Section 00 20 00 - Instructions for Procurement

TECHNICAL MATTERS

Technical inquiries and questions relating to proposal procedures or bonds shall be submitted via Bidder Inquiry in ProjNet at www.projnet.org\projnet.

Offerors shall not submit their proposals via ProjNet. Any questions regarding acceptable means of submitting offers shall be made directly to the Contract Specialist identified in the solicitation.

To submit and review bid inquiry items, bidders will need to be a current registered user or selfregister into system. To self-register go to web page, click BID tab select Bidder Inquiry, select agency USACE, enter Key for this solicitation listed below, and your e-mail address, click login. Fill in all required information and click create user. Verify that information on next screen is correct and click continue. From this page you may view all bidder inquiries or add inquiry.

Bidders will receive an acknowledgement of their question via email, followed by an answer to their question after it has been reviewed and response approved by the Contracting Officer.

1. OVERVIEW.

1.1 Construct classrooms, test center, reference library, administrative area, conference room, break area, supply and storage areas, male and female shower/locker rooms, and elevator. 32,900 SF in size, and significant site work. Built-in building systems include fire alarm/mass notification, fire suppression, utility management control, telephone, advanced communications networks, cable television, intrusion detection, closed circuit surveillance, electronic access control, and protected distribution. Supporting facilities include all related site-work and utilities (electrical, water, gas, sanitary sewer, and information systems distribution), lighting, parking, access drives, roads, hardstands, curb and gutter, sidewalks, storm drainage, landscaping, and other site improvements. Special construction includes sustainable construction features complying with Leadership in Energy and Environmental Design (LEED) "Silver" with enhanced commissioning. Access for persons with disabilities will be provided. Comprehensive interior design, electronic security systems, and audio visual design services are included.

The contract issued will be Firm Fixed Price. The period of performance is 540 calendar days for the base bid; the total contract duration shall not exceed 540 calendar days. Work location is Fort Bragg, North Carolina. Antiterrorism/Force protection measures and sustainment mandates will be incorporated. The resultant contract will be Firm-Fixed Price (FFP).

1.2 The proposal shall describe the capability of the offeror to perform the contract based on five

(5) evaluation factors. The proposal should be specific and complete in every detail as well as be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the contract.

1.3 For the purposes of this solicitation, the Government will award a contract to the responsible offeror whose proposal is fair and reasonable and is determined to be the most advantageous to the Government in terms of price and non-price factors. The basis of award is the Best Value- Tradeoff process, as authorized by FAR 15.101-1. Proposals will be evaluated and ranked using non-cost/price factors for relative strengths, deficiencies, significant weaknesses, and risks.

Tradeoffs are permitted. The Government reserves the right to accept other than the lowest priced offer. The right is also reserved to reject any and all offers.

2. GENERAL INSTRUCTIONS.

In accordance with FAR Clause 52.215-1, Instructions to Offerors – Competitive Acquisitions, the Government reserves the right to make award without discussions. Therefore, offerors should submit their best technical and price terms in their initial offer and not automatically assume that they will have an opportunity to participate in discussions or to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interests of the Government.

In accordance with 15.306(c)(1) and FAR Clause 52.215-1(f)(4), Instructions to Offerors – Competitive Acquisitions, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

2.1 Contractor Team Arrangements. The Government will recognize the integrity and validity of contractor teaming arrangements, provided the arrangements are identified and company relationships are fully disclosed in the offer. As further described in paragraph 2.3, below, the Government will only evaluate the information submitted by the legal entity with whom the Government would enter into a contract. This is the legal entity represented in Tab E, as registered in System for Award Management (SAM) and identified by its specifically assigned CAGE Code.

2.2 If applicable, a 8(a) Joint Venture or SBA/DoD approved Mentor-Protégé must submit all required documentation with their offer to be considered responsive, IAW the requirements set forth in Title 13 Code of Federal Regulations (CFR) Part 125.8

2.3 The Government will only evaluate the information submitted by the legal entity with whom the Government would enter into a contract. This is the legal entity represented in Tab E, as registered in System for Award Management (SAM) and identified by its specifically assigned CAGE Code. However, IAW CFR 125.8(e), the Government will also evaluate past performance and past performance submitted by the individual firms that make up a joint venture.

2.4 Notwithstanding the specific requirements of any other area of the RFP, information submitted about any company other than the offeror, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractor, WILL NOT be evaluated for any factor.

2.5 Offerors shall submit their proposal via ARMDEC in accordance with the Section 3 General Proposal Format, paragraph 3.4.

