About this file

This amendment modifies a solicitation for Small Arms Maintenance Courses. The amendment extends the proposal due date to September 7, 2023. It also updates the response to a question about Status of Forces Agreement coverage to confirm personnel can receive SOFA status as technical experts under Article 73. The accreditation process is estimated at 12-13 weeks after award, with temporary SOFA status provided during that period to allow work to begin. Incumbent contractor personnel may qualify for expedited SOFA processing, depending on factors like time lapse between contracts and ordinarily resident status.

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

The purpose of this Amendment 7 is to do the following:

1) Extend the proposal due date to 10am CEST 7 September 2023, and

2) Revise the response to previously asked Question 1 regarding SOFA status.

Question 1: Are the employees for this work covered under the Status of Forces Agreement (SOFA) today?, Question 1 Updated Response: Yes. And based on additional research regarding SOFA status and discussions with DOD Contractor Personnel (DOCPER) office, this work can be accredited under Article 73 of the supplementary agreement to the NATO SOFA, specifically section 1.b.ff :

ff) Former officers, whose technical military skill or technical military knowledge are required for the performance of their work in addition to their other technical skills. As a matter of exception, this shall also apply to former non-commissioned officers who, under military training conditions, work closely together with soldiers on equipment used for the simulation of tactical combat conditions.

Once the contract is awarded, the accreditation process is estimated to take 12-13 weeks after award before being finalized. During that timeframe, the personnel teaching the courses will receive temporary SOFA status to be able to come overseas and begin work accordingly. Once the award is accredited, then dependents can follow.

If the contractor personnel currently work for the incumbent contractor, there is a process to expedite the SOFA accreditation for incumbents. Several factors that may impact this are: lapse in time between the current contract and the new contract award and if the applicants have significant Ordinarily Residence (OR) factors that would prevent them from obtaining SOFA accreditation.

If the incumbent personnel are eligible for SOFA status, as Technical Experts under Article 73, applicants may apply for status with a request for immediate status on the basis of military exigency (an ME request) as soon as the contract has been reviewed and approved by DOCPER. If the new contract is awarded in a timely fashion, and if DOCPER is promptly provided with the required information and documentation for that contract, individuals can usually receive status with little or no break between the old contract and the new. This assumes, of course, that the individuals are qualified under the requirements of the position descriptions approved with the new contract and also that the applicants are not ordinarily resident in Germany.
