6.1.1. The hourly burdened labor rates proposed in Binding Labor Rate Schedule are binding upon contract award for the life of the MATOC.
6.1.2. The hourly burdened labor rates shall include direct cost, payroll taxes, insurance, benefits, and any other applicable labor costs, but shall exclude profit.
6.1.3. The binding hourly rates represent the maximum labor rates that the contractor shall use when responding to a Request for Task Order Proposal (RTOP) issued by the Government. These binding rates shall also apply to all modifications. The contractor may propose a lower hourly rate for these labor disciplines when responding to the RTOP based on the tasks identified in the RTOP or modification requests.
6.1.4. Adherence to these rates will be reviewed through submittal of supporting documentation by the contractor with each task order proposal. Failure to propose the binding hourly rate or a lower rate for the listed labor disciplines may result in the Contractor’s task order proposal being rejected for award consideration.
6.1.5. If a discipline is not listed in the contract rate pricing schedule and is required for the contractor to perform a specific task order, the contractor may propose the required labor category and the associated fully burdened labor rate (exclusive of profit) in the proposal submitted in response to the issued RTOP.
6.1.6. If during the Contract Period of Performance, the Contractor’s original personnel are no longer available, the Contractor shall find personnel that have the same qualifications as the previous personnel. The Contractor shall be responsible for negotiating the labor rates for those personnel that have been provided in Binding Labor Rate Schedule. The rates provided in Binding Labor Rate Schedule are the maximum that will be paid by the Government for any replacement personnel.
6.1.7. The maximum rates shall be governed by the effective date of the Task Order. Task Orders will use the prices for the 12-month period effective on the date the Task Order is issued. Modifications to Task Orders will reflect the rates of the “current 12-month” binding labor rate schedule. For example, if the rate schedule changes over on 1 November of each year, and a Task Order is issue on 1 September 2018 for 12 months work, the maximum rates will be the rates that were effective on 1 November 2017. Under the same assumptions, if a modification to the Task Order is required in December 2018, the labor rates effective on 1 November 2018 will apply.
6.2 Binding Cap Rates. The Binding cap rates for use on this contract are provided in the following schedule.

Year 4 Option year 2
Year 5

G&A Rate* % % % % % Annual Escalation
Other % % % % % (identify):
*May be substantiated by DCAA at a later time
6.2.1. The Binding Cap Rates represent 1) a breakout of the caps/markups incorporated into the Binding Labor Rate Schedule; 2) caps/markups on materials/services; and 3) caps/markups to be applied to future task order modifications.
6.2.2. The Binding Cap Rates represent the maximum rates that the Contractor shall use when responding to a task order request issued by the Government. These Binding Cap Rates shall also apply to all modifications. The Contractor may propose lower rates for these when responding to the task order request or modification requests.
6.2.3. Adherence to these rates will be reviewed through submittal of supporting documentation by the Contractor with each task order proposal. Failure to propose the binding rates or a lower rates may result in the Contractor’s task order proposal being rejected for award consideration.
6.2.4. The Binding Cap Rates shall be governed by the effective date of the Task Order. Task Orders will use the prices for the 12-month period effective on the date the Task Order is issued. Modifications to Task Orders will reflect the rates of the “current 12-month” Binding Cap Rate schedule. For example, if the rate schedule changes over on 1 November of each year, and a Task Order is issued on 1 September 2018 for 12 months work, the maximum rates will be the rates that were effective on 1 November 2017. Under the same assumptions, if a modification to the Task Order is required in December 2018, the Binding Cap Rates effective on 1 November 2018 will apply.
6.3 Binding Profit Rate. The Profit rate shall be determined at the task order level.
6.4 General.
6.4.1 The amount to be paid to the Contractor for each firm-fixed price task order shall be based on the binding labor rates for the disciplines listed in Paragraph 6.1, the binding cap rates listed in Paragraph 6.2, the binding profit rate cap listed in Paragraph 6.3 and any proposed travel (which has been accepted by the Government) per Paragraph 8.
6.4.2 Applicable Department of Labor Wage Rates (FAR 52.222-41) and Statement of Equivalent Rates for Federal Hires (FAR 52.222-42) will be included at the individual task orders level when the site and location for the work is known.
