However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. END OF ADDENDUM TO FAR 52.212-1
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Price
2. Technical
3. Past Performance
The Government will award a contract from this solicitation to the responsible offeror, whose quote conforms to the Request for Quotations (RFQ) and is the lowest price, receiving an acceptable rating for the non-price factors. This basis of award is known as the lowest-price, technically acceptable (LPTA) source selection process.
(b) Options. The Government will evaluate offers/proposals for award purposes by adding the total price for all options to the total price for the base period. To account for the possibility that the Government may utilize the "Option to Extend Services" provision at FAR 52.217-8 (for a period not to exceed six months), the Government will use the offered prices for all CLINs of the final option period, prorate them to a six-month value, then, add the prorated amount to the sum of all CLINs (base period plus all option periods). The resulting amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices appear to be significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO FAR 52.212-2
FAR 52.212-2 IS HEREBY TAILORED AS FOLLOWS:
a. The following is added as subparagraph (d):
BASIS FOR AWARD
The Government anticipates awarding a contract resulting from this RFQ under FAR Parts 13.5 to the responsible offeror whose quote conforms to the RFQ and whose quote represents the best value to the Government using LPTA source selection process. Award will be made on the basis of the lowest evaluated price meeting the technical acceptability and past performance acceptability standards as described in the RFQ. Technical acceptability will be based on a contractor submitting an offer that complies with all of the requirements listed in the RFQ and Performance Work Statement (PWS). A contractor’s ability to comply with all the requirements listed in the RFQ and PWS is met when they have received an “acceptable” rating on all non-price factors. Only one contract will be awarded from this RFQ on an all-or-none basis. Offerors must price ALL items. If all items are not priced, the offer will be rejected.
PART I - PRICING EVALUATION
(1) Evaluated price will equal total of amounts of all offer’s Line Items (CLIN) and shall be submitted in EUROs.
(2) All extended prices in Section B will be totaled to arrive at an evaluated price
(3) All extensions of the unit price shown in Section B will be subject to verification by the government. In case of variation between the unit price and the extension, the unit price will be considered to be the offer and the total recomputed accordingly. If the offeror provides a total amount for a contract line item but fails to enter the unit price, the amount divided by the specified quantity will be held to be the intended unit price.
(4) The Government will evaluate the reasonableness of the offered prices. Normally, adequate price competition establishes a fair and reasonable price. Analytical technique and procedures described in FAR 13.106-3 may be used, singly or in combination with others, to ensure that the final price is fair and reasonable.
(5) The Total Evaluated Price (TEP) is equal to the extended price of all CLINs in Section B and the prorated value of the six months option (FAR Clause 52.217-8). The Total Evaluated Price (TEP) will be evaluated based upon price reasonableness and the competitive range if one is established. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
PART II - TECHNICAL EVALUATION
At a minimum the Offeror’s submission must include the following:
(a) Quality Control (QC) Manager/Team Leader Qualifications. This factor is met when the proposed resume clearly shows the Quality Control Manager/Team Leader has a minimum of two (2) years of experience in speaking and writing the English language.
(b) This factor is met when the following special qualifications are provided by the offeror:
-VCA, Safety Management System ( Système de Gestion de la Sécurité);
- ISO 9001, 2008 Company Management System (Système de Management de l'Entreprise);
- ISO 14001, 2004 Compliance with Environmental Standards and Procedures (Respect des Normes et Procédures Relatives à l'Environnement).
Certificates will be provided with the offer.
(c) Key Personnel. This factor is met when the offeror provides a list of key personnel and their qualifications in accordance with paragraph 1.7.10 of the PWS. Contract/Project Manager and Alternate Contract/Project Manager shall have a minimum of two (2) years of experience in speaking and writing the English language and must justify a past experience of minimum three (3) years in cleaning/custodial contracts. This factor is met when the proposed resume clearly shows the Contract/Project Manager and Alternate Contract/Project Manager have a minimum of two (2) years of experience in speaking and writing the English language.
Additionally, the Contract/Project Manager and Alternate Contract/Project Manager shall not be the same person identified as the Quality Control (QC) Manager/Team Leader.
The following technical rating definitions will be used in the assessment of technical capability
