About this file

This file is an industry day presentation for the Fort Carson Equipment Concentration Site (ECS) project, delivered by the U.S. Army Corps of Engineers Louisville District on October 6, 2026.

The project involves construction of a general-purpose warehouse with area maintenance support activity at Fort Carson, utilizing Construction Management at Risk (CM@Risk) procurement under Other Transaction Authority (OTA) per 10 U.S.C. 2808a. The acquisition strategy employs a two-phase approach: Phase I covers pre-construction services, and Phase II covers full construction with bilateral modification. The government will issue a Request for Qualifications (RFQ) via SAM.Gov with an estimated advertisement period of 3-4 weeks, expected in mid-to-late October 2026. Qualification packages will be evaluated on Corporate Experience and Relevance, Technical Narrative, and Proof of Bonding Capability. The government will select up to three most qualified firms for individual 60-minute pitch presentations, after which the Agreements Officer will select a single most highly qualified firm for negotiations. Fair and reasonable pricing for Phase I must be determined prior to award. The acquisition is full and open competition with opportunities for small business subcontracting and mentor-protégé arrangements. Applicable laws include Buy American Act, Davis-Bacon, Miller Act, Fiscal Law, and Procurement Integrity Act. The presentation also discussed other future Army Reserve project opportunities including New Training Barracks at Fort Hunter-Liggett and various MILCON projects at Fort Carson totaling $70-100 million for FY27-28.

USACE PROCUREMENT PROCESS OVERVIEW

Chris Brackett Agreements Officer

Legal authority to enter into transactions other than standard contracts, grants, or cooperative agreements. Provides flexibility to adopt commercial industry standards and best practices.

OTAs are NOT subject to Federal Acquisition Regulation (FAR). This can attract non-traditional partners and encourages flexible, collaborative, and commercial arrangements.

Historically used for R&D/prototypes. New authority has expanded use for construction (10 U.S.C. §2808a).

OTAs are awarded by Agreements Officers (AOs).

Will have Administrative Agreements Officers (AAO) for Construction Administration support

What is other transaction authority?

CM@Risk w/OTA Overview CM@Risk with OTA allows for more flexibility/collaboration than traditional FAR-based acquisitions.

Streamlined and simplified selection processed – Qualifications based

Negotiated terms and conditions

Increased cost fidelity, early identification of risks, and Construction Manager input/involvement during design phase

Applicable Laws

Buy American Act (if otherwise would apply) Davis-Bacon (for construction) Miller Act (for construction) Prohibition against using cost-plus for military construction Fiscal Law (e.g. Purpose Statute at 31 USC 1301, Anti-deficiency Act, 31 USC 1341-1342, 1350-1351, The Recording Statute, 31 USC 1501(a)(9)) Tucker Act, 28 USC 1491 Procurement Integrity Act 41 USC 2101-2107 Other ethics laws and regulations Laws of general applicability that would apply to any entity doing business in the United States (e.g. environmental laws, inport/export control, criminal laws, civil rights, etc.)

Trade Secrets and Defend Trade Secrets Acts (18 USC Ch. 90 and 18 USC 1836)

FOIA

CM@Risk Process for Fort Carson ECS Competition will be full and open Small business subcontracting and/or mentor/protégé opportunities Request for Qualifications (RFQ) will be solicited publicly through www.SAM.Gov Qualifications packages will be submitted via the PIEE solicitation module

Agreement will be awarded in two phases:

Phase I Agreement (Pre-Construction Services) Phase II – Bilateral modification to agreement for Construction phase

Evaluation Process and Award Selection Step 1: Request for Statement of Qualifications Rapid, credentials-focused evaluation to identify a short list of highest qualified Construction Managers

Step 2: Pitch Presentations Up to three (3) firms will provide live pitch presentations to Government team.

Oral presentation demonstrating understanding of project requirements, CM@Risk and why they are most highly qualified firm.

Step 3: Negotiation with Most Highly Qualified Offeror Enter into negotiations with single, most highly qualified Offeror based on qualifications and pitch presentations. Fair and reasonable price for Phase I – Pre-construction services must be determined prior to award.

Request for Qualifications Interested firms will submit qualification package to demonstrate their qualifications and understanding of the project.

The district is considering the following evaluation factors:

Corporate Experience and Relevance Technical Narrative Proof of Bonding Capability

Advertisement Period: Estimated 3-4 weeks to prepare qualifications.

The Agreements Officer will determine which firms demonstrate the highest potential in their qualifications statement.

Approximately 3 of the most qualified firms will be invited to individual, confidential Pitch Meetings

Firms will have 60 minutes to deliver an oral presentation about why they are the best qualified firm to deliver the project.

After 60 minutes, a panel of government reviewers will ask questions about the qualification statement, presentation, and the firm’s capabilities.

The Pitch Meetings are intended to be conversational, rather than a strict Q&A session.

Pitch Presentations

The USACE acquisition team, led by the Agreements Officer, will meet to discuss the advantages and disadvantages of each firm.

The team may consider:

The firm’s proposal Pitch meeting discussions Other information within the government’s possession Any other publicly available information about the firms

• Agreements Officer will select one qualified firm to proceed to negotiations.

All other firms will be notified that they were not selected. However, non-selected firms may be asked to return for negotiations if the negotiations with the selected firm are unsuccessful.

Selection of Single/Highest Qualified Firm

USACE will provide a draft agreement to the selected firm.

Parties will meet to negotiate and finalize the terms of the agreement Negotiations may include the agreement articles, pricing, and other considerations.

Fair and reasonable price must be determined in order to award the Phase I Agreement.

If USACE and selected offeror cannot reach consensus on the agreement, USACE reserves the right to discontinue negotiations and take any action determined to be in the Government’s best interest, including entering negotiations with another firm, revising the acquisition approach, or canceling the RFQ.

Negotiations

If negotiations are successful, the Agreements Officer will award Phase I of the Agreement for Pre-Construction Services to the awardee.

Phase II – Full Construction will be incorporated as bilateral modification as design nears completion.

Award

Feedback

Please provide all feedback on CM@Risk process for Fort Carson ECS requirement by 09 October 2026.

All feedback, questions and/or concerns can be provided to Chris Brackett at Christopher.Brackett@usace.army.mil.

Formal RFQ should be issued in mid/late October.

Project: New Training Barracks Location: Ft Hunter-Liggett

The primary scope of work delivers four (4) CTE Barracks and one (1) IPIMT Barracks to restore modern housing capabilities to the installation. The four (4) CTE Barracks will each span approximately 46,000 square feet, utilizing open-bay configurations equipped with integrated officer sleeping rooms, team rooms, laundry facilities, restrooms, showers, storage, and janitorial closets.

Complementing these collective spaces, the single 45,000-square-foot IPIMT Barracks will provide individual sleeping quarters with private bathrooms, study/day rooms, laundry rooms, storage, and janitorial closets.

Also, part of this project is to completely demolish and dispose of the five existing legacy multi-story barracks that have exceeded their useful life. This comprehensive replacement directly resolves critical facility deficits, bringing Fort Hunter Liggett's training housing into full alignment with modern operational requirements.