2.6 Proposals are due no later than the time and date specified in Block 13 of Standard Form 1442.

3. GENERAL PROPOSAL FORMAT.

3.1 Cover Page. Include the title of the solicitation, solicitation number, offeror name, and date of the submittal.

3.2 Table of Contents. Each volume of the proposal shall contain a detailed table of contents. If more than one Adobe PDF file is used for a volume, the complete table of contents shall be included in each. Any materials submitted but not required by this solicitation (such as company brochures) shall be relegated to appendices.

3.3 All information intended to be evaluated as part of the Technical Proposal must be submitted as part of the Technical Proposal. Do not cross-reference similar material in the Price Proposal, or vice versa. No dollar amounts from the Price Proposal are to be included in the Technical proposal.

3.4 Each offeror must submit Price and Technical proposals via the AMRDEC SAFE website.

No hard paper copies will be accepted or evaluated. The Price and Technical proposals must be received by the closing date and time set for receipt of proposals.

In an effort to reduce paperwork and reduce cost, all proposals shall be submitted electronically.

All submissions shall be in Adobe PDF format and shall be on 8 ½ x 11 size pages in no less than a 10 pitch or 10 font. Page limitations, where specified in the RFP, shall be considered a maximum. Offerors may use compressions utility software such as WinZip or PKZip to reduce file size and facilitate transmission.

The date and time of delivery will be established by the time of receipt of the email notification to the Contract Specialist and Contracting Officer by the AMRDEC SAFE website, not by the date and time of uploading of the proposal into the AMRDEC SAFE website. Do not assume that electronic communication is instantaneous – in fact, it can take several minutes or even hours in some cases. Please make allowances for delays in transmittal. If an electronic submission is uploaded minutes before the deadline but notification is not actually received in the recipients’ email inboxes until after the deadline, the submission will be considered late. The Government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals on its behalf. 3.5 The contractor is responsible for including sufficient details in its proposal to permit a complete and accurate evaluation. Accordingly, the Contractor shall be clear and concise in its proposal. The Government will not make assumptions concerning the Contractor’s intent.

3.6 The technical data criteria specified for each factor identified herein and as described in these instructions shall be submitted as part of the proposal. Failure to submit all the data required by the RFP, and these instructions may be cause for determining a proposal incomplete and, therefore, not considered for award.

3.7 Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal. Should the offer include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined “unacceptable” and thus ineligible for award. Should the offeror have any questions related to specific terms and conditions, these should be resolved prior to the submission of the offer.

3.8 Tabs. Proposal shall be organized and tabbed as follows:

3.8.1 VOLUME I: OFFEROR’S CERTIFICATIONS AND PRICE (FACTOR 6)

TAB A – The proposal cover sheet is required by FAR 52.215-1 (c) (2) and must be submitted by all offerors. The format for the proposal cover sheet is as follows:

PROPOSAL COVER SHEET

1. The solicitation number;

2. The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

3. A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

4. Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation; and

5. Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

Offerors should ensure telephone number; fax number, e-mail address, DUNS number and CAGE Code are all included. DUNS number will be used to access Contractor Performance Assessment Reporting System (CPARS) data. Offerors should also provide any other assigned number that identifies them in the CPARS database. If a separate DUNS has been created for a joint venture (J-V) it must be submitted. The offeror should also submit their Tax ID number on the proposal data Sheet.

TAB B - Standard Form 1442, completed and signed by authorized individual(s) of the offeror. Offers submitted in the name of a Joint Venture must be signed in accordance with the terms and conditions specified in the joint venture agreement as evidenced in the proposal.

TAB C - If applicable - All amendments must be acknowledged by all offerors and duly executed with an original signature by an official authorized to bind the company in accordance with FAR 4.102.

TAB D –Factor 5 - Price. Proposed price schedule is to be completed in its entirety by all offerors to include the Subtotals and Totals section as found in Section 00 10 00 - Solicitation, Contract Line Item Number (CLIN) Schedule.

TAB E - Section 00 45 00 – Representations and Certifications. Offerors shall include any narratives as it pertains to the requirement at 2.2 to document any teaming arrangement the offeror has or will enter into.

TAB F – Teaming Agreement Required Documentation, if applicable. See paragraph 2.1 and 2.2. Note to 8(a)—SBA must approve a joint venture prior to the award of an 8(a) contract on behalf of the joint venture.

TAB G - Offerors shall provide a fully executed Bid Bond as required by FAR Clause 52.228-1, Bid Guarantee in both HARD COPY and ELECTRONICALLY in Tab G.

