Can you confirm that all documents in Volume 1 Mandatory documents (Historical Chamber of Commerce certificate of membership, DURC, Attachment 2 Self certification for Antimafia, Prefecture License to provide guards service) can be send in Italian Language? Also the ATI is including in mandatory documents, so can you confirm that also the notarized legal document that estabilished the pool of firm (ATI) can be send in Italian language?

R13. Yes, Italian mandatory documents can be submitted in Italian.

Q14. In solicitation document at page 95 is written: f. Return completed FAR Provision 52.204-26 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment if SAM representations and certifications are not updated, and FAR Provision 52.209-11 Representation by Corporations regarding delinquent tax liability or a felony conviction under any federal law. Can you confirm that is necessary to send completed FAR Provision 52.204-26 only if the sam is not completely updated? Can you confirm that is necessary to send FAR Provision 52.209- 11?

R14. If the offeror is registered in SAM and has updated FAR Clause 52.204-26, dated October 2020, in their SAM records, then there is no need to return FAR 52.204-26 with the proposal. FAR 52.209-11 shall be returned filled out, as per Addendum to 52.212-1, B1f, Mandatory Documentation.

Q15. Can you confirm that the offeror has to decide how many supervisors to present?

R15. In accordance with paragraph 1.10.3 of the PWS: “The contractor shall ensure that an adequate number of supervisory personnel are always available during the contract duty performance”.

Q16. Can we present an ATI between Italian companies and a Joint venture among Italian companies and a US company that will perform the quality control on the security services performed by Italian companies on Livorno and Vicenza?

R16. ATI and joint ventures arrangements are not prohibited provided the requirements of Addendum 52.212-1 are met. However, offerors are advised that there will be one awardee, whether an individual firm or ATI/Pool of Firms/Joint Venture. That awardee is responsible for quality control. See Amended PWS paragraph 1.5.1.5.

Q17. Ref Addendum to 52.212-1, B.Volume content, Volume 1 – Mandatory documentation (page 95 of 118) In many parts of the text reference is made to subcontractors and ATI. Are there any preferences regarding the composition of the offeror? Our company can make the proposal both in ATI and as main contractor with a subcontractor and we would like to choose the best solution for the RFP.

R17. ATI and subcontracting are allowed. The Government does not have a preference on any of these teaming arrangements. Evaluation method will be Lowest Price Technically Acceptable, as per Addendum to 52.212-2.

Q18. Ref Section SF 1449 – Continuation Sheet (page 3 and following of 118).

Q20. Can you confirm that there are no mandatory armed Guards levels (Contratto collettivo di lavoro – CCNL level) to perform security services at the military bases of Vicenza and Livorno?

R20. The Government does not mandate any employment arrangements between the offeror and their employees. However, offerors need to comply with any applicable Italian law, including article 47 of Law n. 428 (29 Dec 1990) as modified by Legislative Decree n. 18 (2 Feb 2001), to ensure Transfer of Undertaking and Protection of Employment (TUPE). See Technical Exhibit B “Incumbent’s personnel roster”.

Q21. In the event of an award to another supplier instead of incumbent, the 'cambio di appalto' is mandatory by Italian Law. ‘Cambio di appalto’ means that the new awarded company have to hires all the incumbent employees that have performed security services at the military bases of Vicenza and Livorno.

For this legal obligation we ask to receive two tables (one for Vincenza and one for Livorno) containing security personnel anonymously data. To comply with Italian Law, we ask to receive for every guard: level ccnl, base salary, seniority ranking, personal allowance, superminimum, hiring date, last seniority step date (livello ccnl, paga base, scatti di anzianità, assegno ad personam, superminimo, data di assunzione, data ultimo scatto di anzianità).
