4. Authority Cited:
10 U.S.C. 2304(c)(1) as implemented by FAR part 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited:
a. The existing district heating network at Military Community Hohenfels is built from prefabricated insulated district heating lines made of steel or flexible stainless steel and various insulated connection pieces of firm Brugg Rohrsysteme GmbH, Adolf-Oesterheld-Str. 31, 31515 Wunstorf, Germany and a centralized leakage control system of firm Brandes GmbH, Ohmstr. 1, 23701 Eutin, Germany. For production of the insulated heating lines and parts firm Brugg uses sensor technology (moisture monitoring wires) of firm Brandes, which are being integrated into the insulation for use with the existing Brandes leakage control system. This provides for absolute compatibility of Brugg and Brandes products. The finished end products (insulated heating lines or connection pieces with the sensors) are delivered by firm Brugg.
b. Other heating line brands are available on the market but are not compatible to the Brugg heating line system. Mixing line brands would cause technical problems due to the different material (e.g. wall thickness of the heating lines), insulations, fittings and compression resistance (high resistance needed for underground crossing of tank roads) used by the different manufacturers. There are no standard insulations and fittings available that would match all brands. Moreover, not all heating line manufacturers produce systems that allow connection of rigid with flexible heating lines, as is the case with Brugg products.
c. There are different leakage control systems on the market, which however are not compatible to the Brandes system. Since components of other brands are incompatible to the Brandes leakage control system, the Government would have to replace the installed Brandes system due to the different sensor technology used.
d. All components used with the existing district heating network and the corresponding leakage control system must be compatible. Using incompatible systems or parts of other brands would result in system damages, loss of operational control, loss of warranty and more repair or follow-on costs.
e. It is neither feasible nor fiscally responsible to replace a complete existing system when only extensions, modifications or repairs are needed.
Annex 409-AI-A-00-01, Templates 13
6. Efforts to Obtain Competition:
The solicitation for the ID/IQ contract will be posted to FedBizOpps and issued to potential offerors. History shows that there are several construction companies who will submit an offer for this type of heating work, which includes the heating lines and connection pieces of firm Brugg. Offerors might get different prices or discounts from the supplier.
7. Actions to Increase Competition:
As long as no other heating line brand is fully compatible to the make Brugg and no other leakage control system is fully compatible to the make Brandes and the Government does not exchange the existing Brugg and Brandes systems with another brand, system components of make Brugg and Brandes are needed. The only way to increase competition is to replace the entire existing district heating network (heating lines and leakage control system) throughout the Military Community Hohenfels by purchasing other brands, which would result in substantial duplication of cost.
8. Market Research:
a. DPW (Mr. Jacobi) conducted a market research between 1 April 2015 and 22 May 2015 by reviewing catalogs and other generally available product literature published by manufacturers, searching the internet and contacting the following knowledgeable individuals:
(1) Mr. Eckert (Tel. 09402-9095) from firm CONDUCT Planungsgesellschaft fuer
Versorgungstechnik mbH, an Architect-Engineering firm which performs construction designs;
(2) Mr. Alkhofer (Tel. 0941-69856181) from the Staatliches Bauamt Regensburg, a
General Engineer from the German Government responsible for construction projects;
(3) Mr. Ehrensberger (Tel. 09492-902077), a local construction contractor installing and repairing heating systems.
(4) Mr. Wanko (Tel. 0171-3301924), representative of firm Brugg Rohrsysteme GmbH, Wunstorf
b. All contacted parties confirmed that the various systems (leakage control system as well as heating lines) available on the market are incompatible and if the Government wanted to use another system, replacement of the existing system would be unavoidable. The different leakage control system manufacturers use different sensor technology, e.g. the “Nordic system” or the “Nickel-chromium” system. The Nordic system locates leakages by impulse reflection technology on copper wires with 10 kilo-ohms. The Brandes system uses the electrical resistance measurement technology working with nickel-chromium wires with a very
Annex 409-AI-A-00-01, Templates 14 high resistance value of 5 mega-ohms. The Brandes technology is approximately 500 times more exact than the Nordic system and is able to locate even minimal moisture values, whereas the Nordic system needs a high moisture value to enable location of leakages.
Moreover, the Brandes system enables remote reading at / reporting of the line leakage status to a central location by use of line / route computers with own firmware, which is not standard with the Nordic system.
c. Mr. Wanko from firm Brugg confirmed that there are several other heating line brands available on the market (e.g. German Pipe or Isoplus) which however cannot be mixed with the Brugg heating lines, as this would cause technical problems due to the different insulation and fittings needed. There are no standard fittings available that would match all brands.
Moreover, not all heating line manufacturers produce systems that allow connection of rigid with flexible heating lines, as is the case with Brugg. Thus, the brands are not compatible. At Hohenfels there are only Brugg heating lines installed.
d. In an attempt to find out if other heating lines could be used with the Brandes leakage control system the above information from Mr. Wanko was confirmed by Mr. Boentgen from firm Brandes (Tel. 04521-807-33) in a telephone conversation with Ms. Kahlert on 01 October 2015.
9. Interested Sources:
To date, no sources have expressed an interest. However, once the pre-solicitation notice is posed it is expected that several construction companies performing heating system work will show interest.
Synopsized on or is planned to be synopsized on/around 20 November 2015 Exception to synopsis applies in accordance with FAR:
5.202(a)(1) Synopsis cannot be worded to preclude disclosure of agency’s needs and disclosure would compromise national security.
5.202(a)(2) Contract action made under conditions described in 6.302-2 and the Government would be seriously injured if it complied with the time periods specified in 5.203.
5.202(a)(3) Contract action is one for which written direction from a foreign government reimbursing the agency for costs of the acquisition must be made to a specified source, or is made under the terms of an international agreement or treaty.
5.202(a)(4) Expressly authorized or required by statute to be made through another Government agency.
5.202(a)(5) Utility services and only one source is available (other than telecommunications).
5.202(a)(6) Contract action is placed using FAR 16.5 5.202(a)(7) Contract action is the result of a proposal accepted under the Small

5.202(a)(14) Contract action is made under conditions described in 6.302-3 with respect to the services of an expert to support the Federal Government in a current or anticipated litigation or dispute.
5.202(b) Head of the Agency has determined in writing that advance notice is not appropriate or reasonable.
10. Other Facts:
a. Subject requirement was procured competitively using IFB procedures. Five bids were received and ID/IQ contract W912PB-13-D-8002 was awarded on 2 July 2013. Only the pre-insulated long distance heating lines of make BRUGG, as well as the components for the repair and extension of the leakage control system of make BRANDES was procured under sole source procedures. All other work contained in the contract such as excavation work, line laying, welding and connection, as well as electrical and certain monitoring system connection work was and still is not considered sole source.
b. The recent market research revealed that there are still no other compatible long distance heating lines and connection pieces available that could be combined with the existing Brugg heating lines. In addition there are also no other compatible components for the existing leakage control system available that could be combined with the currently installed Brandes system. As a result thereof, no other brands can be used for the heating lines and its connection pieces and the sensor wires that will be integrated in the Brugg pre-insulated heating lines and connection pieces.