For the purposes of this Request for Proposal, please note that in accordance with (IAW)

FAR 28.001:

“Bond means a written instrument executed by a bidder or contractor (the “principal”), and a second party (the “surety” or “sureties”) (except as provided in 28.204), to assure fulfillment of the principal’s obligations to a third party (the “obligee” or “Government”), identified in the bond. If the principal’s obligations are not met, the bond assures payment, to the extent stipulated, of any loss sustained by the obligee.”

Bonds shall therefore be executed in the name of the legal entity, whether a joint venture, partnership or the Prime Contractor of an informal teaming arrangement, with whom the government would enter into a contract for a successful offeror. The entity named on the bond must be able to acquire bonding capacity on its own merits, and not as the result of indemnification from a subcontractor or third party.

5. FACTOR 1 - PAST EXPERIENCE

5.1 SUBMISSION/MINIMUM REQUIREMENTS

5.1.1 The offeror shall demonstrate the experience as a prime contractor on projects of similar size, scope, and complexity.

5.1.2 Submit a minimum of three (3) and a maximum of five (5) relevant and recent construction projects that best demonstrate construction experience similar in size, scope, and complexity to the RFP.

For purposes of this evaluation, a relevant project is further defined as:

5.1.3 Size: Project of a minimum $5,000,000 (construction contract value).

5.1.4 Scope/Complexity: New general building construction or renovation to include but not limited to site development, mechanical, electrical, structural, etc.

For purposes of this evaluation, a recent project is further defined as:

5.1.5 Projects submitted for the offeror must be at least 50% complete for current on-going projects. Projects that are 100% complete must have been completed within the last six (6) years preceding the date the solicitation was issued.

5.1.6 A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather offerors shall submit the work performed under a task order as a project.

5.1.7 The attached Experience Information Form (Example 1) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed four (4) pages.

5.1.8 For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods). In addition, the description should also address any sustainable features for the project, including specific descriptions of those features. Provide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process.

5.1.9 If the offeror is a Joint Venture (J-V), relevant project experience should be submitted for projects completed by the Joint Venture entity, or the individual firms that make up the joint venture. Offerors that are part of the DoD Mentor Protégé program may only submit two

(2) recent and relevant projects completed by the Mentor. Offerors are still limited to a total of five (5) projects. Experience of proposed subcontractors to be utilized on this project will not be considered.

5.2 EVALUATION CRITERIA: FACTOR 1

5.2.1 The basis of evaluation will include the offeror’s demonstrated experience and depth of experience in performing relevant and recent construction and design projects as defined in the solicitation submittal requirements. The assessment of the offeror’s relevant experience will be used as a means of evaluating the capability of the offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects. Any projects submitted in excess of the five (5) will not be considered.

5.2.2 The Government places higher value on relevant projects of greater size and contract value.

5.2.3 Relevant projects where the offeror and the proposed design firm(s) have previously worked together may be considered more favorably than those that have not worked together.

5.2.4 Relevant projects that demonstrate design-build experience may be considered more favorably than those that do not have design-build experience.

6. FACTOR 2 – PAST PERFORMANCE

6.1 SUBMISSION/MINIMUM REQUIREMENTS:

6.1.1 The offeror shall demonstrate the experience as a prime contractor on projects of similar size, scope, and complexity.

5.1.2 Submit a minimum of three (3) and a maximum of five (5) relevant and recent construction projects that best demonstrate construction experience similar in size, scope, and complexity to the RFP.

6.1.1 Submit a minimum of three (3) and a maximum of five (5) relevant and recent construction projects that best demonstrate design experience similar in size, scope, and complexity to the RFP.

6.1.2 The Government will evaluate the offeror's past performance using the sources available to it including but not limited to: the example projects identified by the offeror and submitted on the Past Performance Questionnaires and any additional information received from references, CPAR or other sources. Offerors may be provided an opportunity to address any negative past performance information about which the offeror has not previously had an opportunity to respond if such information is determined to present an impact on the rating to be assessed.

6.1.3 The Government will consider past performance of the prime construction contractor.

The government will also consider the individual past performance by each partner to the joint venture as well as any work previously done by the joint venture itself. Offerors that are part of the DoD Mentor Protégé program may only submit two (2) recent and relevant projects completed by the Mentor Information submitted for this factor shall be drawn from projects for which the offeror is or was the prime contractor. Projects on which the offeror’s role was other than prime contractor will not be considered for evaluation. If a firm has multiple functions or divisions, the Government will only evaluate the past performance of the unit or division submitting the offer.

