AMENDMENT 4
Below are responses to RFIs, narrative changes to the specifications in response to RFI's and attached are compiled permit packages (PDF of all three permits/letters).
The Order of Conditions referenced in the response to RFI #6 on Amendment 2 issued on 10/04/2017 is also attached in the PDF permit package.
RFI
7. The plans state that no construction materials, equipment or vehicles shall be allowed within 30 feet of the landward side of the seawall at any time, except within the temporary storage and staging area. If the contractor uses protective measures and accepts responsibility for any and all damage incurred, can the contractor use equipment on the landward side of the seawall to place stone or any other material onto the beach side of the seawall (other than in the temporary staging and storage area)?
Response: No, the statement on the contract drawings will remain a requirement. Pedestrian traffic control measures are the only exception.
8. Please confirm that the area outside the limit of excavation is available for stockpiling the native beach material during the construction of revetment, prior to it being re-distributed as mentioned in Amendment 001 – RFI Question #2?
Response: Yes, native beach material may be stored anywhere between the seawall and the seaward project limits shown on the contract drawings.
9. The large excess quantity of native material that will be generated by excavation is far more than can be loosely distributed within the limits provided per the response to RFI #2, Amendment 001, while maintaining a natural slope. Is it the intent that the material will be dispersed onsite, even if the high quantity dictates it will extend beyond the “limit of excavation” delineation, further onto the beach? If not, please provide a disposal location for the excess material.
Response: The intent is that the majority of excess native material not used as backfill is to be placed over the length of the revetment structure between the revetment crest and the limits of excavation to minimize sand loss from the beach. Any native material beyond that which can reasonably and safety placed in this manner may extend beyond the limits of excavation, subject to approval by the COR.
10. Please confirm CLIN 3 only pertains to the 350 lb underlayer stone and the cost of the crushed stone and cobble should be included in lump sum CLIN 1. It is confusing because Spec section 01 22 00 para 1.3.C. states in part “The contractor shall weigh each load of crushed stone, underlayer stone and armor stone brought to the site……..”. The term “crushed stone”, I assume is referring to the ¾” crushed stone and cobble layers. Why would the C.O. be concerned about certified weight slips for the crushed stone if it is included in a lump sum item?
Response: Yes, CLIN 3 only pertains to the furnishing and installation of the 350 lb Underlayer Stone. See narrative changes below for spec section 01 22 00, 1.3.C.
11. The 1442 allows 150 days for the contract performance period. However, spec section 01 11 00 states that “Work at the project site will only be permitted from 16 October 2017 through 25 May 2018 inclusive.” Is it the intent for the contractor to complete the project within 150 days from NTP or is it the intent to grant a performance period from NTP to May 25, 2018?
Response: The intent is for the contractor to complete the project within 150 days of the Notice to Proceed (NTP) issuance date. The date range of 16 October 2017 to 25 May 2018 is the allowable work window provided by the town.
12. In reference to Amendment #2, does the government expect to issue the Order of Conditions prior to the bid date of this project or will they be issued as a mod to the successful bidder?
Response: See narrative changes below for spec section 01 57 20.
1.1 NARRATIVE CHANGES TO SPECIFICATIONS
1. Section 01 22 00 MEASUREMENT AND PAYMENT, Subpart 1.3 BIDDING SCHEDULE - PAYMENT ITEMS, under Parts "b." and "c.", in the second paragraph, third sentence; delete "of crushed stone," in its entirety.
2. Section 01 57 20 ENVIRONMENTAL PROTECTION, Subpart 3.1 ENVIRONMENTAL PERMITS AND COMMITMENTS, in the first paragraph, first sentence; add the following after "received"; "a Chapter 91 Waterways License,".
3. Section 01 57 20 ENVIRONMENTAL PROTECTION, Subpart 3.1 ENVIRONMENTAL PERMITS AND COMMITMENTS; attach the following permits, referenced in Subpart
3.1 ENVIRONMENTAL PERMITS AND COMMITMENTS, to the end of this section.
Copies of the permits are attached to this amendment.

END OF AMENDMENT 0004
(End of Summary of Changes)

John R. Kennelly Department of the Army US Army Corps of Engineers (USACE) New England District 696 Virginia Road Concord, MA 01742-2751
Re: CZM Federal Consistency Review of the USACE Nantasket Beach Coastal Storm Damage Reduction Project; Hull.
Dear Mr. Kennelly:
The Massachusetts Office of Coastal Zone Management (CZM) has completed its review of the proposed project to construct 1,930 feet of stone revetment along the 2,200-foot long midsection of the seawall located in the Massachusetts Department of Conservation and Recreation’s Nantasket Beach Reservation in Hull.
Based upon our review of applicable information, we concur with your certification and find that the activity as proposed is consistent with the CZM enforceable program policies.
If the above-referenced project is modified in any manner, including any changes resulting from permit, license or certification revisions, including those ensuing from an appeal, or the project is noted to be having effects on coastal resources or uses that are different than originally proposed, it is incumbent upon the proponent to notify CZM, submit an explanation of the nature of the change pursuant to 15 CFR 930, and submit any modified state permits, licenses, or certifications.
CZM will use this information to determine if further federal consistency review is required.
Thank you for your cooperation with CZM.
Sincerely, Bruce K. Carlisle, Director
