shall be gauged before and after fuel transfer to determine amount received. The vendor shall remain onsite until the fuel officer or attendant, in the presence of the contract vendor, and after waiting for a period of no less than 30 minutes, has gauged the uploaded tank(s). The purpose of the waiting period is to allow the fuel to settle (gravity and expansion). The receiving activity will use the Delivery Ticket to document quantity and gauge readings before and after receipt of fuel in the receiving tank.

4.10.8.3 Prior to offloading the fuel, a sample shall be taken and jointly inspected between vendor and customer, a visual test shall be taken and jointly inspected. Fuel must be free of particles and clear of water. If fuel does not meet specifications or cleanliness, the fuel will be rejected and the MOD delivery representative will annotate on the back of the delivery ticket stating the reason for rejection.

The contractor shall provide propane tank marking, inspection and certification for all tanks as specified by US Department of Transportation (US DOT) and American Society of Mechanical Engineers (ASME). (Note: Check int’l or Afghan specs for propane tanks)

4.10.9 Petroleum Deliveries

4.10.9.1 The contractor shall deliver petroleum products only to storage tanks specifically designed for fuel storage. Quantity delivered shall be measured by the receiving activity’s fuel meter and temperature corrected to 60°F/15 °C in accordance with the current version of the American Petroleum Institute (API) Manual of Petroleum Measurement Standards, Chapter 11, Section 1.

4.10.9.2 If using the stick and gauge method, the receiving tank shall be gauged before and after receipt to determine amount received. The fuel officer or attendant, in the presence of the contract vendor, shall wait for a period of no less than 30 minutes to gauge an uploaded tank. The purpose of waiting is to give the fuel a chance to settle (gravity and expansion). If the fuel is gauged immediately after upload, it shall cause an inaccurate reading. The MOD member shall document quantity and gauge readings before and after receipt of fuel. If fuel does not meet specifications or cleanliness IAW SOW Section 4.10.9.3 the fuel will be rejected and the Contractor shall re-deliver conforming fuel within 24 hours.

4.11 SAMPLING AND TESTING

4.11.1 Sampling. The Contractor shall take samples in accordance with the procedures for sampling additives, blend tanks, shipping tanks, lines, and conveyances/containers dictated in the API Manual of Petroleum Measurement Standards (MPMS), Chapter 8, Section 1, (ASTM D 4057) Manual Sampling of Petroleum and Petroleum Products, and/or Section 2, (ASTM D 4177) Automatic Sampling of Liquid Petroleum and Petroleum Products. Procedures include sample location, frequency, quantity, and retention. For all tanker, barge, and pipeline shipments, a flow-proportional sample taken in accordance with MPMS Chapter 8, Section 2, is preferred at the custody transfer point. However, manual samples taken in accordance with MPMS Chapter 8, Section 1 are acceptable provided that they are taken hourly throughout the shipment.

4.11.3 Laboratory Testing. The contractor shall perform all inspections and acceptance tests required by the specifications of the supplies to be furnished under this contract or, shall have such tests performed, in a laboratory deemed acceptable by the U.S. Government. The contractor shall provide the U.S.

Government, prior to the first shipment, with the name and location of the laboratory to be used for testing at each discharge point.