6.4.3 The Government reserves the right to request information other than certified cost or pricing data from the contractor at the task order level to assess the reasonableness of the proposed task order pricing.
6.4.4 The Government will analyze task order proposals to determine whether they are unbalanced with respect to prices or separately priced line items. Task order proposals that are determined to be materially unbalanced may be rejected. An offer is mathematically unbalanced if it is based on prices, which are significantly less than the cost for some contract line items and significantly overstated in relation to cost for others. In addition, a proposal is materially unbalanced if it is mathematically unbalanced and there is a reasonable doubt that the offer would result in the lowest overall cost to the government, even though it is the lowest evaluated offer.
7. DEPARTMENT OF LABOR WAGES
Department of Labor Wage Determination 2015-5635, Rev 14, date December 21, 2020 are attached in Section J of this solicitation. For individual task orders written against the contract, the appropriate Department of Labor Wage Determination and Statement of Equivalent Rates for Federal Hires will be provided.
8. TRAVEL
Per Diem (lodging and MI & E expenses) shall be paid at the current Government rates in accordance with the Federal Travel Regulation (FTR) per person per calendar day spent in travel status. No per diem will be paid for travel less than the number of hours per day stated in the current FTR. Per diem rate information may be obtained at https://www.gsa.gov/travel/plan-book/per-diem-rates

2.7.1. Page Limitations: Page limitations shall include typewritten text pages, charts, graphs, figures, diagrams, schematics, etc., aside from those items specifically stated as exempt from the page count.
Outlines and other similar information documents shall be included as numbered pages - no exceptions.
The number of pages per factor shown in Table 1 below may be varied by the offeror to suit its needs for certain identified factors, however, the total number of pages for the proposal submitted may not exceed thirty (30) pages for Volume I.
Page limitations shall be treated as maximums. Each side of each 8 ½ x 11 inch sheet that displays printed material shall be counted as one (1) page for page limitation purposes. Each side of each 11 x 17 inch sheet that displays printed material shall be counted as two (2) pages for page limitation purposes.
However, where practical, offerors may use the 11 x 17 size page to display a table, chart, graph etc, and it will be counted as one page. Compliance with page count limits shall be verified via the hardcopy. If page limits are exceeded, the excess pages (a) will be destroyed; and (b) will not be read or considered in the evaluation of the proposal. Page limitations shall be placed on responses to ENs. The specified page limits for EN responses will be identified in the letters forwarding the ENs to the Offeror(s).
2.7.2. Pages Counted: Each page shall be counted except the following:

Double sided pages are considered as two pages. NOTE: Proposals that exceed thirty (30) pages will have only those pages that are within the page count limits evaluated. All information appearing thereafter will not be evaluated.
2.7.3. Page Size: Unless otherwise stated, a “page” is defined as being one side of an 8.5” x 11” sheet of paper. Pages shall be typewritten except for the reproduced sections of the solicitation document and the font size shall be Times New Roman, 12 point. Except where it would be practical, offerors may use 10 point font i.e. charts, tables, graphs. All text shall be legible and easily read. Margins on all four edges of each sheet will be at least one-half (0.5) inch. Proprietary statements, security markings, and page numbers can fall within the defined margin area. Pages shall be numbered sequentially by volume.
2.7.4. Indexing: Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify factors.
2.7.5. Foldouts (11x 17 Pages): Legible tables, charts, graphs and figures shall be used wherever practical to depict organizations, systems and layout, implementation schedules, plans, etc. These displays shall be uncomplicated, legible and shall not exceed 11” x 17” in size. Foldout pages shall fold entirely within the volume. Each printed side of a 11 x 17 page will count as two pages, except where practical and is used to display a chart, graph, table, etc. with the exception of the requirement to present Previous Experience on 11” x 17” sheets which shall count as a single page. For tables, charts, graphs and figures, the font shall be the same as stated in paragraph 2.7.3., except where it would be practical, offerors may use 10 point font i.e. charts, tables, graphs. All information (except documentation identification, solicitation number, and page numbers) shall be contained within an image area of 10” x 16”.

