Questions & Answers
As of 1 February 2022
Q1: Can the government please clarify if offerors shall provide their own pricing sheet and a completed 1449? There is no pricing sheet included in the solicitation documents.
A1: W912TF22Q0015 is released is a combined synopsis/solicitation (aka COMBO). Accordingly, use of the SF 1449 is prohibited IAW FAR 12.603(b). See 52.212-1 for guidance in responding to this RFQ. For interested parties who wish to submit an SF1449 in their response, a fillable PDF version may be downloaded at https://www.gsa.gov/forms-library/solicitationcontractordercommercial-items
The Government intends for interested parties to have as wide discretion as possible in submitting their offers for evaluation provided that CLINS are broken out appropriately and they provide pricing for the full performance period described.
Accordingly, the provisions and clauses are updated to provide a more complete description of 52.212- 1 that is intended to provide more clarity.
Q2: The FAR Clause 52.222-41(SCA) and 52.222-62 (Paid Sick Leave) were included in the solicitation and a Wage determination was provided. Please clarify if the HCWs are to be SCA employees?
A2: Contracting officers are required to insert 52.222-41 whenever a service contract exceeds $2,500 and none of the exemptions in FAR 22.1003-3 apply. Whenever 52.222-41 gets inserted, Contracting Officers are also required to insert 52.222-62 IAW FAR 22.2110. Finally, the Contracting Officer must obtain applicable wage determinations whenever a service contract, described above, meets or exceeds the $2,500 threshold IAW FAR 22.1007(a). This applies regardless of the labor required in the PWS
Contracting officers shall insert 52.222-41 in solicitations and contracts whenever the service contract action applies and/or the total contract value is estimated to be $2,500 or above. The mere fact a service contract meets the $2,500, and is not otherwise subject to the exemptions in FAR 22.1003-3, means that the contract is subject to the SCA and 52.222-41 applies. In addition, Contracting Officers must also include 52.222-62 whenever 52.222-41 is also included as required by FAR 22.2110. Finally, the $2,500 threshold also requires Contracting Officers to obtain wage determinations IAW FAR 22.1007(a).