6.1.4 Projects submitted under this factor must first be deemed relevant and recent in accordance with the criteria listed below:

For purposes of this evaluation, a relevant project is further defined as:

Size: Project of a minimum $5,000,000 (construction contract value)

Scope/Complexity: The projects submitted should also demonstrate that the

For purposes of this evaluation, a recent project is further defined as:

6.1.5 Though not required, ideally project past performance information submitted under this factor would be on the same projects submitted for consideration under FACTOR 1, PAST EXPERIENCE. Individual project Past Performance Questionnaires shall not exceed four (4) pages; Government evaluators will review and evaluate only the information contained on the first four (4) pages. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer. The Government will call and confirm information provided by the offeror on the Past Performance Questionnaire with the points of contact, to the extent necessary to conduct a meaningful evaluation. The Government reserves the right to interview other individuals if the point of contact is not available.

6.1.6 Other Sources. The Government may contact sources other than those provided by the offeror for information with respect to past performance. These other sources may include but are not limited to: Contract Performance Assessment Report (CPAR), Past Performance Information Retrieval System (PPIRS), other Government sources, and interviews with organizations or individuals familiar with the offeror’s performance.

6.1.7 Offerors shall utilize the Past Performance Questionnaire in Example 2.

6.2 EVALUATION CRITERIA:

6.2.1 Projects submitted for the offeror must be at least 50% complete for current on-going projects. Projects that are 100% complete must have been completed within the last six (6) years preceding the date the solicitation was issued. The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance.

6.2.1.1 The Government places a higher value on projects which provided particularly difficult or unique challenges and the innovative methods the offeror used to resolve problems successfully.

6.2.2 Offerors are cautioned that the submission of each past performance questionnaire shall not exceed five (5) four (4) pages and that Government evaluators will review and evaluate only the information contained on the first five four (4) pages.

6.2.3 The Government will evaluate past performance based on the elements listed below:

6.2.3.1 Quality of Construction. The Government will evaluate all information available with respect to the quality of the actual construction undertaken and the standards of workmanship exhibited by the offeror.

6.2.3.2 Timeliness of Performance. The Government will evaluate all information available with respect to the completion of projects within the scheduled completion times.

6.2.3.3 Customer Satisfaction. The Government will evaluate all information available with respect to customer satisfaction, cooperation with customers, and interaction on past projects.

6.2.3.4 Management. The Government will evaluate all information available with respect to effective management of subcontractors, suppliers and labor on past projects.

6.2.3.5 Cost. The Government will evaluate all information available with respect to the contractor’s ability to perform within the contractually agreed price.

6.2.3.6 Safety. The Government will evaluate all information available with respect to the contractor’s safety program or efforts.

6.2.3.7 General. The Government will evaluate all general information and comments provided by previous clients with respect to the contractor’s effort

6.2.3.8 If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, past performance will be rated neither favorably nor unfavorably.

7. FACTOR 3 – KEY PERSONNEL.

7.1 SUBMISSION/MINIMUM REQUIREMENTS:

7.1.1 Each offeror shall provide resumes for the following Key Personnel proposed for this contract. Resumes shall not exceed five (5) pages per person. The proposed position of each person shall be clearly stated at the beginning of the resume

7.1.2 A sample suggested resume format is included with this RFP (Example 3). If offerors elect not to use the suggested resume format, all information identified on the sample format is still required for each resume submitted under this Factor. Proposals that fail to include resumes or that fail to include all required information on these resumes may be rejected as unacceptable

7.1.3 The Key Personnel identified must be used on the project. No deviations will be permitted unless they meet the same qualifications and experience of those individuals proposed and are expressly approved by the Contracting Officer in advance. An offeror’s use of different personnel than those proposed without approval from the Contracting Officer will be grounds for a Termination for Default.

Resume information to be provided shall be limited to no more than three (3) five (5) pages per person and shall include the following information as a minimum:

7.2 EVALUATION CRITERIA:

7.2.1 The Government will evaluate each offeror’s proposed Key Personnel submitted in response to Paragraph 7.1 assigning each a rating in accordance with the Combined Technical/Risk Rating in 11.2.

7.2.2 Minimum qualification requirements for Key Personnel are found in the specifications.

7.2.3 The Government places higher value on Key Personnel who have:

o Ten (10) years or more experience in assigned positions working on projects of similar size, scope, and complexity to the work described in this RFP.

o Five (5) years or more of experience in their assigned position while an employee of the prime contractor or the joint venture itself.