Offerors shall provide a timeline schedule as part of their technical approach. Offerors are advised that this schedule is displayed on a table, chart or something similar as it will not be counted against the page limitation.
Title sheets, indices, and tables of contents are EXCLUDED from the page limitation.
3.2. Volume I, Factor 2 – Past Performance
The past performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements. If past performance information is not available for the Offeror; the Offeror shall be assigned a neutral rating which is neither favorable nor unfavorable.
Factor 2 (Past Performance) will be evaluated and adjectivally rated. One of the adjectival ratings (Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence as defined in Section 3 of Section M) will be assigned for the Past Performance Factor.
The Past Performance information to be submitted by the prime offeror shall consist of projects cited on the Past Performance Information Sheet (Attachment 1) and Contractor Performance Assessment Reporting System (CPARS) or Past Performance Questionnaire (PPQ) (Attachment 2).
3.2.1. A project is defined as: Work performed pursuant to one specific task order of an indefinite delivery/indefinite quantity (IDIQ) type contract at one site or multiple sites at a single installation or facility or work performed pursuant to a site-specific contract for one site or multiple sites within a single installation or facility. An ID/IQ type contract or the performance of work pursuant to multiple task orders of an ID/IQ type contract does not represent a "project" within this definition. If the offeror provides a specific task order as its "project," it shall provide the base contract number and the task order number for reference purposes. If the offeror provides a site-specific contract as its "project," it shall provide the contract number for reference purposes. The projects must be paid to date at no less than 60% paid out within the last seven (7) years to be considered as a project.
The Offeror shall provide the information in Attachment 2 for project experience for at least three (3) but no more than five (5) recent and relevant projects performed as the Prime or major subcontractor which demonstrate its relatable experience in project management and execution of work similar to that described Section C of this solicitation.
The Offeror must indicate whether it was Prime or subcontractor on each project. If the offeror was the Prime contractor, the offeror shall also describe its primary role/duties in execution of the work (i.e. the major components of the project which were completed by the Prime’s staff and major components which were subcontracted out). If the Offeror was a subcontractor, the Offeror shall describe its primary role/duties in execution of the work they were subcontracted to perform. The Offeror shall also provide information on the project as to the size, complexity, and distinctive and/or unique features of the project.
Example projects submitted by the offeror need to be from the prime contractor, one of it’s teaming arrangement/JV or a major subcontractor. If submitting as a JV or Teaming arrangement all firms that are part of the JV or teaming arrangement need to provide at least one example project.
Only submit recent projects that were physically completed or accepted by the customer within five (5) seven (7) years of the closing date of this solicitation, or which are nearing completion (e.g., are substantially complete).
3.2.2. Offeror shall demonstrate an acceptable past performance record. Provide at least three (3) but no more than five (5) questionnaires for the previous projects presented. CPARS are to be submitted for projects completed in support of the Department of Defense (DoD) projects. The Offeror shall provide a completed offeror performance evaluation, whether interim or final, and are available via the Contractor Performance Assessment Reporting System (www.cpars.gov). If a completed offeror performance evaluation does not exist in CPARS (example, non-U.S. Government projects) the Offeror shall provide a completed Past Performance Questionnaire (PPQ) (Attachment 2). A sample PPQ transmittal letter is provided in Attachment 3. If, at time of evaluation, a completed offeror performance evaluation exists in CPARS that conflicts with a submitted PPQ, the completed offeror performance evaluation will govern.
PPQ forms submitted by previous customers are not included in the overall proposal page limitation of Volume I. PPQ forms should be included under this tab.
The Offeror shall complete Blocks 1 - 4 of the PPQ form and send the questionnaire to their customer(s) and if applicable, to both the Government Contracting Activity (Contracting Officer) and the Government Contract Administration Activity (i.e. Administrative Contracting Officer/Contracting Officer Representative (ACO/COR)) responsible for the past or current contract. Customers should be instructed to complete Blocks 5 – 8 and the performance questions on the PPQ form. Ensure correct phone numbers and email addresses are provided for the customer POC.
Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a customer for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ which will provide contract and customer information for the respective project(s). Offerors should follow-up with customers to ensure timely submittal of questionnaires.
