See attached formats at end of this section, Past Performance Information Sheet, Past Performance Questionnaire (PPQ), Resume Template, for more details.
1.9 ELIGIBILITY FOR CONTRACT AWARD
In accordance with the FAR, no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in Part FAR 9 and any special standards set forth in the solicitation.
1.10 SOURCE SELECTION USING BEST VALUE TRADE-OFF
The Government will make award for this proposed contract using the Tradeoff Source Selection Process (see FAR 15.101-1). This process allows for a tradeoff between non-cost factors and cost/price and allows the Government to accept other than the lowest priced proposal or other than the highest technically rated proposal to achieve a best-value contract award. The Government shall conduct an in-depth review of each proposal against the factors established in this section and assign evaluation ratings.
Cost or Price Evaluation. Cost or price to the Government shall be evaluated, however, no adjectival ratings shall be utilized for evaluating cost or price since cost or price is not rated.
In all source selections analysis must include a determination, by the Procuring Contracting Officer, of whether the proposed cost or price is fair and reasonable.
Technical Rating Evaluation Processes. The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal.
For this acquisition, technical (non-cost) factors are significantly more important than price. All non-price (i.e., technical) evaluation factors are not equal. Relative weighting of the technical evaluation factors is as follows:
i. Factor 1 (Past Performance) and Factor 2 (Technical Approach) are equally important factors and are more important than,
ii. Factor 3 (Key Personnel including Resumes/Organizational Structure) which, is least important of all factors.
Responses that the Offeror understands, or will comply with the specifications, statements paraphrasing the specifications, and general or overly broad responses such as “standard procedures will be employed” or “well known techniques will be used”, will be rated “non-acceptable”.
1.11 LIST OF EVALUATION FACTORS (VOLUME I) AND SPECIFIC TECHNICAL
EVALUATION CRITERIA.
The Technical Proposal will be evaluated based on the following technical evaluation factors and standards:
FACTOR 1: PAST PERFORMANCE
FACTOR 2: TECHNICAL APPROACH
FACTOR 3: KEY PERSONNEL INCLUDING RESUMES/ORGANIZATIONAL
STRUCTURE
Evaluation Factors Location Factor Description Relative Importance Tab 1 Factor 1 Past Performance Factor 1 and 2 are equally important and are more important that Factor 3.
Tab 2 Factor 2 Technical Approach Factor 1 and 2 are equally important and are more important that Factor 3.
Tab 3 Factor 3 Key Personnel Including
Resumes/Organizational Structure Less important than Factors 1 and 2.
In order to be considered technically acceptable, proposals must meet ALL of the following requirements listed in the factors below:
FACTOR 1: PAST PERFORMANCE
The past performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements.
Factor 1 (Past Performance) will be evaluated and adjectivally rated. One of the adjectival ratings (Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence as defined in Section 1.11.1) will be assigned for the Past Performance Factor.
The Past Performance information to be submitted by the prime offeror shall consist of projects cited on the Past Performance Information Sheet (Attachment 1) and Contractor Performance Assessment Reporting System (CPARS) or Construction Contractor Appraisal Support System (CCASS) or Past Performance Questionnaire (PPQ) (Attachment 2). The Offeror may submit past performance information from a sub-contractor, but should provide a letter of commitment as part of the proposal if that is the case. CPARS/CCASS are to be submitted for projects completed in support of the Department of Defense (DoD) projects. The Offeror shall provide a completed offeror performance evaluation, whether interim or final, and are available via the Contractor Performance Assessment Reporting System (www.cpars.gov). If a completed offeror performance evaluation does not exist in CPARS (example, non-U.S. Government projects) the Offeror shall provide a completed Past Performance Questionnaire (PPQ) (Attachment 2). A sample PPQ transmittal letter is provided in Attachment 3. If, at time of evaluation, a completed offeror performance evaluation exists in CPARS that conflicts with a submitted PPQ, the completed offeror performance evaluation will govern. Past performance information sheets and PPQ forms are not included in the overall proposal page limitation of Volume I. PPQ forms should be included under this tab.
The Offeror shall complete Blocks 1 - 4 of the PPQ form and send the questionnaire to their customer(s) and if applicable, to both the Government Contracting Activity (Contracting Officer) and the Government Contract Administration Activity (i.e. Administrative Contracting Officer/Contracting Officer Representative (ACO/COR)) responsible for the past or current contract.
Customers should be instructed to complete Blocks 5 – 8 and the performance questions on the PPQ form. Ensure correct phone numbers and email addresses are provided for the customer POC.
Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a customer for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ which will provide contract and customer information for the respective project(s). Offerors should follow-up with customers to ensure timely submittal of questionnaires. The Government reserves the right to contact the customer for verification or additional information. If the customer requests, questionnaires may be submitted directly to the Government’s POC, Pat Bonilla, via email at Patricia.B.Bonilla@usace.army.mil, prior to the proposal closing date.
Offerors may include performance recognition documents received within the last five (5) years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting
System (CPARS), using all CAGE/DUNS numbers of team members (partnership, JV, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
Other types of PPQs, signed by a commercial customer or signed by a representative from another Federal or State agency, may be submitted as long as the information submitted has the same or similar information as that of the PPQ provided in this solicitation which documents the quality of the Offeror’s performance for the project submitted.