8. FACTOR 4 – QUALITY OF BUILDING SYSTEMS AND MATERIALS.

8.1 SUBMISSION/MINIMUM REQUIREMENTS:

8.1.1 Whether individual narratives or a single combined narrative is provided, the maximum total length for technical narratives under this section shall be ten (10) typewritten pages.

Drawings/Catalog Sheets WILL NOT count towards total number of pages.

8.1.2 Manufacturers’ catalog sheets that are submitted as part of the proposal will be used to evaluate offers based on their qualitative features and risk to the Government. Because all design efforts are not completed at the time of the proposal submission, it is expected that some specific models and capacities may not be indicated at the time of proposal submission.

However, manufacturers, product features, product lines and models can be proposed and qualitative and risk evaluations can and will be made by the Government. Those manufacturers, product features, product lines and models are to be included in the final design documents and will be incorporated into the construction contract.

8.2 EVALUATION CRITERIA:

8.2.1 Presentation Drawings:

o Provide building floor plans of each facility (base and option) with appropriate detail to show spatial relationships and overall dimensions o Provide exterior elevations of each facility clearly noting proposed materials, colors, and heights.

o Provide typical building sections and wall sections with appropriate details for each building type depicting the proposed building system and major materials. All proposals must be compliant with the Anti-Terrorism/Force Protection (ATFP) requirements.

8.2.2 Technical Approach Narratives:

o Provide a technical approach narrative, both qualitative and quantitative, defining the elements of the proposal. It is the responsibility of the Offeror to ensure that all aspects identified in the list below are addressed. The maximum total length for this narrative shall be ten (10) typewritten pages:

8.2.2.1 Minimum Space and Facility Size.

o Describe the spaces provided for each facility, in accordance with the requirements of the RFP. As a minimum, include a tabulation of the net square footage for rooms, zones, or other areas, the total gross square footage for each floor of each facility, and the total gross square footage for each facility to clearly demonstrate compliance with the project requirements. See the sample Format for Table of Facilities (Example 4) and Format for Table of Spaces (Example 5).

o Proposals shall identify any individual rooms, zones, or areas which are smaller than the required areas shown in the RFP and describe how such deviation would enhance the building function.

8.2.2.2 Quality Improvements

o Provide an overall list of quality improvements that are above the minimum stated with the performance specifications. Develop the table (Example 6) or similar, to identify quality betterments. Provide this information in tabular form supported by catalog information, as applicable, including warranties. The table should include a concise description of the betterment and if equipment, it should include the manufacturer’s name, model number, length of warranty, size/capacity (where available), efficiency (where applicable), and any other notes or information selected by the Offeror.

8.2.2.3 Connection to Installation Wide Systems

Describe how systems integrated into the new facilities which require connection and interface with existing installation wide systems will be accommodated in the proposed project. Narrative should address the following systems as minimum: Fire Alarm, Telephone, Cable Television, Utility Monitoring and Control System (UMCS), and privatized utility companies where applicable.

8.2.2.4 Architectural Finishes

o Describe how the materials selected provide for a suitable environment for the expected population of the facility. Discuss how these selections provide value to the Government and how they address the minimum requirements. Narrative should focus on aesthetics, durability and maintenance of the finishes proposed.

o Proposals may receive additional consideration for materials offered that include extended warranties, longer life expectancies, sustainability, durability (stand up to troop usage), have low maintenance requirements, and enhance the overall life cycle cost efficiency of the facility. Examples of such features might include, but are not limited to:

more durable building envelope systems and windows, solid wood cabinetry; solid surface counter tops; ceramic tile.

8.2.2.5 Mechanical Components and Systems:

o Describe how the mechanical systems selected provide for a highly efficient environmental control system including information about provisions for indoor air quality maintenance. Discuss how these selections provide value to the Government and how they address the minimum requirements. Narrative should focus on maintenance considerations, limiting energy consumption, and suitability of the proposed systems for the expected usage.

o Proposals may receive additional consideration for components and systems offered that include extended warranties, longer life expectancies, reduce energy consumption, sustainability, maintainability (cyclical maintenance, access, equipment placement), and enhance the overall life cycle cost efficiency of the facility. Examples of such features might include, but are not limited to: energy recovery systems;

exhaust air heat recovery systems; high efficiency central equipment (i.e. 0.5 kW/ton chillers, variable speed pumping and air handlers).

8.2.2.6 Plumbing Systems:

o Describe how the plumbing systems selected provide for a highly efficient domestic hot water system and an efficient piping system. Discuss how these selections provide value to the Government and how they address the minimum requirements. Narrative should focus on maintenance considerations, energy consumption, and suitability of the proposed systems for the expected usage.