The Government reserves the right to contact the customer for verification or additional information. If the customer requests, questionnaires may be submitted directly to the Government’s POC, Pat Bonilla, via email at Patricia.B.Bonilla@usace.army.mil, Or Michael Robinson via E-mail at michael.g.robinson@usace.army.mil prior to the proposal closing date.
Offerors may include performance recognition documents received within the last seven (7) years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, JV, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), mailto:Patricia.B.Bonilla@usace.army.mil mailto:michael.g.robinson@usace.army.mil
Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
Other types of PPQs, signed by a commercial customer or signed by a representative from another Federal or State agency, may be submitted as long as the information submitted has the same or similar information as that of the PPQ provided in this solicitation which documents the quality of the Offeror’s performance for the project submitted.
PPQs previously completed by the customer may be submitted in lieu of having the customer complete a new questionnaire. Previously completed questionnaires will be evaluated only if they are submitted according to the instructions listed in this section.
Offerors shall not incorporate PPQs by reference that were previously submitted for other RFPs unless the questionnaire previously completed was identical in format and content to of Attachment 2. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
If an Offeror has been required to take corrective action for any substandard performance, experienced other performance problems such as cost overruns, offeror caused delays, numerous warranty calls, etc., the Offeror should explain the circumstances and the corrective actions taken.
Joint Venture Submission Requirements. Offerors submitting proposals as a Joint Venture (JV) shall obtain a DUNS number and be registered in the System for Award Management (SAM) as the offering Joint Venture. For the projects required by the Relevant Company Effort paragraph, the Offeror must provide projects performed by the JV that reflect the JV’s ability to perform the work required in this solicitation. If the Offeror cannot provide a sufficient number of projects as the JV to meet the requirement, the Offeror must provide those “recent”, “relevant” projects that it has performed as the JV, and then supplement the record with additional “recent”, “relevant” projects performed by each JV member in their individual capacities. In such instance, each JV member must satisfy the requirement, to include any performed as the JV. If the JV has no “recent”, “relevant” projects performed by the JV, then each member of the JV must provide a minimum of one (1) project, but submitting no more than five (5) projects total demonstrating “recent”, “relevant” projects performed by the JV member that reflect the JV member’s ability to perform the work required in this solicitation as required by the RELEVANT COMPANY EFFORT paragraph.
An offeror may use experience gained as a member of a Joint Venture (JV) agreement; however, while relevant, this experience may be considered less favorable than a specific project completed by the Offeror. If used, the Offeror must clearly identify their role and responsibilities in competing the project including the percentage of JV agreement and specific roles in constructing the project.
Provide the fully executed Joint Venture Agreement under this tab. The JV agreement will not be counted against the page limitation.
Verification: The Government reserves the right to verify the past performance record of cited projects or other recent projects not submitted by reviewing the Contractor Performance Assessment Reporting System (CPARS) or other Government appraisal systems or to interview owners or references. The Government may check any or all cited references to verify supplied information. An Offeror will be afforded the opportunity to reply to or explain adverse performance information to which the Offeror has not previously had an opportunity to respond.
The Government will use the recency, relevant company effort and quality of past performance information submitted under this tab to assess the Offeror’s Past Performance to determine the Offeror’s probability of successfully performing the scope of work described in this solicitation. Where the word “recent” appears it is understood to mean projects which are at least 60% complete (measured by amount paid out) as of the RFP closing date or a project that has been completed within seven (7) years of the RFP closing date.
Where the word "project(s)" appears in this RFP Section, it is understood to mean project(s), contract(s), task order(s), or any other contract document provided for by the Federal Acquisition Regulation (FAR 2.101). Examples of projects submitted by the Offeror shall indicate their role as Prime Contractor or major subcontractor on at least one contract for environmental remediation services at known or suspected MMRP sites.
Offerors are responsible for indicating the percentage of work that is complete (actual progress and/or earned value) if currently underway. The Offeror shall submit evidence of the quality of their past performance on submitted projects. The Offeror shall provide a completed offeror performance evaluation, whether interim or final, found in the Contractor Performance Assessment Reporting System (www.cpars.gov).
