2. BACKGROUND:

Individual medical preparedness is vital for force health protection. Laboratory testing for G6PD deficiency, Lipid Panels and other blood work are required by DoD and NYARNG.

3. OBJECTIVES AND SCOPE:

The objective of this Statement of Work is to provide parameters and criteria for the completion (pick up and testing) of Blood/Urine samples as required for Soldiers of the New York Army National Guard (NYARNG).

4. GOVERNMENT- FURNISHED PROPERTY AND INFORMATION

Medical Command, NYARNG will provide the required supplies (ie. needles/syringes) to obtain and perform centrifugal separation of the specimen if needed for Laboratory Testing.

The number of specimens taken will vary daily as numbers are based on mission requirements.

5. CONTRACTOR FURNISHED ITEM:

Contracted laboratory will provide all supplies needed to draw and contain specimen with exception of those noted in section 4 above. This includes all tubes, sterile urine cups, requisition forms, packing and shipping items, and any other supplies needed to provide safe and secure shipping to the contractor.

Contractor shall be governed and comply with all applicable State and Federal Laws.

Contractor will provide for pickup of samples between 0900 to 1800 hours, Monday thru Sunday from various sites throughout New York State as designated by NYARNG Medical Command. Once Samples picked up they will be taken to the Contractor Lab and be processed/ tested and the results will be provided to Medical Command in written format

Contractor must provide written test results to NYARNG MEDCIAL COMMAND within 48 hrs of receipt of samples through a secure website and by mail/ fax.

6. SPECIFIC TASKS:

A. Contractor must be able to perform the following Laboratory Tests as needed:

1. Glucose-6-Phospate Dehydrogenase, RBC (G-6-PD RBC)

2. Blood Group and Rh factor

3. Lipid Panel (which includes Total Cholesterol, HDL Cholesterol, LDL Cholesterol, Cholesterol/HDL Cholesterol Ration, Calculated LDL, and Triglycerides);

4. Cholesterol, Total

5. CBC Hemogram (which includes WBC, RBC, HGB, HCT, MCV, MCH, MCHC, RDW (Red Cell Distribution Width), MPV (Mean Platelet Volume), and Platelet Count)

6. Glucose

7. Prostate Specific Antigen, Total (PSA)

8. Urinalysis Dipstick with Microscopic Reflex (includes Macroscopic and Dipstick)

9. Drug Screen, 10 Drug, without confirmation, THC cutoff at 50 ng/mL (Includes Amphetamines, Barbiturates, Benzodiazepines, Cocaine, Marijuana (50 ng/mL Tetrahydrocannabinol screening cutoff), Methadone, Methaqualone, Opiates, Phencyclidine (PCP), and Proxyphene *no chain of custody needed)

16. Liver Panel II (Includes Alanine Aminotransferase (ALT), Albumin, Alkaline Phosphatase, Aspartate Aminotransferase (AST), Gamma Glutamyltransferase (GGT), Globulin (calculated), Lactate Dehydrogenase (LD), Total and Direct Bilirubin, and Total Protein)

B. On occasion other laboratory tests will be ordered on an as needed base to support NYARNG medical readiness requirements.

C. Routine physical exam labs ordered are G-6-PD RBC, Blood Group and Rh Factor, Lipid Panel, and Total Cholesterol.

D. There will be approximately 1500 Soldiers seen yearly in the medical clinic at Watervliet Arsenal, which normally operates Tuesday- Thursday, which will require a more comprehensive lab analysis than seen in routine physical exams.

E. Lab testing performed on mass events such as Medical Readiness Weekends (MRWs) and Soldier Readiness Processing (SRP) for mobilization, which can take place in multiple locations, will primarily involve G6PD and Blood RH Factor testing on perhaps 15- 20% of the Soldiers seen. Approx 30% seen will require over 40 labs ie. Lipid panels, Total Cholesterol, Glucose, PSA.

F. Contractor will provide instruction to Medical Command on how to label the specimen containers and what specific tubes are required for each specific individual test and how to fill out the Contractors requisition (lab order) forms, so that prompt and accurate Lab testing can be completed on the specimens that are provided.

