SECTION 00 22 18 – PROCEDURES

PROCEDURES FOR SUBMITTAL AND EVALUATION OF OFFERS FOR PHASE II

1. Overview

1.1 The intent of this solicitation is to select up to seven (7) contractors for a firm-fixed-price Multiple Award

Task Order Contract (MATOC) for primarily Design/Bid/Build (D/B/B) and Design/Build (D/B) Construction Activities for the Great Lakes and Ohio River Division Mission Boundaries.

1.2 This is a two-phase procurement. Following completion of the evaluation of Phase I, up to a maximum of ten (10) most highly qualified offerors will be selected to participate in Phase II. The selected offerors for Phase II will be invited to submit the information described in this Section 00 22 18, Procedures for Submittal and Evaluation of Offers for Phase II, for review and evaluation by the Government.

AMENDMENT 0009******

1.3 This sample project is for the Replacement of the Motor Control Center (MCC) Project at West Fork Lake, Hamilton County, Cincinnati, Ohio. The cost range is between $50,000 and $100,000.

AMENDMENT 0009******

1.4 The basis of award is the Best Value Trade-Off process. Following completion of the Phase II evaluation, the Contracting Officer will award a maximum of seven (7) firm-fixed-price Indefinite Delivery Indefinite (IDIQ) contracts to the responsible offerors whom the Source Selection Authority (SSA) determines conform to the solicitation, are fair and reasonable, and offer the best overall value to the Government, all factors considered. The Government reserves the right to accept other than the lowest priced offers or to reject all offers. For Phase II submittals, requirements stated in this RFP are minimums.

NOTE: The rating information from Phase I will not be considered in Phase II or in the final selection.

2. Submittal of Offers

2.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror’s technical information, and management capabilities necessary for successful completion of the project. For the Phase II submittals, requirements stated in this RFP are minimums. Innovative, creative or cost-saving proposals that meet or exceed the requirements are encouraged and will be rated accordingly. Proposals should follow in the order of sequence set forth in the RFP. Information provided out of sequence may not be evaluated and may result in the offeror’s disqualification from award.

2.2 Offerors shall submit their proposals in accordance with the ELECTONIC PROPOSAL

SUBMISSION INSTRUCTIONS no later than the time and date specified in Section 00 10 00 of Standard Form 30.

2.3 The Government is using a two-phase procurement approach for this design/build Indefinite Delivery

Indefinite Quantity (IDIQ) Multiple Award Task Order Contracts (MATOC). For Phase II, offerors are required to submit a proposal consisting of the information identified in paragraphs 2.4 and 2.5 below. All proposal materials shall be submitted in accordance with the ELECTONIC PROPOSAL SUBMISSION INSTRUCTIONS. Phase II proposal sections should parallel the submission requirements identified herein.

2.4 Volume I for Phase II shall be submitted in accordance with the ELECTONIC PROPOSAL SUBMISSION INSTRUCTIONS and include the following information:

Volume I – Factor I: Design / Technical o Sub-factor 1 – Design Drawings o Sub-factor 2 – Design Narrative

Volume I – Factor II: Management Approach o Sub-factor 1 – Schedule Narrative o Sub-factor 2 – Management Plan

NOTE: Volume I shall be submitted in accordance with the “File Naming Convention” and “File Organization” paragraphs of the ELECTONIC PROPOSAL SUBMISSION INSTRUCTIONS. Failure to place the required submission information under the appropriate tab (factor or sub-factor) may result in a lower rating if the evaluators cannot readily find the appropriate information. Any specified page limits will be strictly adhered to and enforced. Information submitted which exceeds the specified limit will not be evaluated.

2.5 Volume II for Phase II shall be submitted in accordance with the ELECTONIC PROPOSAL

SUBMISSION INSTRUCTIONS and include the following information:

AMENDMENT 0009******

Volume II – Tab A: A signed SF1442 acknowledging all amendments and Price Breakout Schedules (Sample Project and Binding Rates)

NOTE: Volume II, with the Price Breakout Schedule for the Sample Project and the Price Breakout Schedule for the Binding Rates, shall be submitted in accordance with the “File Naming Convention” and “File Organization” paragraphs of the ELECTONIC PROPOSAL SUBMISSION INSTRUCTIONS.

Failure to place the required submission information under the appropriate tab (factor or sub-factor) may result in a lower rating if the evaluators cannot readily find the appropriate information.

3. Proposal Evaluation Process

3.1 A Source Selection Evaluation Board (SSEB) comprised of representatives of the U.S. Army Corps of

Engineers will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. Technical/quality proposals will be reviewed and rated without knowledge of the price offered. The number and identities of offerors will not be revealed to anyone who is not involved in the evaluation and award process or to other offerors. Proposals will be evaluated based on the factors described herein, and the basis of award is the Best Value Trade-Off Process, as stated in paragraph 1.4 above.

3.2 The evaluation process for Phase II essentially consists of four parts: proposal compliance review, technical evaluation, price evaluation, and cost/technical trade-off analysis.

3.2.1 Proposal Compliance Review: This is an initial review to ensure that all required forms and certifications are complete and that both a technical and price proposal were received.

3.2.2 Technical Evaluation: The SSEB will evaluate and rate the proposals against the Phase II RFP requirements. The factors will be rated using an adjectival-based system.

3.2.3 Price Evaluation: The SSEB and SSA will evaluate price proposals independent of the technical evaluation.

The SSEB will not have access to price information until completion of the technical evaluation.

3.2.4 Cost/Technical Trade-off Analysis: After all above evaluations and reviews are complete, the SSA will compare the relative advantages and disadvantages of technical proposals and compare prices. The SSA will then consider all factors to select the proposals offering the best value to the Government.

4. Phase II Proposal Information and Related Evaluation Factors

4.1 Phase II proposals will be evaluated in accordance with the factors and sub-factors below, listed in relative order of importance. All technical evaluation factors and sub-factors, other than cost or price, when combined, are approximately equal to cost or price. Offerors are reminded to include their best technical approach in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interest of the Government.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