PPQs previously completed by the customer may be submitted in lieu of having the customer complete a new questionnaire. Previously completed questionnaires will be evaluated only if they are submitted according to the instructions listed herein.
Past performance information consists of the following three aspects:
(a) Recency
(b) Relevant Company Effort
(c) Quality of Past Performance
Recency. Recency is defined as a Project that shall be no less than 75% completed within five (5) years preceding the date of this solicitation.
Relevant Company Effort. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the solicitation requirements. Relevancy is also a measure of the likelihood that the past performance is an indicator of future performance. The Offeror shall provide no more than five (5) examples of “relevant” underground storage tank closure activities which may include, but shall not be limited to: removal and disposal of underground storage tanks, sheet pile shoring, dewatering large quantities of groundwater, soil contamination transfer and disposal, sampling and reporting of groundwater and soil. The Offeror shall complete and provide a Past Performance Information Sheet (Attachment 1) for a minimum of three (3) projects and a maximum of five (5) projects which meet the criteria described below. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer. If the Offeror is a joint venture, each firm shall provide a minimum of one (1) project, submitting no more than five (5) projects total demonstrating experience relevant to their role on this project. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer.
Where the word “relevant” appears it is understood to mean activities associated with regulatory closure of underground storage tanks. The government will give more consideration to projects submitted that illustrate expertise working on underground storage tank removal and disposal projects in California. Proposals that demonstrate successful experience with state and/or local regulatory agencies may be rated higher.
Quality of Past Performance. The Offeror shall submit evidence of the quality of their past performance on projects submitted in the Relevant Company Effort paragraph above. The Offeror shall provide a completed offeror performance evaluation, whether interim or final, found in the Contractor Performance Assessment Reporting System (www.cpars.gov). If a completed offeror performance evaluation does not exist in CPARS (example, non-U.S. Government projects) the Offeror shall provide a completed Past Performance Questionnaire (PPQ) (Attachment 2). If, at time of evaluation, a completed offeror performance evaluation exists in CPARS that conflicts with a submitted PPQ, the completed offeror performance evaluation will govern.
Offerors shall not incorporate PPQs by reference that were previously submitted for other RFPs unless the questionnaire previously completed was identical in format and content to the Attachment 2. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
If an Offeror has been required to take corrective action for any substandard performance, experienced other performance problems such as cost overruns, offeror caused delays, numerous warranty calls, etc., the Offeror should explain the circumstances and the corrective actions taken.
Joint Venture Submission Requirements. Offerors submitting proposals as a Joint Venture (JV) shall obtain a DUNS number and be registered in the System for Award Management (SAM) as the offering Joint Venture. For the projects required by the Relevant Company Effort paragraph, the Offeror must provide projects performed by the JV that reflect the JV’s ability to perform the work required in this solicitation. If the Offeror cannot provide a sufficient number of projects as the JV to meet the requirement, the Offeror must provide those “recent”, “relevant” projects that it has performed as the JV, and then supplement the record with additional “recent”, “relevant” projects performed by each JV member in their individual capacities. In such instance, each JV member must satisfy the requirement, to include any performed as the JV. If the JV has no “recent”, “relevant” projects performed by the JV, then each member of the JV must provide a minimum of one (1) project, but submitting no more than five (5) projects total demonstrating “recent”, “relevant” projects performed by the JV member that reflect the JV member’s ability to perform the work required in this solicitation as required by the RELEVANT COMPANY EFFORT paragraph.
An offeror may use experience gained as a member of a Joint Venture (JV) agreement; however, while relevant, this experience may be considered less favorable than a specific project completed by the Offeror. If used, the Offeror must clearly identify their role and responsibilities in competing the project including the percentage of JV agreement and specific roles in constructing the project.
Provide the fully executed Joint Venture Agreement under this tab. The Joint Venture Agreement does not count toward the Volume I page limit.
Verification: The Government reserves the right to verify the past performance record of cited projects or other recent projects not submitted by reviewing the Contractor Performance
Assessment Reporting System (CPARS) or other Government appraisal systems or to interview owners or references. The Government may check any or all cited references to verify supplied information. An Offeror will be afforded the opportunity to reply to or explain adverse performance information to which the Offeror has not previously had an opportunity to respond.
The Government will use the recency, relevant company effort and quality of past performance information submitted under this tab to assess the Offeror’s Past Performance to determine the Offeror’s probability of successfully performing the scope of work described in this solicitation.
Where the word “recent” appears it is understood to mean construction projects which are at least 75% complete (measured by actual progress and/or earned value) as of the RFP issue date or a construction project that has been completed within five (5) years of the RFP issue date. Where the word "project(s)" appears in this RFP Section, it is understood to mean project(s), contract(s), task order(s), or any other contract document provided for by the Federal Acquisition Regulation (FAR 2.101). Examples of projects submitted by the Offeror shall indicate their role as Prime Contractor on a contract for similar dewatering and closure activities for Government or for commercial/private sector customers.
Offerors are responsible for indicating the percentage of work that is complete (actual progress and/or earned value) if currently underway. The Offeror shall submit evidence of the quality of their past performance on submitted projects. If, at time of evaluation, a completed offeror performance evaluation exists in CPARS that conflicts with a submitted PPQ, the completed offeror performance evaluation in CPARS will govern. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. This does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
FACTOR 2: TECHNICAL APPROACH