G. Contractor shall be licensed by the State of New York to provide the specific services rendered.

H. Contractor will provide monthly invoices for services rendered to NYARNG Medical Command prior to payment being made. The Contractor will be paid on the basis of the invoice, which must state (a) date of service rendered, type of test performed, and cost of test performed, (b) or in other formats agreed to by the contractor and contracting office.

7. APPLICABLE DOCUMENTS:

8. PLACES OF PERFORMANCE:

Medical Command is a Mobile Unit and Contractor will need to be able to pick up/ test specimens in multiple areas of New York State. The most common pick up sites will include the following list.

1. 1 Buffington Street, BLDG 120, Watervliet Arsenal, Watervliet, NY 12189

2. Camp Smith Training Site (CSTS), Cortlandt Manor, NY 10567

3. Fort Drum, Watertown, NY

4. Buffalo, NY

9. PERIOD OF PERFORMANCE: 21 April 2010 – 30 September 2010

10. OTHER CONDITIONS/ SECURITY:

a. Safety: The contractor has established a safety and health program in accordance with the New York State as well as Federal Occupational Safety and Health Administration (OSHA) standard.

b. The contractor employee shall be responsible for safeguarding all Government Property provided for contractor use. At the end of each work period, all Government materials must be secured.

c. Contractor must be New York State Licensed to perform Laboratory Testing.

11. ACCEPTANCE PLAN:

All work performed and all test data to be submitted under this task will be made available to be inspected for compliance with the SOW and accepted by the government.

12. QUALITY CONTROL:

The contractor shall adopt a quality assurance program that monitors all lab service activities and ensures the highest quality customizable lab services available.

Contractor Evaluation: The Government will evaluate the contractor’s performance using the “Contractor Performance Assessment Reporting System (CPARS) ( http://www.cpars.csd.disa.mil/). The Government may evaluate the quality of professional and administrative services provided.

ESTIMATED WORKLOAD DATA

Workload is variable as stated in section 6 and based on the number of NYARNG Soldiers who are attending Medical Readiness or Soldier Readiness Processing events during the training year as well as approx 30 Soldiers a week receiving routine medical care in the Watervliet Arsenal Medical Command Clinic .These numbers will vary by the events with up to 2500 Soldiers in a month during mobilization events. Medical Command is responsible for assessing the medical readiness of each Soldier. This includes specific blood work for all Soldiers over 40 and other test as needed. There are approximately 10,500 Soldiers in the NYARNG.

The table below projects approximately; when and how many Soldiers are to be seen during Medical Event Periods. Not all these Soldiers will need Lab work, as stated in Section 6E. This table does not include the number of Soldiers mentioned in Section 6D that are to be seen at the Watervliet Arsenal.

Organizational Analysis

Army National Guard (ARNG):

Vision is to be “Relevant, reliable, ready and accessible.”

Mission:

· Federal: “Maintain properly trained and equipped units available for prompt mobilization for war, national emergency or as otherwise needed.”

· State: To provide trained and disciplined forces for domestic emergencies or as otherwise required by state law.

Technical Specifications Contractor serves as the Laboratory Specimen Testing Contractor for the Medical Command Commander and his/her staff for matters regarding the laboratory specimen pick up and testing. Contractor is to work with the MEDCOM Commander and his/her staff to develop a screening plan and facilitate the implementation and the progress toward the plan.

2.0

Technical Specifications: The following technical specifications are provided to demonstrate the task environment in which the services will be delivered. The following specifications are not directives on how the services are to be provided but an example of what traditionally has been required to successfully support the task order objective. The contractor is encouraged to surpass the minimal technical specifications as well as demonstrate technical, operational, and administrative expertise to support the customer in exceeding organizational and departmental objectives.

2.1 Kick-off Meeting: There will be an initial meeting of the Medical Command and the contractor to discuss upcoming requirements that involve the Laboratory Specimen Pick-up and Testing. The Contractor shall present a program work plan, including technical approach. Establish milestones, meetings, coordination, submittals, and review period. The program plan shall address program and project organization which includes compliance with AR’s, coordination procedures and activity schedule; and describe the quality assurance and quality control procedures, and activities that will contribute to the successful execution.

2.2 Program Management; The Contractor shall manage the objectives and technical review for laboratory specimen pick up and testing. This may include site visits to various locations within New York State.

