52.236-2 DIFFERING SITE CONDITIONS (APR 1984)

(a) The Contractor shall promptly, and before the conditions are disturbed, give a written notice to the Contracting Officer of

(1) subsurface or latent physical conditions at the site which differ materially from those indicated in this contract, or

(2) unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inhering in work of the character provided for in the contract.

(b) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor's cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(c) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in (a) above for giving written notice may be extended by the Contracting Officer.

(d) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract.

(End of clause) any subcontractors and/or personnel noted in the narrative shall be explained. Each Offeror’s Past Experience will be rated based on the quality of each project’s narrative describing the work performed (i.e., how well the project’s scope is described), the relevance to the PWS Section 6.0 program areas, and the depth and breadth of each project’s scope (i.e. how many of the PWS Section 6.0 program areas are covered by the project’s scope).

The narrative should describe the complexity of a submitted project and innovativeness of the Offeror’s technical approach in achieving performance objectives or overcoming obstacles, either anticipated or unforeseen. Offerors should describe risks that were mitigated by use of quality management, risk evaluation and mitigation, and technical solutions.

B.1.1.9 Indefinite-Delivery, Indefinite-Quantity (IDIQ) Contracts, where numerous Task Orders are summed to meet any of the requirements identified herein, are not acceptable.

B.1.1.10 If proposing as a JV, each Contractor in the JV should be represented within the selected project examples. JV documentation shall be provided in Volume 3, Tab E of the Offeror’s price proposal.

B.1.1.11 In the case of contractor teaming arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed six (6) relevant projects submitted for Factor 1 for consideration in response to the experience requirements of the RFP. T teaming documentation shall be provided in Volume 3, Tab E of the Offeror’s price proposal. If a Teaming Agreement or commitment is not provided, the projects of any team members outside of the Prime Contractor will not be considered.

Factor 1 is the most important factor.

B.1.2 FACTOR 1 EVALUATION CRITERIA

B.1.2.1 The Government will evaluate the extent of the Offeror's experience on projects that are “recent” and “relevant” to the work to be done in the context of this solicitation. Recency and relevancy are defined above. Recency and relevancy of each submitted project will be evaluated for its similarity to the contract type to be awarded (i.e., FFP), magnitude, technical scope (identified program areas of the PWS Section 6.0), technical complexity (complex ERS tasks, regulatory involvement, etc.) and diversity (depth and breadth of PWS Section 6.0 program areas) of this solicitation.

As this is a Best Value Trade-Off, higher evaluation ratings for this Factor may be given for proposed project examples that:

W912PP21R0008

provide a summary list of any/all OSHA violations and reported lost time accidents in the past five (5) years for the Prime and Team Partners, or state that there were none. The list of OSHA violations may be provided as an Appendix to the Management Approach. The signed certification sheet and the list or OSHA violations will be excluded from the 40 page limit for Factor 2.

The Offeror shall provide documentation of their accreditation in accordance with the Department of Defense (DoD) Advanced Geophysical Classification Accreditation Program (DAGCAP). The DAGCAP documentation may be provided as an Appendix to the Management Approach, and will be excluded from the 40 page limit for Factor 2.

B.2.1.2 Key Personnel and Resumes

The evaluation of Key Personnel will consider education, professional qualifications, complexity and range of experience, and accomplishments/successes in executing and providing environmental remediation services in accordance with the RFP.

Though Section 5.1 of the PWS identifies all disciplines considered Key Personnel, the Offeror shall provide resumes only for individuals listed below using the KEY PERSONNEL RESUME FORM provided at the end of this section. Resumes must clearly demonstrate how the proposed individual possesses not only the required education, qualifications, and professional registrations, but also the experience in the stated Program areas required by his/her respective Key Personnel role stated in Section 5.1 of the PWS to successfully execute the requirements of this contract. Resumes shall also include appropriate cross-references of the proposed individual’s work on submitted Past Experience projects in Factor 1, if applicable. Resumes are limited to three (3) pages each for a total of 30 pages under Key Personnel Resumes (which is part of the 40-page limit for Factor 2).

Key Personnel are as follows:

Program Manager*

Senior Project Manager*

Contractor Quality Control Manager (CQCM)*

Safety and Health Manager (SHM)*

Quality Control Geophysicist

Senior Project Geophysicist

Senior Chemist

Senior Geologist

Senior Project Engineer

Senior Risk Assessor/Toxicologist

*Must be an employee of the Prime.

Replacement of Key Personnel After contract award, the Contracting Officer shall approve replacement of any Key Personnel after verifying that they meet or exceed the requirements of the solicitation. If further key management personnel are required to perform any work under this contract, the contractor will be required to submit their resumes for approval by the Contracting Officer.

the requirement for the full work effort in relation to the technical requirements and UFP-QAPP in Attachment A.

The Offeror’s price proposal for the Example Project should correlate with the labor categories proposed in the narrative portion of their proposal and be traceable to their proposed discipline schedule in Factor 6. Individual tasks should be identified that are associated with executing the Example Project in the price proposal and include a breakdown of their respective costs. Other direct costs (e.g., supplies, materials, travel, etc.) and profit for the Example Project shall be included and identified in the calculation of the total costs. Offerors shall provide cost breakdowns and supporting calculations in Excel file format, including underlying formulas. The cost breakdowns should be cross-referenced to the individual tasks to which they relate.

The Service Contract Act Wage Determination provided in Section J is to be used as a minimum base rate and is intended for use in preparing the Example Project price proposal only.

Separate Service Contract Wage Determinations, including Davis Bacon Wage Determinations, will be provided by the Government when a task order is issued from the awarded MATOCs.

Any proposal that does not provide their price proposal for the Example Project using their proposed price schedule in Section B as instructed will not be evaluated and considered for award. The Offeror shall include all professional and support effort such as project management, professional service resources and overhead costs. Bonding costs are not required in this proposal.

B.6.1.5.5 Financials and Financial Standing Questionnaire. Offerors shall provide their latest balance sheet and income statement, including names of banks or other financial institutions with which your firm conducts business. If the financial statements are more than 60 days old, a certificate should be attached stating that the financial condition is substantially the same, or if not the same, state the changes that have taken place. The financial statements will be treated as confidential. The Financial Standing Questionnaire provided at the end of this section of the RFP is required to be submitted under this section.

B.6.1.5.6 Small Business Subcontracting Plan. Only large business Offerors are required to submit a subcontracting plan. The plan shall be prepared in accordance with FAR 52.219-9, DFARS 252.219-7003, and AFARS Appendix DD. The Offeror shall take into consideration when preparing the required subcontracting plan, that only those subcontracts which are awarded directly by the prime contractor to small and small disadvantaged firms can be included in the plan. Subcontracts to be awarded by a large business subcontractor are subject to the flow-down provisions of the clause and shall be reported by that subcontractor electronically via eSRS (https://www.esrs.gov). Failure to submit an acceptable subcontracting plan shall make the Offeror ineligible for the award of the contract. The format for the Subcontracting Plan and subcontracting goals applicable to this solicitation are provided at the end of Section M. Subcontracting Plans will be evaluated on an ACCEPTABLE/UNACCEPTABLE basis. The Subcontracting Plan must adequately respond to each of the required elements of FAR 52.219-9(d) paragraphs (1) through (15).