2.2.1 Training: Contractor will be fully trained and be governed and comply with all applicable State and Federal Laws.

2.2.2 Reporting Requirements: The contractor shall: Pick up Specimens at different locations throughout New York State, Test the Specimens at an approved facility. Contractor will then report those results within 2 business days of specimen pick up and testing to MEDCOM.

3.0 Additional Requirements and Notes:

3.1 The Contractor shall be governed and comply with all applicable State and Federal Laws.

3.2 Contractor shall be licensed by the State of New York to provide the specific services rendered.

3.3 Contractor must be able to perform the following Laboratory Tests as needed:

3.4 They shall possess experience/knowledge directly related to the Army/Air National Guard related to the requirements of the task order.

3.5 It is highly desirable that the Contractor have experience working as a liaison between community based organizations and the military.

3.5 Location of Pick- up Sites is New York State.

4.0 Security Requirements:

4.1.1 Contractor Verification System. Contractor Verification System (CVS) program was implemented under Homeland Security Presidential Directive-12 (HSPD-12): Policy for Common Identification Standard for Federal Employees and Contractors. CVS was developed as a web-based tool designed to automate the application, validation and approval process for issuance for the Common Access Card (CAC) to eligible Department of Defense contractor personnel. The Contractor shall obtain the necessary clearance(s) and comply with all regulatory guidance. The Contractor shall be in compliance with HSPD-12 at all times and is subject to any future requirements to this directive.

5.0 Miscellaneous:

5.1.

Referring to the Basic Contract PWS paragraph 7.9; Performance of Services During Crisis Declared by the National Command Authority or Overseas Combatant Commander. Not Applicable this Task Order.

5.2 The contractor is cautioned that if off-duty active military personnel are hired under this contract, they may be subject to permanent change of station, change in duty hours, or deployment. Military Reservists and National Guard members may be subject to recall to active duty. The absence of such employees shall not constitute an excuse for nonperformance under this contract.

5.3 Hours of Operation: The contractor shall perform the services required under this contract within core operating hours which are 9:00 am to 6:00 pm Monday thru Sunday.

Quality Assurance Surveillance Plan:

The Customer Point of Contact (POC) will monitor contractor performance and complete the Quality Assurance Surveillance Plan Worksheet provided below on a monthly basis. The following information will be provided to the Contracting Officer and the Contracting Officer Representative (COR) to ensure service and/or deliverables support the PWS objectives. If the performance rating for any task in this order is “Red” during any time in the performance period, the customer will provide the Contracting Officer and the COR documentation and appropriate action will be taken to remedy the deficiency. The quality rating may change from “Green” to “Red” without notice. We anticipate the POC utilizing the “Yellow” quality rating to alert the contracting office and the COR of quality issues that have the potential for a “Red” quality rating if corrective action is not taken.

The Quality Assurance Surveillance Plan Worksheet will be submitted to the Contracting Officer with a copy to the COR following the first month of performance. Future months will be submitted to the Contracting Officer only, unless COR involvement is warranted. The COR will assume a quality performance rating of “Green” on all measured deliverables unless otherwise notified. By approving service and/or deliverables that this form documents, the POC confirms the quality performance rating of “Green” unless otherwise annotated.

At the end of the task order period of performance or annually, the POC will be asked to complete a Quality Performance Review to document the quality performance rating during the performance period. This will be submitted to the Contracting Officer and the COR.

The POC may submit a Quality Assurance Worksheet at anytime and as often as necessary to document quality levels. If Contractor response to an identified quality deficiency is unsatisfactory, the Contracting Officer or COR will contact the appropriate Contractor representative to implement a plan of action to remedy the identified deficiency.

The task order COR must be formally trained which requires 2 courses; DAU CLC106, COR with a Mission Focus and CLC 013, Performance-Based Services Acquisition, (proof of training certificates are required). New certificates required every 2 years.

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (FEB 2009)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 621511.

(2) The small business size standard is 13,500,000 million dollars.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b)(1) If the clause at 52.204-7, Central Contractor Registration, is included in this solicitation, paragraph (d) of this provision applies.

(2) If the clause at 52.204-7 is not included in this solicitation, and the offeror is currently registered in CCR, and has completed the ORCA electronically, the offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation. (d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
